<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -36.0pt; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 1;"> </span><span style="mso-spacerun: yes;"> </span><span style="mso-tab-count: 1;"> </span>Sir, it is intimated that the industry is tiny unit and falls in industrial mix land use area as per DTP, Ludhiana letter no. 2729 dated 07.12.2022. Earlier a complaint has been received against the industry by nearby residents regarding noise pollution caused by the industry. To verify the contents of complaint, the industry was visited by officer of the Board on 22.04.2022 and it was observed that:-</span></p>

<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; line-height: 150%; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; mso-bidi-font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry has installed 02 lathe machines, 01 shaper machine, 02 drill machine, 01 cutting machine and 01 hacksaw.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; line-height: 150%; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; mso-bidi-font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">During visit, the noise monitoring of the industry was carried out from complainant's house and the noise level in the house of complainant was observed 36.4 dB(A), when the machines were not in operation and noise level was observed as 40.6 dB(A) when the machines were in operation.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry was issued show cause notice by this office vide no. 277 dated 25.04.2022 with the opportunity of filling the reply if any, within 15 days. However, the industry was failed to submit the reply in this regard.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin-left: 0cm; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-spacerun: yes;"> </span><span style="mso-tab-count: 1;"> </span>Keeping in view of above, it was recommended to Zonal Office-1, Ludhiana for taking action u/s 33-A of Water Act, 1974 & u/s 31-A of Air Act, 1981 against the industry for its closure. But after discussion regarding Water Pollution/Air Pollution/Noise pollution caused by the industry, it was decided by the Competent Authority that the complainant may be informed that there is no source of Water &<span style="mso-spacerun: yes;"> </span>Air pollution and noise levels are within permissible limit. In compliance of above, the complainant has been informed vide this office letter no. 2110 dated 16.02.2023 accordingly. The complaint has been disposed off.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -36.0pt; line-height: 150%;"><span style="mso-spacerun: yes;"> </span><span style="mso-tab-count: 2;"> </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">Now, the industry has applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 with requisite documents i.e. CA certificate regarding gross block value of fixed assets for Rs. 4.29 lac, approved building plan, MSME certificate as a date of commencement proof, Manufacturing process chart, Proprietorship certificate, Copy of registry, DTP certificate regarding land use pattern of site of the industry etc. The industry is claiming VDS scheme announced by the Board vide order No. 394 dated 21.11.2022. The industry is being operated since 2006. The industry has deposited consent fee for Rs. 9400/- vide R.No. 423330831 dated 01.02.2023 & Rs. 8300/- vide UTR No. 000756985711 dated 27.12.2022 under Water Act, 1974, Rs. 9800/- vide R. No. 325202893 dated 10.02.2023, Rs. 3300/- vide UTR No. 000756987997 dated 27.12.2022. The industry is required to be deposit Rs. 10000/- under VDS scheme as the industry is put into commission before 2010 i.e. 2006 and<span style="mso-spacerun: yes;"> </span>Rs. 4200/- for the period of 2018 to 2023 under Water & Air Act separately, Rs. 700/- for NOC regularization fee<span style="mso-spacerun: yes;"> </span>i.e. <span style="mso-spacerun: yes;"> </span>(Rs. 14200 + Rs. 14200 + Rs. 700= Rs. 29100/-). Consent fee deposited by the industry is adequate upto 31.03.2024.</span></p>

<p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">There is no boiler/furnace/DG set installed in the industrial premises.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-spacerun: yes;"> </span><span style="mso-tab-count: 1;"> </span>Keeping in view of above, it is recommended that consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31.08.2023 with usual conditions as per policy of the Board & with special condition that:</span></p>
<p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; line-height: 150%; mso-list: l2 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry shall shift its industrial unit in designated industrial area/zone in compliance of sitting guidelines of notified Master Plan, Ludhiana.</span></p>
<p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; line-height: 150%; mso-list: l2 level1 lfo3;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry shall comply with the Noise (Pollution and Control) Rules, 2000 at all time. </span></p>
