<p style="text-align: justify;"><strong><span lang="EN-US">Subject: Proceedings of the personal hearing given on 14/2/2023 by the Senior Environmental Engineer (ZP-1) of the Board to M/s </span></strong><span lang="EN-US"><strong>Preet Packager, Plot no. 416, Phase-9, Industrial Area, Mohali for non-compliance of the decisions of hearing dated 7/10/2022 and Show cause notice for refusal of consent to operate consent to operate applied under the Water Act, 1974 and the Air Act, 1981</strong></span></p>
<p style="text-align: justify;"><span lang="EN-US"> </span>Following were present:</p>

<p style="text-align: justify;"><span lang="EN-US">From the industry:</span></p>
<p style="text-align: justify;"><span lang="EN-US"> Sh. </span><span lang="EN-US">Baljeet Singh, Proprietor</span></p>
<p style="text-align: justify;"><span lang="EN-US"> </span></p>
<p style="text-align: justify;"><span lang="EN-US">It is intimated that the officer of the Board that the </span>industry was given personal hearing before the Senior Environmental Engineer on 7/10/2022, wherein, it was decided as under:</p>
<p style="text-align: justify;">1. The industry shall install adequate treatment facility to treat the wastewater generated from the process so as to achieve the prescribed standards of the Board.</p>
<p style="text-align: justify;">2. The industry shall not discharge any untreated wastewater into sewer/ drain/ choe under any circumstances.</p>
<p style="text-align: justify;">3. The industry shall apply consent to operate as required under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 within 7-days.</p>
<p style="text-align: justify;">4. The Environmental Engineer, Regional Office, SAS Nagar shall visit the site of the industry exact after 10-days to verify the statement given by the industry during hearing and to send comments/ recommendations thereafter. </p>
<p style="text-align: justify;">5. The Environmental Engineer, Regional Office SAS Nagar shall process the consent applications of the industry to be submitted by the industry on merits.</p>
<p style="text-align: justify;">To check the compliance of the decision of personal hearing as mentioned above, the site was visited by officer of the Board on 4/1/2023 and it was observed as under:</p>
<p style="text-align: justify;">1. The industry is engaged in manufacturing of Corrugated box & doing printing on it and same was in operation during visit.</p>
<p style="text-align: justify;">2. The industry has installed 3 no. corrugating machine, 02 cutting machine, 02 no. Stitching machine, 02 pasting machine and 2 no. printing machine.</p>
<p style="text-align: justify;">3. The effluent generated from washing of rollers of printing machine is disposed off into sewer without treatment.</p>
<p style="text-align: justify;">4. The industry has not obtained any Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 from the Board.</p>
<p style="text-align: justify;">5. The industry is covered under orange category as per categorization of the Board.</p>
<p style="text-align: justify;">6. The industry is located in industrial area approved for setting up of such type of industries.</p>
<p style="text-align: justify;">7. No source of air pollution has been installed by the industry.</p>
<p style="text-align: justify;">The industry had already been served notice for non-compliance of the decisions of hearing dated 7/10/2022 given by the Senior Environmental Engineer (ZP-1) of the Board alongwith an opportunity of personal hearing vide Board's letter no. 717-18 dated 27/1/2023 of personal hearing the Senior Environmental Engineer (ZP-1) of the Board on 14/2/2023. In the meantime, the industry has now applied fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for Corrugated Packaging Boxes @ 950 Kgs/day along with requisite documents. However, the project proponent was submitted regarding allotment letter approved from PSIEC vide no. 2825 dated 3/5/1995 for manufacturing of Finished Leather in the name of Baljit Singh. But the industry has submitted manufacturing process such as Raw Materialsà Paper Roll à Glue à Corrugation Machine à Corrugation Board à Slitter Machine à Die Cutting à Manual Slotting à Manual Print à Gum Pasting and Stitching à Banding and Finished Carton. While scrutinizing the application of the industry, the following observations were raised on 3/2/2023 with request to submit reply within 2 days. But no reply was received from the industry:</p>
<p style="text-align: justify;">1. The industry has submitted electricity bill as proof of date of commissioning but the connection as per the bill is in the name of Mehak Preet. However, the project proponent has submitted allotment letter in the name of Baljit Singh & in the authority letter, the project proponent has mentioned Baljit Singh as proprietor. Further, the project proponent has submitted letter from GMDIC issued to PSIEC in which date of production has been mentioned as 2/4/2003. Hence, proper proof of date of commissioning is required to adjudge adequacy of Consent to Operate fees.</p>
<p style="text-align: justify;">2. The industry was not mentioned water consumption & disposal details of the water used for washing of rollers of printing machine.</p>
<p style="text-align: justify;">3. The industry was not mentioned DG set detail in the application form.</p>
<p style="text-align: justify;">4. The industry was not submitted latest un-depreciated CA Certificate, so that the fees cannot be adjudged.</p>
<p style="text-align: justify;">The site was again visited by officer of the Board on 2/2/2023 and it was observed as under:</p>
<p style="text-align: justify;">1. The industry is engaged in manufacturing of Corrugated box & doing printing on it and same was in operation during visit.</p>
<p style="text-align: justify;">2. The industry has installed 03 corrugating machines, 02 cutting machines, 02 Stitching machines, 02 pasting machines and 2 printing machines.</p>
<p style="text-align: justify;">3. The effluent generated from washing of rollers of printing machine is disposed off into sewer without treatment. The industry was failed to install electric evaporator for the disposal of wastewater. Domestic wastewater is disposed off into MC sewer.</p>
<p style="text-align: justify;">4. The industry has not made any agreements for disposal of hazardous waste of category 5.2 i.e. cotton rags and 33.1 ink containers.</p>
<p style="text-align: justify;"><span lang="EN-US">The industry did not comply with the provisions of the Air (Prevention & Control of Pollution) Act, 1981 and operating its unit without obtaining the consent to operate of the Board and also not complied with the decisions of hearing dated 7/10/2022, willfully causing water and air pollution in the vicinity, thus, violating the provisions of the Water (Prevention & Control</span><span lang="EN-US"> of Pollution) Act, 1974 and the </span><span lang="EN-US">Air (Prevention & Control of Pollution) Act, 1981 intentionally and deliberately. It was proposed to refuse consent to operate applied under the Water (Prevention & Control</span><span lang="EN-US"> of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981</span><span lang="EN-US">, after affording an opportunity of show cause/ personal hearing. </span><span lang="EN-US">Therefore, the industry was show cause notice for refusal of consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 vide Board's letter no. 1016-17 dated 8/2/2023 alongwith an opportunity of personal hearing before the Senior Environmental Engineer (ZP-1) of the Board on 14/2/2023.</span></p>
<p style="text-align: justify;"><span lang="EN-US">The representative of the industry attended the personal hearing and informed that they have installed electric evaporator for the wastewater generated from washing of roller. They have made agreement for disposal of empty ink containers and are under process to make agreement for disposal of waste cotton rags.</span></p>
<p style="text-align: justify;"><span lang="EN-US"> </span><span lang="EN-US">After hearing the officers of the Board and the representative of the industry, the Senior Environmental Engineer (ZP-1) of the Board decided as under:</span></p>
<p style="text-align: justify;"><span lang="EN-US">1) The industry shall operate its </span><span lang="EN-US">electric evaporator to evaporate the wastewater generated from washing of roller regularly and efficiently so as to achieve the zero discharge and the industry shall not </span>discharge any untreated wastewater into sewer/ drain/ choe under any circumstances.</p>
<p style="text-align: justify;"><span lang="EN-US">2) The industry shall immediately apply authorization as required under the Hazardous & other Waste (Management & Transboundary Movement) Rules, 2016 also shall also make agreement with registered recyclers </span><span lang="EN-US">for disposal of empty ink containers and for disposal of waste cotton rags with requisite documents.</span></p>
<p style="text-align: justify;"><span lang="EN-US">3</span>) <span lang="EN-US">The Environmental Engineer, Regional Office, SAS Nagar shall visit the industry immediately to verify the statements of the industry, process the consent applications of the industry and send his report/ recommendations and also processed the authorization application to be applied by the industry under the Hazardous & Other Waste (Management & Transboundary Movement) Rules, 2016, on merits. </span></p>
<p style="text-align: justify;"><span lang="EN-US"> If approved, proceedings of the personal hearing as above may be conveyed to the industry and Environmental Engineer, PPCB, RO, SAS Nagar for compliance and sending the report, respectively.</span></p> |
