<p style="text-align: justify;">The agenda note and report / recommendations of AEE/EE, RO, may kindly be perused.</p>
<p style="text-align: justify;">The industry is a small scale red category dyeing unit and was granted consent to operate under the Water Act, 1974 & Air Act 1981, both valid upto 30.06.2023 for manufacturing of Fancy Yarn @ 1000 Kgs/day & Dyeing of Yarn/Fabric @ 3100 Kgs/day with discharge of trade effluent @ 360 KLD into sewer after ETP & domestic effluent @ 1.0 KLD into sewer along with one boiler of capacity @ 05 TPH & 02 DG set of capacity 250 KVA & 200 KVA with conditions mention therein.</p>
<p style="text-align: justify;">The CETP 50 MLD has been in continuous operation since February, 2022. Presently, the industry is discharging its effluent into CETP 50 MLD through dedicated conveyance system.</p>
<p style="text-align: justify;">A complaint had been received against the dyeing industries located at Tajpur Road, Ludhiana on 20.05.2022 and 21.05.2022 regarding stagnation of untreated effluent in different area at Tajpur Road. A lot of hue and cry is being caused among the general public due to stagnation of untreated effluent.</p>
<p style="text-align: justify;">Accordingly, directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 were issued to the industry that the industry to operate only at 50% of the consented production capacity, till the dedicated conveyance line leading to CETP, 50 MLD is cleared and no stagnation occurs in the area. 50 % of dyeing machinery of the industry be sealed.</p>
<p style="text-align: justify;">In compliance of above said directions, 50 % of dyeing machinery of the industry was sealed by the Board.</p>
<p style="text-align: justify;">M/s Punjab Dyer Association (SPV),Tajpur Road Module, Ludhiana vide its letter dated 22.07.2022 had submitted the letter regarding intimidation of the tentative share of the CETP, 50 MLD, Tajpur Road, Ludhiana amongst the dyeing members of Tajpur Road, Ludhiana. As per the list, the industry has been temporarily allotted shares of 317 KLD. These shares are temporary/tentative and their finalization is under the consideration of the Board.</p>
<p style="text-align: justify;">M/s Punjab Dyer Association (SPV),Tajpur Road Module, Ludhiana vide its email dated 04.08.2022 has submitted the latest report conducted by the Guru Nanak DevEngg College (GNE), regarding effluent discharge quantity of dyeing units of Tajpur Road, Ludhiana. This study was done by the GNE on entire existing dyeing machinery (Sealed and un-sealed) installed inside the dyeing units, by physically inspecting the site of each unit. As per the GNE report 2022, the industry has installed machinery for discharge of 609.6 KLD.</p>
<p style="text-align: justify;">The shares allotment is under consideration of the Board and to regulate the quantum of effluent reaching the CETP, the Competent Authority of the Board had decided to temporarily restrict the quantum of effluent discharged from the industries, to the lesser quantum out of GNE report 2022 and tentative shares intimated by PDA vide its letter dated 22.07.2022. As such, the quantum of effluent discharge from the industry is temporarily required to be restricted to 317 KLD.</p>
<p style="text-align: justify;">Accordingly, directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 were issued to the industry that the industry to operate only at 52 % of the machinery as per GNE report -2022. As the 50% dyeing machinery of the industry is already sealed, accordingly 2 % of dyeing machinery of the industry be de-sealed. Further, if any new machinery has been installed by industry after GNE report 2022 be sealed</p>
<p style="text-align: justify;">Now, the industry has applied for varied consent to operate under the Water Act, 1974 & the Air Act, 1981 for manufacturing of Fancy Yarn @ 1020 Kgs/day & Dyeing of Acrylic Yarn @ 2980 Kgs/day with discharge of trade effluent @ 317 KLD & domestic effluent @ 1.0 KLD into conveyance system of CETP 50 MLD alongwith one boiler of capacity @ 05 TPH & 02 DG set of capacity 250 KVA & 250 KVA.</p>
<p style="text-align: justify;">The industry has deposited consents fee, which is adequate upto 30.06.2029 (Water) & 30.06.2028 (Air).</p>
<p style="text-align: justify;">The industry was visited by the AEE of RO on 02.02.2023 and it was observed as under:-</p>
<p style="text-align: justify;">1. The industry was in operation, during visit.</p>
<p style="text-align: justify;">2. The industry has installed 17 cabinet dyeing machines (120 Kgs X 4, 90 Kgs X 3, 60 Kgs X 10) in its premises. Out of which, 02 cabinet of 120 Kg & 06 cabinet of 60 kg are already sealed by the Board, due to excess discharge of effluent as comparison to shares allotted to it.</p>
<p style="text-align: justify;">3. The study on effluent generation has been done by the Guru Nanak Dev Engineering College (GNE) and as per report it has total effluent generation in 24 hours as 609.6 KLD from 7 cabinet dyeing machines (120 Kgs X 4, 90 Kgs X 3, 60 Kgs X 10). However, the industry has granted 317 KLD shares on 22.07.2022 of CETP, hence the discharge of the industry was 292.6 KLD more than the share allotted to it in 24 hours.</p>
<p style="text-align: justify;">4. The industry is connected with the conveyance system of CETP 50 MLD, Tajpur Road, Ludhiana for discharge its effluent. The industry has provided the flow meter at its final outlet leading to CETP. The industry was also advised to provide the flow meter at inlet water supply.</p>
<p style="text-align: justify;">5. The industry has installed one boiler of 05 TPH capacity and cyclone separator has been provided as APCD along with stack of adequate height.</p>
<p style="text-align: justify;">6. The industry was using wood/ agro waste as fuel in the furnace of boiler.</p>
<p style="text-align: justify;">7. Air emission samples of the industry were collected by RO on 24.11.2022 and as per the analysis report SPM was 109 mg/Nm3, which was found within limits.</p>
<p style="text-align: justify;">8. The industry has installed two DG sets of capacity 250 KVA each with canopies and stacks of adequate height.</p>
<p style="text-align: justify;">9. Further, some units have made the complaint regarding in judicial allotment of the shares by the PDA, Tajpur Road, Ludhiana, which is under process at Board and at Govt. Level.</p>
<p style="text-align: justify;">10. The industry vide its letter dated 30.01.2023 has submitted as under:</p>
<p style="text-align: justify;">"Our unit has total dyeing machines of (60 kgs) 10 machines (120 kgs) 4 machines and (90 kgs) 3 machines. We are engaged in dyeing of different shade of yarns. Yarns being dyed under market shade from light to dark. Before sealing all these machines were reserved for particular shades (light to dark). Our 50% dyeing machines that is (60kgs) 6 machines, (120 kgs) 2 machines has been sealed by the board. Due to which our whole process of dyeing has been disturbed as we cannot do dyeing of required shades. It is informed that study of effluent discharge by GNE has been carried on 24 hours. But we have never operated our unit beyond 12 hour. We have also planned to operate for 12 hours after de sealing of machinery. Therefore our effluent generate will be around 300kld in 12 hours. We have also installed flow meter at effluent discharge to CETP. Our discharge is around 300 KLD, CETP share has been granted for 317 KLD, therefore our discharged in 12 hours (single shift) will be less then allotted shares of CETP. It is there for requested that our dyeing machinery be de-sealed for single shift (12hours), so that we can do dyeing of required shade as per market demand".</p>

The industry has provided arrangement for reusing excess cooling water in process and steam condensate in boiler. The surplus draining of cooling water/ steam condensate can be taken as i.e. 14 KLD (5 TPH x 80% X12 hr X 30% draining of steam into effluent). Hence total effluent discharge by the industry can be around 230 KLD + 14 KLD= 244 KLD in 12 Hours.</p>
<p style="text-align: justify;">As per the record of online meter installed by the industry at final outlet leading to CETP the average discharge from last three months (01.11.2022 to 31.01.2023) is around 250 KLD.</p>
<p style="text-align: justify;">As per the Common land use certificate issued by the DTP vide letter no. 1313-DTP(L)/I-16 dated 13.04.2011. Right side of the Tajpur Road falls in the Residential Zone and left side to the falls in the Industrial Zone. This unit falls on main Tajpur Road left side on Buddha Nallah.</p>
<p style="text-align: justify;">Till the finalization of the allotment of the shares of CETP 50 MLD, it is recommended that:</p>
<p style="text-align: justify;">A. Consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 may be granted for one year with usual conditions & special condition that the industry got analyzed it stack emission samples within 01 month.</p>
<p style="text-align: justify;">B. Consent to operate Water Act, 1974 may be granted to the industry temporarily for 3 months for discharge of effluent @ 317 KLD (TE @ 316 KLD & DE @ 1 KLD) into CETP 50 MLD as an interim arrangements so as to check the discharges from Members industries and the efficiency of the CETP subject to suitable conditions and with special conditions that:-</p>
<p style="text-align: justify;">1. The consent is an interim arrangements so as to check the discharges from Members industry and the efficiency of the CETP.</p>
<p style="text-align: justify;">2. The consent is based on tentative intimidation of the shares by PDA dated 22.7.2022 and GNE report of 2022, as such, it is a temporary arrangement, it will not convey any right to the industry to tentative shares intimated by SPV vide letter dated 22.7.2022.</p>
<p style="text-align: justify;">3. The member industry shall install effluent measuring devices at the outlet of the industry leading to conveyance system of CETP within the validity of consent for verification of the discharges.</p>
<p style="text-align: justify;">4. The industry shall ensure that no new machinery is installed without prior permission of the Board.</p>
<p style="text-align: justify;">5. The consent is an interim measure in-accordance to tentative shares intimated by PDA to the Board vide its letter dated 22.07.2022. These shares are temporarily considered and their finalization is under the consideration of the Board.</p>
<p style="text-align: justify;">6. The member units and PDA shall ensure that total effluent intake into the CETP, Tajpur Road, Ludhiana from the existing units will never be exceed 40 MLD.</p>
<p style="text-align: justify;">7. The industry as well as M/s Punjab Dyer Association (SPV), Tajpur Road Module, Ludhiana will comply with the undertaking submitted by SPV dated 22.09.2022.</p>
<p style="text-align: justify;">8. The PDA shall ensure the working of Inlet and outlet online flow-meters at CETP and shall also provide standby flow meters for the same to ensure their regular working at CETP site.</p>
<p style="text-align: justify;">9. The online flow meters at the inlet water source of all member units shall be installed within 4 months. The online connectivity of these flow meters of all units shall be ensured so as to check the discharge allowed by the Board.</p>
<p style="text-align: justify;">10. The member industry and M/s Punjab Dyer Association (SPV),Tajpur Road Module, Ludhiana shall provide online meters at the outlet of all the dyeing units and to check, update / calibrate this online system so as to provide the regular and exact data of effluent discharge by individual units and in consonance to the effluent received at CETP within 1 week. </p>
<p style="text-align: justify;">11. The PDA, Tajpur Road, Ludhiana shall ensure that no overflow of effluent will takes place from the conveyance system at any time and if such things happen, immediately the concerned industries discharging effluent in that line will be closed.</p>
<p style="text-align: justify;">12. All member units shall have only one outlet jointly for domestic and trade effluent for discharge into the conveyance system of CETP, 50 MLD Tajpur Road, Ludhiana. There shall be no bypass from any dyeing unit.</p>
<p style="text-align: justify;">13. M/s Punjab Dyer Association (SPV),Tajpur Road Module, Ludhiana or individual industry shall not to execute any trading/ transfer of CETP's shares without prior permission of the Competent Authority of the Board. The PDA or the individual industry will be responsible for any loss due to trading of shares.</p>
<p style="text-align: justify;">14. The PDA, Tajpur Road, Ludhiana and individual member unit shall be liable to pay Environmental Compensation for any lapse in undertaking submitted by SPV dated 22.09.2022.</p>
<p style="text-align: justify;">15. It is made clear that in case of failure of commitment made by PDA vide its undertaking dated 22.09.2022, the Board shall be constraint to take strict action in accordance to law, on SPV as well as individual members without any further notice.</p>
<p style="text-align: justify;">16. The PDA is again directed to ensure that it achieves the prescribed standards at the outlet of CETP within one month, failing which the Board shall be constrained to order the closure of all the member industries attached with the CETP.</p>
<p style="text-align: justify;">C. The decision regarding de-sealing of the dyeing machinery of the industry may also be considered after finalization of shares.</p>
