File Note: <p style="text-align: justify;">The agenda note and report / recommendations of AEE/EE, RO, may kindly be perused.</p> <p style="text-align: justify;">Earlier the industry was running with the name &amp; style of M/s Master Art Processors at Rasna Dyeing Compound, Mata Karam Kaur Colony, Near Lovely Dyeing Tajpur Road, Ludhiana. The old unit operating at Mata Karam Kaur Colony was granted consent to operate under the Water Act, 1974, valid upto 15/10/2021 &amp; Air Act, 1981 valid upto 30/06/2024 for production of washed garments @ 300 Kgs/day and discharge of trade effluent @ 10 KLD into sewer after treatment through ETP and domestic effluent @ 01 KLD into sewer. Thereafter, the industry had planned to shift this unit at present location and had applied for NOC to establish at present location.</p> <p style="text-align: justify;">The industry was granted &lsquo;Consent to Establish&rsquo; / NOC under the provisions of the Water Act, 1974 and Air Act, 1981, valid upto 17.10.2022 for Dyed Cloth @ 1500 Kg/day with discharge of 150 KLD &amp; domestic effluent @ 0.45 KLD into conveyance system of CETP 50 MLD. The NOC was granted to the industry for the installation of 03 soft flow machines, 01 hydro extractor and 1 pole dryer.</p> <p style="text-align: justify;">Now, the industry has applied for fresh &lsquo;Consents to Operate&rsquo; under the Water Act 1974 and the Air Act, 1981 for dyed cloth @ 1000 Kgs/day with discharge of trade effluent @ 100 KLD &amp; domestic effluent @ 0.5 KLD into conveyance system of CETP 50 MLD. The industry has deposited consent fee, which is adequate upto 30.11.2027 under both acts.&nbsp;The industry was earlier proprietorship firm and now it is partnership firm and has submitted partnership deed.</p> <p style="text-align: justify;">There was dispute of ownership as a written complaint has been received in this office by the proprietor Sh. T.R. Mishra, stating that someone else has applied for consents to operate in the name of their firm and they are not concerned with their firm. The matter was considered by the Competent Authority of the Board and it was decided that the technical aspect of application will be considered, later on. First the legitimacy of applicant is to be decided.</p> <p style="text-align: justify;">Thereafter, the industry was given personal hearing before SEE, ZO on 07.02.2023.&nbsp; During hearing, Sh. Subash Yadav, Applicant attended the hearing and submitted that they have purchased M/s Master Arts from the Proprietor Sh. T.R. Mishra and also submitted agreement from Sh. T.R. Mishra dated 07.02.2023. They have also submitted the sale deed of land, buiding and plant &amp; machinery and requested to grant the consent to operate. Accordingly, it was decided that:- (copy attached)</p> <p style="text-align: justify;"><!-- [if !supportLists]-->1.&nbsp;&nbsp;&nbsp; <!--[endif]-->The consent application be processed with the partnership deed submitted by the new applicant.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->2.&nbsp;&nbsp;&nbsp; <!--[endif]-->The consent application of the industry be processed on merit.</p> <p style="text-align: justify;">The matter regarding the proprietor has been solved. The industry was visited by AEE of RO on 20.12.2022 and it was observed that:-</p> <p style="text-align: justify;"><!-- [if !supportLists]-->1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry was not in operation, during visit and no raw material was lying at site.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry has installed 03 soft flow dyeing machines (2 X 300 Kg and 1 X 450 Kg) having total 07 chambers/mouths in its premises.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The study on effluent generation from the industry was not carried out in GNE 2022 report as this unit was not commissioned. However, as per the calculation done by the GNE in other units, the total effluent generation from the 07 chambers of soft flow will be 140 KLD. However the industry has been granted shares of CETP 50 MLD @ 100 KLD as per PDA letter dated 22.07.2022. Hence, the proposed effluent generation of the industry will be 40 KLD more than the share allotted to it. Hence, atleast its 02 chambers of soft flow is required to be sealed.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry is connected with the conveyance system of CETP 50 MLD, Tajpur Road, Ludhiana for discharge its trade and domestic effluent. The industry has provided the flow meter at its final outlet leading to CETP.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->5.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry has installed one boiler of capacity @ 2.0 TPH and mechanized fuel feeding system with wood /agro waste fuel. The industry has provided cyclone separator as APCD with rotary valve and adequate stack height.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->6.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry has also installed one pole dryer.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->7.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry is providing the arrangements for re-use its cooling water &amp; boiler condensate.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->8.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry has installed&nbsp;one&nbsp;DG set of capacity of 125 KVA equipped with canopy.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->9.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The old unit earlier located at Mata Karam Kaur Colony was also checked and found that this unit has been permanently closed.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->10.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry has submitted DTP certificate vide no. 2744 dated 05.09.2021 is stating that the site of the industry falls in industrial zone.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->11.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->This is a shifting case, the industry has shifted to new location and NOC has been already granted by the Board. Earlier, the industry was doing washing and now it has installed soft flow machines for dyeing. As, this is new unit application for consent to operate under Water (Prevention &amp; Control of Pollution) Act, 1974 &amp; the Air (Prevention &amp; Control of Pollution) Act, 1981. The Competency lies with the Head Office as approved in e-noting 19582356.</p> <p style="text-align: justify;">Keeping in view of above, it is recommended that :-</p> <p style="text-align: justify;"><!-- [if !supportLists]-->A)&nbsp;&nbsp; <!--[endif]-->Directions u/s 33-A of the Water (Prevention &amp; Control of Pollution) Act, 1974 for sealing of 02 chambers of soft flow machine of the industry be issued.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->B)&nbsp;&nbsp; <!--[endif]-->Consent to operate under Air (Prevention &amp; Control of Pollution) Act, 1981 may be granted for one year with suitable conditions &amp; special condition that it will got analysis its Air emission sample from Board/ approved lab within 01 month.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->C)&nbsp;&nbsp; <!--[endif]-->Consent to operate under the Water Act, 1974 may be granted to the industry temporarily for one year for discharge of trade effluent @ 99.5 KLD &amp; domestic effluent @ 0.5 KLD into CETP 50 MLD as an interim arrangements so as to check the discharges from Members industries and the efficiency of the CETP subject to suitable conditions and with special conditions that:-</p> <p style="text-align: justify;"><!-- [if !supportLists]-->1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The consent is an interim arrangements so as to check the discharges from Members industry and the efficiency of the CETP.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The consent is based on tentative intimidation of the shares by PDA dated 22.7.2022 and GNE report of 2022, as such, it is a temporary arrangement, it will not convey any right to the industry to tentative shares intimated by SPV vide letter dated 22.7.2022.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The member industry shall install effluent measuring devices at the outlet of the industry leading to conveyance system of CETP within the validity of consent for verification of the discharges.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry shall ensure that no new machinery is installed without prior permission of the Board.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->5.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The consent is an interim measure in-accordance to tentative shares intimated by PDA to the Board vide its letter dated 22.07.2022. These shares are temporarily considered and their finalization is under the consideration of the Board.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->6.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The member units and PDA shall ensure that total effluent intake into the CETP, Tajpur Road, Ludhiana from the existing units will never be exceed 40 MLD.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->7.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The industry as well as M/s Punjab Dyer Association (SPV), Tajpur Road Module, Ludhiana will comply with the&nbsp;undertaking submitted by SPV dated 22.09.2022.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->8.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The PDA shall ensure the working of Inlet and outlet online flow-meters at CETP and shall also provide standby flow meters for the same to ensure their regular working at CETP site.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->9.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The online flow meters at the inlet water source of all member units shall be installed within 4 months. The online connectivity of these flow meters of all units shall be ensured so as to check the discharge allowed by the Board.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->10.&nbsp;&nbsp;&nbsp; <!--[endif]-->The member industry and M/s Punjab Dyer Association (SPV),Tajpur Road Module, Ludhiana shall provide online meters at the outlet of all the dyeing units and to check, update / calibrate this online system so as to provide the regular and exact data of effluent discharge by individual units and in consonance to the effluent received at CETP within 1 week.&nbsp;</p> <p style="text-align: justify;"><!-- [if !supportLists]-->11.&nbsp;&nbsp;&nbsp; <!--[endif]-->The PDA, Tajpur Road, Ludhiana shall ensure that no overflow of effluent will takes place from the conveyance system at any time and if such things happen, immediately the concerned industries discharging effluent in that line will be closed.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->12.&nbsp;&nbsp;&nbsp; <!--[endif]-->All member units shall have only one outlet jointly for domestic and trade effluent for discharge into the conveyance system of CETP, 50 MLD Tajpur Road, Ludhiana. There shall be no bypass from any dyeing unit.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->13.&nbsp;&nbsp;&nbsp; <!--[endif]-->M/s Punjab Dyer Association (SPV),Tajpur Road Module, Ludhiana or individual industry shall not to execute any trading/ transfer of CETP's shares without prior permission of the Competent Authority of the Board. The PDA or the individual industry will be responsible for any loss due to trading of shares.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->14.&nbsp;&nbsp;&nbsp; <!--[endif]-->The PDA, Tajpur Road, Ludhiana and individual member unit shall be liable to pay Environmental Compensation for any lapse in undertaking submitted by SPV dated 22.09.2022.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->15.&nbsp;&nbsp;&nbsp; <!--[endif]-->It is made clear that in case of failure of commitment made by PDA vide its undertaking dated 22.09.2022, the Board shall be constraint to take strict action in accordance to law, on SPV as well as individual members without any further notice.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->16.&nbsp;&nbsp;&nbsp; <!--[endif]-->The PDA is again directed to ensure that it achieves the prescribed standards at the outlet of CETP within one month, failing which the Board shall be constrained to order the closure of all the member industries attached with the CETP.</p> <p style="text-align: justify;">&nbsp;</p> <p style="text-align: justify;">Competency : Hon'ble Chairman of the Board</p>
