CTOW/Varied/RPN/2020/12108224 dated 26/04/2020 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/RPN/2020/12108108 dated 26/04/2020, both were valid upto 30/09/2024 for operation of Crushing & Screening, Washing of River Bed Material @ 5000 CFT/Day subject to the suitable conditions mentioned therein. </span></p>
<p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; text-indent: 72pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Thereafter, the Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act 1981 was revoked/cancelled vide no. 938 dated 26.04.2022 due to the non-submission of the mining certificate as per the decision no. 02 of the personal hearing held on 31.08.2021 in light of the instructions issued by the Board vide letter no. 16536 dated 23.07.2021 for processing the CTE/CTO applications for stone crushers/screening/washing plants.</span></p>
<p class="MsoNormal" style="margin-bottom: 6pt; text-align: justify; text-indent: 72pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Now, the unit has applied for obtaining fresh 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 alongwith compliance of previous consent, undertaking regarding code of practice and consent fee.</span></p>
<p class="MsoNormal" style="margin-bottom: 12pt; text-align: justify; text-indent: 76.5pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Further, the unit has submitted the slips of obtaining raw material from HP, verified by O/o Executive Engineer-cum-District Mining, Drainage cum Mining Division, Sri Anandpur Sahib dated 11.01.2023 regarding obtaining raw material from Himachal Pradesh through inter-state mobile check post.</span></p>
<p class="MsoNormal" style="margin-bottom: 12pt; text-align: justify; text-indent: 76.5pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry has submitted CA certificate dated 18.01.2023, wherein, the value of fixed assets of the industry as on 31.03.2022 is of Rs. 34.75 lakhs with value of plant & machinery is Rs. 27.50 lakhs. As per the record file earlier, the fee deposited by the unit was adequate upto 30.09.2024 under the both Acts. Now, the unit has deposited additional fee amounting to Rs. 9,000/- vide UTR. No. PUNBC22364002540 dated 30.12.2022 under the Water Act, 1974 and Rs. 9,000/- vide UTR. No. PUNBC22364002532 dated 30.12.2022 under the Air Act, 1981. As such, the fee deposited by the unit is adequate upto 31.03.2027 under the both Acts after adjusting penalty @ 50% as per circular dated 29.10.2018.</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin: 0cm 0cm 0.0001pt; text-align: justify; text-indent: 72pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Further, the unit was visited surprisingly by the AEE of this office on 30.01.2023 and Sh. Baljinder Singh, Partner was contacted. <p class="MsoNormal" style="text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">As such, it is clear that the unit is not complying with the code of practice stipulated for such units and is violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Thereafter, the unit was issued show cause notice for violations of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 alongwith an opportunity of personal hearing on 14.02.2023 at 11:00 am to show cause as to why the proposed action may not be taken.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The representative of the industry attended the hearing and informed that it has removed all the observations observed during the visit.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">After hearing the representative of the unit and considering background of the case, the Environmental Engineer decided that the AEE will visit the unit within 07 days to verify the contention of the unit and process the application of the unit on merit as per visit.</span></p>

<p class="MsoNormal" style="margin-bottom: 12pt; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">In view of the above facts and letter issued by the Executive Engineer, Deptt. of Irrigation-cum-Mining, Sri Anandpur Sahib and raw material mining slips, verified by their office, if approved, it is recommended that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be renewed for a short period upto 31.12.2023 due to non-availability of carrying capacity issued by the Mining Department, subject to the suitable conditions and additional conditions as under</span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">:</span></p>

<p class="MsoListParagraph" style="margin: 0cm 0cm 0.0001pt 42.55pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The unit shall obtain raw material from the Govt. approved mining sites only and shall not indulge itself into any kind of illegal mining. If at any stage the unit engaged itself in illegal mining, the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 shall be revoked/cancelled without any opportunity of hearing.</span></p>

<p class="MsoNormal" style="margin: 0cm 0cm 0.0001pt 42.55pt; text-align: justify; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">ii) The industry shall comply with the noise limits prescribed by the Ministry of Environment & Forests (MoEF), New Delhi vide notification No.GSR-371(E) dated 17.5.2002 as amended from time to time.</span></p>
<p class="MsoNormal" style="margin-left: 42.55pt; text-align: justify; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">iii) The industry shall comply with the stack emission standards prescribed by the MoEF vide notification No.GSR-520 (E) dated 1.7.2003 as amended from time to time or GSR-489(E) dated 7.9.2002 as amended from time to time, whichever is applicable to the applicant.</span></p>
<p class="MsoListParagraph" style="margin: 0cm 0cm 0.0001pt 54pt; text-align: justify; text-indent: -11.45pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">iv)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The height of the stack with the D.G. set shall be in accordance with the norms prescribed by the Board vide notification No.Admn/A-4/F.No.160/87/14744 dated 14.9.1987.</span></p>
<p class="MsoListParagraph" style="margin: 0cm 0cm 0.0001pt 42.55pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">11.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry shall make necessary arrangements for the monitoring of ambient air emissions from Board’s Lab/NABL approved lab twice in a year and shall submit the analysis report to the Board.</span></p>

<p class="MsoListParagraph" style="margin: 0cm 0cm 5pt 42.55pt; text-align: justify; text-indent: -18pt; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">17.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry shall ensure that no air pollution problem or public nuisance is created in the area due to discharge of emissions from the industry.</span></p>
