ASR/RO/WPC/2013/F-49 dated 30/08/2013 and under Air (Prevention & Control of Pollution) Act, 1981 vide no. ASR/RO/WPC/2013/F-51 dated 30/08/2013, which were valid up to 31/12/2022.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: .5in; line-height: normal;"><span lang="EN-US" style="font-family: 'Arial','sans-serif'; background: white;">Now, the industry has applied for obtaining renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981, under Green Category through OCMMS along with required documents for manufacturing of Ayurvedic Capsules @ 11196000 Kg/Year. </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: .5in;"><span lang="EN-US" style="font-family: 'Arial','sans-serif'; background: white;">The industry has deposited Rs. 42000/- online vide UTR/Ref.No.</span> <span lang="EN-US" style="font-family: 'Arial','sans-serif'; background: white;">AXIC223356198466 dated 01/12/2022 under Water (Prevention & Control of Pollution) Act, 1974. Rs. 2900/- vide UTR No. AXIC223356200237 dated 01.12.2022 as NOC regularization fee, Rs. Rs. 42000/- online vide UTR/Ref.No.</span> <span lang="EN-US" style="font-family: 'Arial','sans-serif'; background: white;">AXIC223356199478 dated 01/12/2022 under Air (Prevention & Control of Pollution) Act, 1981 and Rs. 500/- vide UTR No. AXIC223356200513 dated 01.12.2022 as application form fee. </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: .5in;"><span lang="EN-US" style="font-family: 'Arial','sans-serif'; background: white;">Further it was observed that the earlier CA certificate submitted by the industry dated 17.11.2012 was valued to Rs. 14.24 Lac ( cost of plant and machinery as 10.51 Lac). Now the industry has submitted year wise CA certificate, wherein the cost of gross fixed assets in the year 2018 to 2020 was between 25 to 50 Lacs and from 2020 to 2023 was between slab 50 to 75 Lac. Considering balance consent to operate fee from 2012 to 2020 for jump in slab from under 25 lac to 25 to 50 lac and from 2020 to 2023 from 25 to 50 lac to 50 to 75 lac, it will be Rs. 15000/- under each Act. The remaining consent fee will be valid for a period upto 31.12.3031.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: .5in;"><span lang="EN-US" style="font-family: 'Arial','sans-serif'; background: white;"><span style="mso-spacerun: yes;"> </span>The industry has already submitted reply mentioning that the increase in gross fixed assets is due to repair and maintenance/replacement of the machinery carried out.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: .5in; line-height: normal;"><span lang="EN-US" style="font-family: 'Arial','sans-serif'; background: white;">The industry has submitted rent agreement and compliance of the previous grated consents etc.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span lang="EN-US" style="font-family: 'Arial','sans-serif'; color: red; background: white;"><span style="mso-tab-count: 1;"> </span></span><span lang="EN-US" style="font-family: 'Arial','sans-serif'; background: white;">It is pertinent to mention here that Board has issued order vide no. CEE(HQ)F.No. 957/2016/59 dated 2/2/2016 regarding to grant of auto renewal of consent to establish/consent to operate to the Orange & Green category industries.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span lang="EN-US" style="font-family: 'Arial','sans-serif'; color: red; background: white;"><span style="mso-tab-count: 1;"> </span></span><span lang="EN-US" style="font-family: 'Arial','sans-serif'; background: white;">It is further intimated that the project is complying with the conditions of consents granted earlier under Water Act, 1974 and Air Act, 1981. The industry falls in Green category in Small Scale sector and competency to decide the case lies with Environmental Engineer of the Board.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; line-height: normal;"><span lang="EN-US" style="font-family: 'Arial','sans-serif'; background: white;"><span style="mso-tab-count: 1;"> </span>In view of the above, may if approved, the renewal of consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 and the Water (Prevention & Control of Pollution) Act, 1974 be granted to the industry under Green Category up to 31/12/2031 with usual terms and conditions along with following special conditions:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-bottom: 6.0pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: normal; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Arial','sans-serif'; mso-fareast-font-family: Arial;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Arial','sans-serif'; background: white;">The industry shall not install any polluting machinery in its premises that will generate any emission and trade effluent from its industrial premises.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 6.0pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: normal; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Arial','sans-serif'; mso-fareast-font-family: Arial;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Arial','sans-serif'; background: white;">The present consent granted to the industry is for the same production capacity as earlier and industry shall not increase its production capacity without revised consents of the Board.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 6.0pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: normal; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Arial','sans-serif'; mso-fareast-font-family: Arial;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Arial','sans-serif'; background: white;">The industry will be visited due course of time and if found violating the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, consents to operate under the said acts will be revoked/cancelled without any prior intimation.</span></p>
