It is submitted that earlier the industry was granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 vide no. MOH/WPC/07-12/343 dated 28.03.2007 valid upto 27.03.2012 which was further extended upto 27.09.2016 and Air (Prevention & Control of Pollution) Act, 1981 vide no. MOH/WPC/07-12/F-882 dated 28.03.2007 valid upto 27.03.2012 which was further extended upto 27.09.2016 for production of eggs @ 18,000 nos/day subject to certain terms and conditions mentioned therein. The poultry farm was issued show cause notice for violation under the provisions of the Air (Prevention & Control of Pollution) Act, 1981 and Air (Prevention & Control of Pollution) Act, 1981 vide this office letter no. 5696 dated 23.07.2020 with an opportunity of show cause in writing within 15 days as to why the proposed action may not be taken, failing which it will be presumed that industry has nothing to say and the Board shall go ahead to take the proposed action without giving any further notice / opportunity. The poultry farm was issued notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 vide Board’s letter no. 5516-5517 dated 27.11.2020 alongwith opportunity of personal hearing before the Chief Environmental Engineer (P) of the Board on 15.12.2020. The representative of the poultry farm failed to attend the hearing and no reply in response to the notice served was received from the poultry farm. Thereafter, the poultry farm was issued another opportunity of personal hearing before the Chief Environmental Engineer (P) of the Board on 28.01.2021 vide Board’s letter no. 220-221 dated 14.01.2021. The above hearing as postponed due to administrative reasons vide Board’s letter no. 452-453 dated 21.07.2021. The poultry farm was given personal hearing before the Chief Environmental Engineer (P) of the Board on 16.02.2021, wherein, it was decided as under: 1.    The poultry farm shall comply with the Environmental Guidelines prescribed by the Board vide office order noo. SEE(HQ-II)/2017/1034 dated 2.11.2017, within one month. Till such time, the poultry farm shall ensure that no odour & flies problem exist in its  vicinity. 2.    The poultry farm shall apply for obtaining ‘consent to operate’ under the Water Act, 1974 & the Air Act, 1981, within 15 days, alongwith requisite documents and consent fee. 3.    Environmental Engineer, Regional Office, SAS shall visit the poultry farm to verify compliances, keeping in view the policy / guidelines of the Board for such type of units and shall forwarded the applications on merits, within 7 days, thereafter. The poultry farm was issued notice regarding non-compliance of hearing decisions given on 16.02.2021 by the Chief Environmental Engineer (P) of the Board u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 vide Board’s letter no. 2436-2437 dated 20.04.2022. The poultry farm was given personal hearing before the Chief Environmental Engineer (P) of the Board on 19.07.2022, wherein, it was decided as under: 1.    The industry shall comply with the Environmental Guidelines for Poultry Farm issued vide Board’s letter no. 3466-79 dated 24.02.2022, within 20-days. 2.    The industry shall apply consent to operate as required under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 alongwith requisite documents within 20 days through OCMMS. 3.    The Environmental Engineer, Regional Office, SAS Nagar shall visit the site of the industry after 20 days to check the progress made by the industry, to verify the compliances, verify the mode of disposal and to give comments / recommendations with respect to the industry statement / claim. Now, the poultry farm has applied for obtaining renewal of consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for production of eggs @ 18,000 nos/day alongwith requisite documents. The poultry farm was earlier deposited Rs. 45100 vide common R. No. 67/4428 dated 20.02.2017 (Rs. 19800/- under Water (Prevention & Control of Pollution) Act, 1974, Rs. 19800/- under Air (Prevention & Control of Pollution) Act, 1981, Rs. 5000/- as NOC regularization fee and 500/- as form downloading fees). The industry has now deposited Rs. 74200/- vide UTR No. BARBW23012243386 dated 12.01.2023 under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 73600/- vide UTR No. BARBW23012247488 dated 12.01.2023 under Air (Prevention & Control of Pollution) Act, 1981. The total fee deposited by the poultry farm is adequate upto 30.09.2033 after adjusting late fee / penalty against the total cost of the industry Rs. 81.88 lacs. The poultry farm has submitted compliance report of the previous granted consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The industry has submitted a letter issued by Director of Factories, Punjab vide no. ਡਅਫ/ਮੁਹਾਲੀ/ਡੀ-69/857 dated 18.01.2017 regarding acceptance of site plan / layout plan under Factories Act, 1948. The site of the poultry farm was visited by undersigned on 15.02.2023. During the visit, it was observed as under: 1.    The poultry farm was in operation and the representative informed there is about 18000 birds. 2.    The poultry farm has provided a feed mill alongwith cyclone separator as APCD with adequate stack height. 3.    The poultry farm has provided DG set of capacity 10 KVA with canopy and stack of adequate height. 4.    The poultry farm has constructed 02 no. burial pits for disposal of dead birds. 5.    The poultry farm has provided water meter on Borewell and was advised to keep the daily record of the same. 6.    The poultry farm has provided septic tank for the treatment of domestic effluent after treatment same is being discharged onto land for plantation alongwith boundary of the poultry farm. 7.    The poultry farm is complying with the decisions of the personal hearing given before the Competent Authority of the Board. In view of the above, it is recommended that consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31.12.2032 subject to suitable terms and following additional conditions that: 1.    This consent is only valid for production of eggs @ 18000 nos/day. The poultry farm shall not increase its production capacity without the prior permission of the Board. 2.    The industry shall not start any other new process within its unit which may change its category from Green to Orange/ Red, without the prior written permission of the Board. 3.    The industry shall discharge only domestic effluent onto land for plantation after passing through septic tank. 4.    The industry shall not generate any trade effluent. 5.    The industry shall obtain permission from other concern departments, if need be.     Competency: Environmental Engineer, (RO) as per policy of the Board dated 30.04.2013.
