File Note: <p style="text-align: justify;">The agenda note and report / recommendations of AEE/EE, RO, may kindly be perused.</p> <p style="text-align: justify;">The industry was granted &lsquo;Consent to Operate&rsquo; under the Water Act, 1974 &amp; Air Act, 1981 for manufacturing of tubes @ 24700 Numbers/Day and Tyres @ 6000 Numbers/Day, valid upto 30.06.2023 each.</p> <p style="text-align: justify;">&nbsp;&nbsp;&nbsp;&nbsp;Thereafter, the industry was visited by officer of the Board on 03.12.2021 and it was observed that the industry was installing new boiler of capacity 8 TPH without obtaining &lsquo;Consent to Establish&rsquo; / NOC from the Board and was also violating the provisions of the Air Act, 1981 by not operating APCD with the existing boiler of capacity 3.5 TPH. Effluent samples were also collected from STP provided by the industry and concentration of various parameters was found beyond the prescribed limits of the Board.</p> <p style="text-align: justify;">Meanwhile, the industry had applied for obtaining &lsquo;Consent to Establish&rsquo;/NOC for expansion under the Water Act, 1974 and under the Air Act, 1981. The industry was given personal hearing before the Senior Environmental Engineer, Zonal Office-2, Ludhiana, wherein it was decided that</p> <p style="text-align: justify;"><!-- [if !supportLists]-->1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry shall maintain and operate its sewage treatment plant (STP), regularly and efficiently, so as to achieve the effluent standards, consistently as prescribed by the Board/ MoEF&amp;CC.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry shall either get its effluent sample analyzed from Board's/NABL Lab or submit the copy of same in the office of Environmental Engineer, Regional office-3, Ludhiana, within 10 days.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->Environmental Engineer, Regional office-3, Ludhiana shall visit the site of the industry, verify the compliances, process the NOC application on merits and send the report alongwith recommendations, within 05 days.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->Further action in the matter will be taken after receipt of report from Environmental Engineer, Regional office-3, Ludhiana.</p> <p style="text-align: justify;">Thereafter, the industry was again visited by officer of the Board on 25.02.2022 and it was observed that the industry failed to comply with the decisions of personal hearing and was still violating the provisions of the Water Act, 1974 and the Air Act, 1981.</p> <p style="text-align: justify;">Accordingly, Consent to Establish / NOC expansion application was refused vide no. CTE/EXP/LDH3/2022/17622882 dated 03.03.2022.</p> <p style="text-align: justify;">The industry was again visited by AEE of RO on 11.03.2022 and effluent samples were collected from STP provided by the industry and concentration of various parameters was found beyond the prescribed limits of the Board.</p> <p style="text-align: justify;">Thereafter, the industry again applied for obtaining &lsquo;Consent to Establish&rsquo;/NOC for expansion under the Water Act, 1974 and under the Air Act, 1981 for installation of new boiler of capacity 08 TPH to manufacture Auto &amp; ADV Tubes @ 24700 Pcs/day &amp; Auto &amp; Adv Tyres @ 6000 Pcs/day.</p> <p style="text-align: justify;">The industry was given personal hearing before the Chief Environmental Engineer, Ludhiana on 19.05.2022, wherein, it was decided as under:</p> <p style="text-align: justify;"><!-- [if !supportLists]-->1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry shall maintain and operate its STP regularly and efficiently, so as to achieve the effluent standards consistently as prescribed by the Board / MoEF&amp;CC and as amended from time to time.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry shall not fire any kind of waste / bushes and make provision for vermin composting for the dried leaves.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry shall provide proper plantation area for the disposal of treated wastewater, provide flow measuring device at STP and enter into the agreement with registered recycler of the Board for disposal of HW category 5.1, within 15 days and submit the compliance in the o/o Environmental Engineer, Regional Office-3, Ludhiana, thereafter.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->Environmental Engineer, Regional Office-3, Ludhiana shall visit the site of the industry, verify the contentions made by the industry and send the report, within 15 days.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->5.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->Consent to Establish for the installation of the boiler of capacity 8 TPH be granted to the industry upto 04.04.2023 (adequacy of NOC fee).</p> <p style="text-align: justify;">&nbsp;</p> <p style="text-align: justify;">Accordingly, &lsquo;Consent to Establish&rsquo;/ NOC was granted on 27.05.2022, valid upto 04.04.2023 for expansion for installation of new boiler of capacity 08 TPH for manufacturing of tubes @ 24700 Numbers/Day and Tyers @ 6000 Numbers/Day with conditions mentioned therein.</p> <p style="text-align: justify;">Now, the industry has applied for &lsquo;Consents to Operate&rsquo; under the Water Act 1974 and under the Air Act, 1981 for&nbsp;manufacturing of tubes @ 24700 Numbers/Day and Tyers @ 6000 Numbers/Day with discharge of Domestic effluent @ 3.0 KLD onto land for plantation after treatment in STP and by operation of one boiler of capacity 8 TPH with Dust collector followed by twin cyclone as APCD and 03 no. DG sets of capacity 500 KVA (each) equipped with canopies along with stack of adequate height with conditions mentioned therein.&nbsp;The industry has submitted C.A. certificate dated 04.01.2023 and as per this C.A. certificate, gross fixed assets of the industry is Rs. 26.62 Cr.</p> <p style="text-align: justify;">The industry has deposited consent fee, which is adequate upto 30.06.2027 under both acts.</p> <p style="text-align: justify;">The industry has also submitted NOC regularization fee for increased fixed assets. The value of fixed assets of the industry has been increased from Rs. 14.58 Cr. to Rs. 26.62 Cr i.e. by Rs. 12.04 Cr. There is no increase in value of land. The value of building increased by 1.73 Cr. The increase in value of building is due to construction of sales office at BRS Nagar and due to major renovation of office building at factory. The value of plant and machinery increased by 9.48 Cr. The industry has submitted bills of items purchased after 01.04.2019 and it has observed that the value of plant and machinery increased in year 2020 by about 07.00 Cr. due to installation of tyre plant and further increased in year 2022 by due to purchase of new mould &amp; dyes, new scale, electrical fittings and motors &amp; boiler of capacity 8 TPH.</p> <p style="text-align: justify;">The industry was visited on 06.02.2023 and it was observed as under:</p> <p style="text-align: justify;"><!-- [if !supportLists]-->1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry was in operation for production of tubes and tyres.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry has installed boiler of capacity 08 TPH based on coal and rice husk. The industry has installed dust collector followed by twin cyclone as APCD with boiler along with stack of adequate height with sampling arrangements. The air emission samples were collected on 16.12.2022 and as per analysis report, the concentration of SPM is 163 mg/NM3, which is within prescribed limits of the Board. The industry was using rice husk as fuel in its boiler during visit dated 16.12.2022.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry has removed its old boiler of capacity 3.5 TPH. There is no source of process emissions.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->There is no generation of trade effluent from the process and only domestic effluent generated as industry is labour intensive unit. There are 150 no. workers in the industry. There is no labour quarters in the premises of the industry.&nbsp;&nbsp;</p> <p style="text-align: justify;"><!-- [if !supportLists]-->5.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry has installed STP&nbsp;consists of collection tank, EA Reactor, MBBR, Tube settler, Dual Stage Filters for the treatment of domestic effluent to be generated from its premises. The treated effluent is disposed off onto land for plantation after STP. The industry has provided plantation in an area of 1000 sq. yards and condition of plantation is good.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->6.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry has constructed hazardous waste room of size 8.5&rsquo; X 10&rsquo; X 8&rsquo; for storage of hazardous waste of category 5.1 to be generated from its process. The industry has stored about 300 litres of spent oil (HW Category 5.1) in the storage room. However, the industry has not made any agreement with authorized recycler for lifting of HW category 5.1. The report of the same is being sent separately.&nbsp;&nbsp;</p> <p style="text-align: justify;"><!-- [if !supportLists]-->7.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry has installed&nbsp;03 no. DG sets of capacity 500 KVA (each)&nbsp;equipped with canopies along with adequate stack height.</p> <p style="text-align: justify;">As per CA certificate, the cost of plant and machinery is Rs. 17.18 cr.&nbsp; The industry is a large scale red category unit and the competency lies with Hon'ble Chairman of the Board.</p> <p style="text-align: justify;">As earlier reported by the RO that as per drawing [drawing no. D.T.P.(L) 2/2008] of the approved Master Plan, Ludhiana (2007-31), the entire revenue area of village Gaunspur falls under the Industrial Zone. Thus, the site of the industry is suitable for such type of expansion/modernization.</p> <p style="text-align: justify;">Keeping in view of the above, it is recommended that varied &lsquo;Consent to Operate&rsquo; under the Water Act, 1974 and Air Act, 1981 may be granted to the industry upto 30.06.2026 for&nbsp;manufacturing of tubes @ 24700 Numbers/Day and Tyers @ 6000 Numbers/Day subject to suitable conditions with special condition that the industry shall get its domestic effluent samples analyzed from Board&rsquo;s lab within 01 month.</p> <p style="text-align: justify;">&nbsp;Competency : Hon'ble Chairman of the Board</p> <p style="text-align: justify;">&nbsp;</p>
