It is submitted that the industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/FZR/2019/9683401 dated 05/09/2019 and under the Air Act, 1981 vide no. CTOA/Renewal/FZR/2019/9683080 dated 05/09/2019, both valid upto 30/09/2023, for manufacturing of raw rice with dryer @ 3 TPH along with sorted rice @ 4 TPH, under orange category, subject to certain conditions mentioned therein.                      Thereafter, the industry has obtained consent to establish (NOC) for expansion of rice sheller unit to manufacture raw rice with dryer @ 5 TPH along with sorted rice @ 4 TPH, under orange category, vide no. CTE/Exp/FZR/2020/13315092 dated 02/09/2020, valid upto 01/09/2021, subject to certain conditions mentioned therein alongwith special condition that the industry will not process paddy at paddy cleaner of dryer section beyond existing capacity of 4.5 TPH for which it has installed cyclone / air pollution control device to contain the process emissions.                      Now, the industry has applied for renewal of consents to operate under the Water Act, 1974 & the Air Act, 1981, for production raw rice with dryer @ 3 TPH along with sorted rice @ 4 TPH, under orange category with requisite documents and adequate consent fees. Details of the case are as under: 1.            Earlier, the industry has obtained certificate for expansion of rice sheller i.e. Raw Rice with Dryer @ 5 TPH in the year 2020. But now, it has applied for obtaining certificate for earlier consent granted to it in the year 2019 i.e. Raw Rice with Dryer @ 3 TPH. Accordingly, a clarification has been raised to the industry to submit whether it has made expansion or not. In reply, the industry has submitted that they have not made any expansion in our unit. 2.            The industry has submitted CA certificate regarding its gross fixed assets of Rs. 145.17lacs as on 31.01.2023.Accordingly, the industry has deposited consent fee of Rs. 42000/- vide R. NO. N032232311571999 dated 01.02.2023 under the Water Act, 1974 & Rs. 42000/- vide R. NO. N032232311558144 dated 01.02.2023under the Air Act, 1981, which are adequate upto 30.09.2028under both Acts. 3.            The industry has submitted compliance report of conditions imposed in previous consents under the Water Act, 1974 & the Air Act, 1981.                      Punjab Pollution Control Board in order to facilitate the industries vide office order no. 59 dt. 02.02.2016 has decided that renewal of consents to operate under the Water Act, 1974 and Air Act, 1981 will be granted to the industries (Orange/Green Category- Small Scale) without visiting the unit within 7 days.                      Further, it is intimated that the industry will be visited during tour to that area within two months to check the compliance under the provisions of the Water Act, 1974 and the Air Act, 1981 and report will be submitted accordingly.  There is no change in production capacity as per the last CTO granted to it as well as no modernization/ expansion of the unit. No complaint is pending against the industry.                      Keeping above in view, it is recommended that consent to operate granted under the Water Act, 1974 & under the Air Act, 1981 may be renewed up to 30/09/2028 for operation of the industry for manufacturing of raw rice with dryer @ 3 TPH along with sorted rice @ 4 TPH, subject to the suitable conditions and following specific conditions: 1.            The industry shall ensure to comply with the provisions of the Water Act, 1974 and the Air Act, 1981 as well as with code of practice prescribed for rice sheller units by the State Govt. vide order dated 15.10.2013 and if found not complying during visit, the consents to operate under Water Act, 1974 and the Air Act, 1981 will be revoked without any further intimation. 2.            The industry will always comply with the guidelines issued by Deptt. of Science Technology & Environment Govt. of Punjab vide Order No. 10/48/2004-STE (4)/932 dated 15.10.2013. 3.            The industry shall submit analysis report of emission sample analyzed from the Board’s lab to this office within one month. 4.            The industry is bound to upgrade / replace its existing APCD as and when asked by the Board. 5.            In case the industry plans to install any DG set within its premises, it shall install acoustic enclosure on the same as per the guidelines prescribed by the Board.
