<p class="MsoBodyText" style="text-align: justify; line-height: 150%; margin: .1pt 6.7pt .0001pt 46.0pt;"><span style="mso-tab-count: 1;"> </span>Earlier the industry is in operation in the name and style of M/s Sh. Nirmal Singh S/o Sh. Surain Singh, Hargobing Nagar, B/s Sant Brass, Jalandhar. The industry was visited by officer of this office on 05.08.2021 and violations were observed. Accordingly, the industry was given personal hearing before the Chief Environmental Engineer, Jalandhar on 06.10.2022 and during hearing it was decided as under:-</p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-list: l0 level1 lfo1; margin: .1pt 6.7pt .0001pt 82.0pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span><!--[endif]-->Directions u/s 31-A of the Air Act, 1981 be issued against the industry for closure of unit and PSPCL Authorities be directed to disconnect the electric connection of the industry.</p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-list: l0 level1 lfo1; margin: .1pt 6.7pt .0001pt 82.0pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span><!--[endif]-->Environmental Engineer, Regional Office-1, Jalandhar shall visit the industry to seal the machinery of the industry and submit the compliance of the directions issued against the industry within 10-days.</p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-list: l0 level1 lfo1; margin: .1pt 6.7pt .0001pt 82.0pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span><!--[endif]-->Case be forwarded to Hon’ble Chairman of the Board for getting orders for imposition of Environmental Compensation, being a fit case as per record and the Committee constituted by the Board vide office order no. 260 dated 10.08.2022 shall calculate/ evaluate the Environmental Compensation to be imposed on the industry.<span style="mso-spacerun: yes;"> </span></p>
<p class="MsoBodyText" style="text-align: justify; line-height: 150%; margin: .1pt 6.7pt .0001pt 46.0pt;"><span style="mso-tab-count: 1;"> </span>Thereafter, the industry was visited by officer of this office on 06.12.2022 and during visit, the ball mill and both the lead melting furnaces and D.G set without canopy were sealed in compliance to directions issued vide ZO endst no. 3494 dated 09.11.2022 and also directions were also issued to PSPCL authorities for disconnection of electricity available in the premises vide Board’s letter no. 3490-91 dated 09.11.2022. Thereafter, the letters were written to PSPCL authorities vide no. 2392-93 dated 09.12.2022, vide no. 24-25 dated 09.01.2023 and vide no. 129-130 dated 19.01.2023 to submit the compliance of the directions issued by the Board. In compliance to direction issued, the electric connection of the industry was disconnected by PSPCL Authorities vide no. 018/94 dated 22.02.2023. The compliance of point no. 3 was sent through E-noting no. 21234443.</p>
<p class="MsoBodyText" style="text-align: justify; line-height: 150%; margin: .1pt 6.7pt .0001pt 46.0pt;"><span style="mso-tab-count: 1;"> </span>Now, the industry has applied for fresh consent to operate under Water (Prevention &<span style="letter-spacing: .05pt;"> </span>Control of Pollution) Act 1974 and Air (Prevention and Control of Pollution) Act, 1981 through OCMMS of the Board for manufacturing of lead oxide @ 20 MTD by using<span style="mso-spacerun: yes;"> </span>Lead ingots @ 20 MTD by installing two lead melting furnaces and one ball mill. The industry has deposited Rs. 9800/- Vide UTR/No. BARBU23003792068 dated 03.01.2023 under Water Act 1974 and Rs. 12200/- (Including Rs. 2800/- as balance fee, Rs. 1400/- as NOC fee and Rs. 500/- as application form fee) Vide UTR/No. BARBT23002508186 dated 02.01.2023 under Air Act, 1981 which is adequate upto 30.06.2027.</p>
<p class="MsoBodyText" style="text-align: justify; line-height: 150%; margin: .1pt 6.7pt .0001pt 46.0pt;"><span style="mso-tab-count: 1;"> </span>The industry has submitted electricity bill as proof of date of commissioning i.e 19.11.1995. Moreover, the industry has also submitted in writing that the electricity connection was running since 1995 in the name of land but they have established their unit in 2022. The representative of the industry has also submitted license deed made on 06.10.2022 between Sh. Nirmal Singh S/o Sh. Surain Singh, Sh. Amit Malhotra S/o J.J Malhotra C/o M/s Bhagwati Oxides and Chemical and Sh. Harminder Singh Grewal S/o Gurbachan Singh Grewal.</p>
<p class="MsoBodyText" style="text-align: justify; line-height: 150%; margin: .1pt 6.7pt .0001pt 46.0pt;"><span style="mso-tab-count: 1;"> </span>The<span style="letter-spacing: .05pt;"> </span>industry was visited by officer of this office on 23.02.2023 and it was observed that the industry was not in<span style="letter-spacing: .05pt;"> </span>operation. The industry has installed 02 nos. lead melting furnaces alongwith ball mill for manufacturing lead oxide with Cyclone followed by bag filter followed by water sprinkling system as APCD and the same were lying sealed during the visit. The industry has not submitted feasibility report w.r.t APCD installed alongwith melting furnace and ball mill. The APCD installed with machinery seems principally adequate, however, the actual adequacy can only be adjudged after monitoring the stack emission. The industry was guided to provide proper platform for sampling purpose. One D.G set was also lying sealed in the premises. There is no source of generation of trade effluent. Domestic effluent is being discharged into sewer. The industry has submitted building plan approved from Director of Factories, Punjab. The industry has not submitted area classification certificate from competent authority.</p>
<p class="MsoBodyText" style="margin-right: 7.1pt; text-align: justify; line-height: 150%;"><strong style="mso-bidi-font-weight: normal;"><span style="font-size: 12.0pt; mso-bidi-font-size: 10.0pt; line-height: 150%; font-family: 'Times New Roman','serif'; mso-hansi-font-family: Tahoma; mso-bidi-font-family: Tahoma;"><span style="mso-tab-count: 1;"> </span></span></strong>Keeping in view of above, it is recommended that case may be considered for grant of consents for a period of six months after imposition of Environmental Compensation as already decided during personal hearing alongwith following conditions:-</p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-list: l1 level1 lfo2; margin: 0cm 7.1pt .0001pt 64.0pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span><!--[endif]-->The Punjab State Power Corporation Ltd be directed to restore the supply of electricity to the industry temporarily for six months.</p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-list: l1 level1 lfo2; margin: 0cm 7.1pt .0001pt 64.0pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span><!--[endif]-->The industry shall submit certificate regarding classification of area within 01 month</p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-list: l1 level1 lfo2; margin: 0cm 7.1pt .0001pt 64.0pt;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span><!--[endif]-->The industry will also get its stack emission sample analyzed from Board’s Lab within 01 month.</p> |
