<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 14.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">It is submitted that the industry is a small scale red category unit and has been granted Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/LDH4/2022/20070066 dated 16.11.2022 valid upto 30.06.2027. </span></p>
<p class="MsoNormal" style="margin-left: -4.5pt; text-align: justify; text-indent: 40.5pt; line-height: 115%;"><span style="font-size: 14.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">Earlier, the industry was surprisingly visited by officer of the Board on 16.11.2022 regarding identification of the chemicals used by the industry in its process of acid pickling as the industry has made an agreement with Keshav Chemical Marketing Company, E-578, Phase-7, Focal Point, Ludhiana for lifting of its trade effluent @ 2000 ltr/month. Accordingly, the effluent sample was collected from the trade effluent collection tank of the industry and as per the results of analysis report, the industry is using HCL in its process. The industry was found violating the provisions of Water (Prevention & Control of Pollution) Act, 1974 as it is lifting HCL containing trade effluent to the re-processor facility. </span></p>
<p class="MsoNormal" style="margin-left: -4.5pt; text-align: justify; text-indent: 40.5pt; line-height: 115%;"><span style="font-size: 14.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">Accordingly, the consent to operate under the Water Act, 1974 was revoked vide Zonal Office -2, Ludhiana letter no. 616 dated 10.02.2023 and directions u/s 33- A of the Water Act, 1974 was issued to the PSPCL Authorities for disconnecting the electric connection of the industry vide Board letter no. 621 dated 10.02.2023.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 14.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">Now, the industry has applied for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 through OCMMS and made request for restoring the electric connection. The industry has deposited Consent fees Rs. 39,300/- vide R. No. 1011I27713559881 dated 11.10.2022 under the Water Act, 1974 including penalty fee and Rs. 2,200/- vide R. No. 1011I27713554541 dated 11.10.2022 as NOC regularization fee, which is adequate upto 30.06.2026 against the gross value of fixed assets Rs. 89,17,369.15 and plant & machinery Rs. 70,34,093.00 as on 31.03.2022.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in; line-height: 115%;"><span style="font-size: 14.0pt; line-height: 115%; font-family: 'Bookman Old Style',serif;">To verify the facts, the industry was visited by the undersigned on 16.02.2023 and it was observed as under:-</span></p>

<p class="MsoListParagraph" style="margin-left: .5in; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1; tab-stops: .5in;"><!-- [if !supportLists]--><span style="font-size: 14.0pt; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 14.0pt; font-family: 'Bookman Old Style',serif; mso-bidi-font-family: Tahoma;">The industry has made an agreement with M/s Keshav Chemicals Marketing Company, Phase-8, Focal Point, Ludhiana on dated 04.10.2022 for lifting of effluent @ 2,000 Liter/Month.</span></p>
<p class="MsoListParagraph" style="margin-left: .5in; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1; tab-stops: .5in;"><!-- [if !supportLists]--><span style="font-size: 14.0pt; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 14.0pt; font-family: 'Bookman Old Style',serif; mso-bidi-font-family: Tahoma;">The industry is maintaining the record of total water consumption viz-a-viz effluent lifted. </span></p>
