It is submitted that the subject cited industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Fresh/PTA/2022/20243482 dated 18.11.2022 for packaging of drinking water / soda @ 57 KLD by using water @ 80 KLD with the suitable conditions mentioned therein and special condition that the industry shall obtain necessary clearance for abstraction of ground water from Punjab Water Regulation and Development Authority.  A complaint from the residents of the nearby locality of the said unit was received regarding illegal abstraction of ground water by the unit. In the said complaint, it has been alleged that the residents in the area are already facing scarcity of water, but the said industry has installed borewell without any Govt. permission and illegally abstracting the ground water.  Accordingly, SDM, Rajpura has constituted a team vide office order no. 278-86 dated 13.10.2022 comprising of the following officers to check the industry surprisingly and submit its report: 1.        Tehsildar Rajpura 2.        SDO, PPCB, Rajpura at Patiala 3.        SDO, Deptt. of Water Supply and Sanitation, Rajpura 4.        SDO, PWSSB, Rajpura 5.        SHO City, Rajpura The team constituted by the Sub Divisional Magistrate has visited the site on 14.10.2022 and found the industry operational. A borewell  of size 6” dia and 350 ft depth (federal make) & consumption of water as shown by the flow meter was recorded to be 233975 KL, was observed in the premises of the industry from where the ground water was extracted. The Deputy Commissioner, Patiala vide its office letter no. 1234 dated 18.11.2022 requested the Board to initiate immediate action against the unit for the violation reported by the above mentioned team as per the guidelines / Rules of NGT and Government. The team constituted by the Sub Divisional Magistrate again visited the site of the industry on 13.12.2022. After inspection, it was observed that the industry i.e. M/s Anand Beverages is a bottling-cum-packaging unit and has installed 1 no. borewell for extraction of ground water. The industry has not obtained permission from the Department of Water Resources (PWRDA) for extraction of ground water.  Accordingly, the Consent to Operate granted to the industry under Water Act, 1974 was revoked vide Board’s letter no. 7682 dated 14.12.2022 due to reasons as mentioned therein.   Also, the industry was served with notice to issue directions u/s 33-A of the Water Act, 1974, alongwith opportunity of personal hearing before Chairman of the Board on 03.01.2023. After the hearing, it was decided as under: 1.    The industry shall submit the registration obtained by M/s United Breweries Ltd. under the Plastic Wastes Management Rules, 2016 to the Environmental Engineer, Punjab Pollution Control Board, Regional Office, Patiala within 15 days. 2.    The industry is liable to pay Environmental Compensation for extraction of ground water without permission of the Competent Authority for the period of violation from 18.09.2018 to 23.12.2022 in accordance with the mandate of the orders of the Hon'ble National Green Tribunal passed in O.A No. 438 of 2018 for which separate order will be passed. 3.    The industry shall apply for consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 within 15 days. 4.    Environmental Engineer, Regional Office, Patiala shall visit the industry immediately after 15 days and submit his conclusive report/recommendations. 5.    Further action, shall be taken after the receipt of report/recommendations from the Environmental Engineer, Regional Office, Patiala.   The proceedings/directions were conveyed to the industry vide letter no. 332 dated 17.01.2023 for compliance.   Now the industry has submitted application for obtaining fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 under orange category alongwith requisite documents. The industry has already deposited consent fee, which is now adequate upto 30.06.2027 under Water Act 1974. The industry vide undertaking dated 24.01.2023 has submitted reply of the decisions of personal hearing held on 03.01.2023, which is attached in application.  Further, the industry has submitted the copy of registration obtained by M/s United Breweries Ltd., UB Tower, UB city, # 24, Vittal Mallya Road, Bengalurur, 560001 under the Plastic Waste Management Rules, 2016 is attached in application.   The industry was visited by the AEE of this office on 13.02.2023 and Sh. Ashwani Mehta /Manager was present at the time of visit. During visit, it was observed as under:   <p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 18.0pt; mso-list: l1 level1 lfo3; background: white; margin: 0in 0in .0001pt 40.5pt;">1.     The industry was in operation. The industry is engaged in the business of manufacturing of packaged drinking water & soda by using water as raw material. The industry is also manufacturing PET bottles used for bottling of processed water & soda, within its premises by using PET preform as raw material. The industry has also installed blow-moulding machines for the same, within its premises. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 18.0pt; mso-list: l1 level1 lfo3; background: white; margin: 0in 0in .0001pt 40.5pt;">2.     The industry has provided new EMF meter at borewell for abstraction of ground water, on 23.12.2022 as informed by representative. The reading at time of visit in 1441.958 m3. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 18.0pt; mso-list: l1 level1 lfo3; background: white; margin: 0in 0in .0001pt 40.5pt;">3.     The RO reject is being utilized for various activities such as flushing, floor washing, cooling tower in its premises. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 18.0pt; mso-list: l1 level1 lfo3; background: white; margin: 0in 0in .0001pt 40.5pt;">4.     The industry has provided septic tank for domestic effluent and same after mixing with RO-Reject is being discharged into public sewer. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 18.0pt; mso-list: l1 level1 lfo3; background: white; margin: 0in 0in .0001pt 40.5pt;">5.     The reading of TDS meter at RO reject is 1119 PPM. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 18.0pt; mso-list: l1 level1 lfo3; background: white; margin: 0in 0in .0001pt 40.5pt;">6.     The industry has installed one no. DG set of capacity 125 KVA which was equipped with canopy & adequate stack height. <p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 18.0pt; mso-list: l1 level1 lfo3; background: white; margin: 0in 0in .0001pt 40.5pt;">7.     The industry has not installed any other source of air pollution like boiler, furnace etc, within its premises.             The industry has now complied with decisions of personal hearing except point no. 2 i.e.  deposition of Environmental Compensation and is also complying with the provisions of Water Act, 1974 and Air Act, 1981.   <span style="font-size: 11.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-ansi-language: EN-IN; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;">In view of the above, it is recommended that the consent to operate under the Water Act, 1974 and maybe granted upto 30.09.2026 with suitable conditions.
