<p style="text-align: justify;">It is submitted that the subject cited industry is a member of 50 MLD CETP. The tentative shares allotment of the member units was submitted by PDA vide its letter dated 22.07.2022, which was under consideration of the Board. The Competent Authority of the Board has directed to take interim actions as per e-noting no. 19582356. The application is being processed in light of directions given in the above said e-noting.</p>
<p style="text-align: justify;">The industry was granted ‘Consent to Establish’ / NOC under the provisions of the Water Act, 1974 & the Air Act, 1981, valid upto 08.08.2022 for dyeing of polyester fabric @ 4800 kgs./day, Dyeing of acrylic yarn @ 720 kg/day for discharge of trade effluent @ 170 KLD discharge into sewer leading to CETP 50 MLD & domestic effluent @ 2 KLD into sewer with conditions mentioned therein.</p>
<p style="text-align: justify;">The industry was issued show cause notice for refusal of consents to submit share allotment certificate duly signed by Chairman, Directors and Company Secretary of CETP 50 MLD. But the industry has failed to submit the same and accordingly consents were refused dated 06.01.2023. <strong>Earlier, the consents were refused as the industry was treated as a new upcoming unit, which were not allowed till the finalization of shares.</strong></p>
<p style="text-align: justify;">Now, as per the report of RO, the industry vide its letter received with consent application has informed that they have shifted their unit from Ganesh Nagar, Link Road to Tajpur Road and obtain the share certificate from 200 KLD dated 08.06.2020. The industry has also informed that they have setup their unit & invested all money at this site after getting NOC from the Board.</p>
<p style="text-align: justify;">Further as per the record the industry has been also granted NOC by the Board for the establishment of the unit at present site after shifting from Ganesh Nagar. As per report from Regional office-1, Ludhiana that M/s Hindustan Dyeing, Ganesh Nagar, Link Road, Near Samrala Chownk Ludhiana has closed down its dyeing operation at the site. The site was visited by officer of the Board on 24/9/2021 and it was observed that no dyeing machinery or boiler was at site.</p>
<p style="text-align: justify;">Now, the industry has again applied consent to operate under the Water Act, 1974 and under Air Act, 1981 for dyeing of polyester fabric @ 4800 kgs./day, Dyeing of acrylic yarn @ 720 kg/day for discharge of trade effluent @ 170 KLD & domestic effluent @ 2 KLD into conveyance system of CETP 50 MLD. The industry has deposited consents fee, which are adequate upto 30.09.2027 under both acts.</p>
<p style="text-align: justify;">The industry was visited by officer of RO on 03.11.2022 and it was observed as under:-</p>
<p style="text-align: justify;">1. The industry was in operation during visit.</p>
<p style="text-align: justify;">2. The industry has installed the 2 soft flow of 03 chambers each and 02 soft flow of 02 chambers each i.e. total 10 chambers. The industry is recently commissioned, hence it is not included in GNE 2022 report, however, as per the calculation done by the GNE in other units, the total effluent generation from 10 chambers will be around 200 KLD for 24 hour operation. However, the industry has applied for the consent for the discharge of trade & domestic effluent @ 172 KLD.</p>
<p style="text-align: justify;"><strong>3. The industry has granted 200 KLD shares by the PDA, Tajpur Road, Ludhiana vide letter dated 22.07.2022 for discharge of effluent into CETP 50 MLD.</strong></p>
<p style="text-align: justify;">4. The industry has installed one boiler of capacity 03 TPH with twine cyclone separator as APCD in which agro waste was being used as fuel and adequate stack height has been provided. The furnace is also FBC based.</p>
<p style="text-align: justify;">5. The industry has also installed one DG sets of capacity 125 KVA with canopy and adequate height.</p>
<p style="text-align: justify;">6. The industry is connected with the conveyance system of CETP 50 MLD, Tajpur Road, Ludhiana for discharge its effluent. The industry yet has not provided the flow meter at its final outlet leading to CETP. The owner of the industry informed that same is yet to be provided by the PDA, Tajpur Road, Ludhiana. The industry was also advised to provide the flow meter at inlet water supply.</p>
<p style="text-align: justify;">7. Further, some units have made the complaint regarding in judicial allotment of the shares by the PDA, Tajpur Road, Ludhiana, which is under process at Board and at Govt. Level.</p>
<p style="text-align: justify;">In this case the SPV has allotted the share without prior approval of the Competent Authority of the Board.</p>
<p style="text-align: justify;">As per the Common land use certificate issued by the DTP vide letter no. 1313-DTP(L)/I-16 dated 13.04.2011. Right side of the Tajpur Road falls in the Residential Zone and left side to the falls in the Industrial Zone. This unit falls on main Tajpur Road left side on Buddha Nallah.</p>
<p style="text-align: justify;">As the industry has been shifted from scattered area to CETP compatible zone and NOC has been already granted by the Board, hence, till the finalization of the allotment of the shares of CETP 50 MLD, it is recommended that:</p>
<p style="text-align: justify;">A. Consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 may be considered for grant for one year with special condition that the industry shall got analyzed its stack emission samples of boiler within 01 month, please..</p>
<p style="text-align: justify;">B. Consent to operate Water Act, 1974 may be granted to the industry temporarily for 3 months for discharge of effluent @ 172 KLD (TE @ 170 KLD & DE @ 2 KLD) into CETP 50 MLD as an interim arrangements so as to check the discharges from Members industries and the efficiency of the CETP subject to suitable conditions and with special conditions that:-</p>
<p style="text-align: justify;">1. The consent is an interim arrangements so as to check the discharges from Members industry and the efficiency of the CETP.</p>
<p style="text-align: justify;">2. The consent is based on tentative intimidation of the shares by PDA dated 22.7.2022 and GNE report of 2022, as such, it is a temporary arrangement, it will not convey any right to the industry to tentative shares intimated by SPV vide letter dated 22.7.2022.</p>
<p style="text-align: justify;">3. The member industry shall install effluent measuring devices at the outlet of the industry leading to conveyance system of CETP within the validity of consent for verification of the discharges.</p>
<p style="text-align: justify;">4. The industry shall ensure that no new machinery is installed without prior permission of the Board.</p>
<p style="text-align: justify;">5. The consent is an interim measure in-accordance to tentative shares intimated by PDA to the Board vide its letter dated 22.07.2022. These shares are temporarily considered and their finalization is under the consideration of the Board.</p>
<p style="text-align: justify;">6. The member units and PDA shall ensure that total effluent intake into the CETP, Tajpur Road, Ludhiana from the existing units will never be exceed 40 MLD.</p>
<p style="text-align: justify;">7. The industry as well as M/s Punjab Dyer Association (SPV), Tajpur Road Module, Ludhiana will comply with the undertaking submitted by SPV dated 22.09.2022.</p>
<p style="text-align: justify;">8. The PDA shall ensure the working of Inlet and outlet online flow-meters at CETP and shall also provide standby flow meters for the same to ensure their regular working at CETP site.</p>
<p style="text-align: justify;">9. The online flow meters at the inlet water source of all member units shall be installed within 4 months. The online connectivity of these flow meters of all units shall be ensured so as to check the discharge allowed by the Board.</p>
<p style="text-align: justify;">10. The member industry and M/s Punjab Dyer Association (SPV),Tajpur Road Module, Ludhiana shall provide online meters at the outlet of all the dyeing units and to check, update / calibrate this online system so as to provide the regular and exact data of effluent discharge by individual units and in consonance to the effluent received at CETP within 1 week. </p>
<p style="text-align: justify;">11. The PDA, Tajpur Road, Ludhiana shall ensure that no overflow of effluent will takes place from the conveyance system at any time and if such things happen, immediately the concerned industries discharging effluent in that line will be closed.</p>
<p style="text-align: justify;">12. All member units shall have only one outlet jointly for domestic and trade effluent for discharge into the conveyance system of CETP, 50 MLD Tajpur Road, Ludhiana. There shall be no bypass from any dyeing unit.</p>
<p style="text-align: justify;">13. M/s Punjab Dyer Association (SPV),Tajpur Road Module, Ludhiana or individual industry shall not to execute any trading/ transfer of CETP's shares without prior permission of the Competent Authority of the Board. The PDA or the individual industry will be responsible for any loss due to trading of shares.</p>
<p style="text-align: justify;">14. The PDA, Tajpur Road, Ludhiana and individual member unit shall be liable to pay Environmental Compensation for any lapse in undertaking submitted by SPV dated 22.09.2022.</p>
<p style="text-align: justify;">15. It is made clear that in case of failure of commitment made by PDA vide its undertaking dated 22.09.2022, the Board shall be constraint to take strict action in accordance to law, on SPV as well as individual members without any further notice.</p>
<p style="text-align: justify;">16. The PDA is again directed to ensure that it achieves the prescribed standards at the outlet of CETP within one month, failing which the Board shall be constrained to order the closure of all the member industries attached with the CETP.</p>
