It is intimated that the establishment is an Authorized Retail Centre of Tata Motors, for selling and servicing of light motor vehicles without washing process and accordingly, has applied for obtaining fresh 'consent to operate' (CTO) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981, for selling and servicing of light motor vehicles @ 5 nos. per day.                     The fees deposited on account of consent fee under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 is adequate upto 28/02/2026 as mentioned at sr. no. VII.                   The establishment has taken the land & building on lease dated 01.03.2021, which is valid upto 28.02.2026.                                                    Further, the industry has obtained 'Land Use Classification' certificate from the District Town Planner (P&R), Sangrur vide memo no. 1960- DTP (S)/SS- 110 dated 16.12.2022, in which it is stated that the site of the industry is falls in residential zone as per notified Master Plan of Sangrur. According to Unified Zoning Regulations, 2018, LMV Automobile Showroom and Workshop is allowable as per condition no. 17 (Showrooms with workshop including painting and washing for light motor vehicles (LMV) shall have approach from 80 feet wide ROW or as per provision of master plan whichever is higher provided that existing road should not be less than 60 feet. Applicant shall produce a certificate/NOC from Pollution Control Board that unit is not creating any such pollution which is harmful to nearby residents). In this case, the Showroom is situated on NH- 52 having width more than 60 ft. Hence, the site is suitable. To check the contents of application submitted by the establishment, the industry was visited on 17.02.2023 and it was observed as under: <span lang="X-NONE" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-ansi-language: X-NONE; mso-fareast-language: X-NONE;">1.          The establishment is authorized retail centre of Tata Motors for selling and repair of light motor four wheeler vehicles. <span lang="X-NONE" style="font-size: 12.0pt; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-ansi-language: X-NONE; mso-fareast-language: X-NONE;">2.          The establishment is not engaged in denting, painting and washing of vehicles. However, minimal servicing of vehicles is proposed to start in few days. 3.          There is no generation of trade effluent and only domestic effluent is being generated from its premises, which is discharged into MC sewer. 4.          The establishment has not installed any DG set in its premises. Hence, there is no source of air pollution. 5.          The representative of the establishment was advised to obtain authorization HOWM rules, 2016 before start of servicing of vehicles. 6.          The establishment has submitted that they are already in process of entering into an agreement with re-cyclers of hazardous waste pertaining to category 5.1 & 5.2 and will start servicing only after obtaining authorization HOWM rules, 2016 from the Board.                        Further, as per the guidelines issued by Central Ground Water Authority (CGWA), the site of the unit falls under Sangrur block which has already been declared as notified area by Central Ground Water Authority (CGWA). Furthermore, to regulate the extraction of ground water, Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:            “The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA)”           Keeping in view, may, if approved the application of establishment for obtaining fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 under Orange Category may be sent SEE, ZO-II, Patiala with recommendations for grant of consent upto 30/9/2025 for functioning of Showroom for selling and servicing of light motor four wheeler vehicles @ 5 nos. per day, only with suitable conditions and special condition as under: - 1.    The establishment shall apply for obtaining authorization under HWM Rules, 2016, immediately. 2.    The establishment shall intimate to this office, whenever, the establishment want to start the process of repair of auto vehicles and shall apply for obtaining revised consent to operate (CTO) under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. 3.    The establishment will not provide facility for denting, painting and washing of vehicles, without prior permission of the Board and other various concerned Govt. Departments.
