It is submitted that the BKO was granted Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/PTA/2017/6251623 dated 09/10/2017 & under the Air (Prevention and Control of Pollution) Act, 1981 vide no. CTOA/Renewal/PTA/2017/6251640 dated 29/09/2017, which were valid upto 30/09/2018, for manufacturing of Bricks @15000Numbers/Day by using Clay @ 45000Kgs/day, coal @3Metric Tonnes/Day as raw material under orange category subject to certain conditions as mentioned therein.  <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; background: white; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">Now, the BKO has applied for obtaining renewal consent to operate under Water (Prevention & Control of Pollution) Act, 1974 & under the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Bricks @15000Numbers/Day by using Clay @ 45000Kgs/day, coal @3Metric Tonnes/Day as raw material under orange category along with requisite documents. The industry has deposited Rs. 4500/- vide Receipt No. 61733384 dated 03.02.2023 and Rs. 14500/- vide Receipt No. 493925335 dated 24.01.2023 as consent fee under the Water (Prevention & Control of Pollution) Act, 1974 & Rs. 14500/- vide Receipt No. 701071775 dated 24.01.2023 and Rs. 4500/- vide Receipt No. 398936035 dated 02.02.2023 as consent fee under the Air (Prevention & Control of Pollution) Act, 1981. The BKO has also deposited Rs. 1800/- vide Receipt No. 493925335 dated 24.01.2023, which is adequate upto 30.09.2027, against the investment of Rs. 34.98 lakh (including lease value of land) as per CA certificate dated 31.12.2022 submitted by it. <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; background: white; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">The BKO has submitted letter dated 21.02.2023 undertaken that the construction of the BKO for conversion to high draft has been completed on 28.02.2019 and as per field visit of officer of PSCST Chandigarh, they started the operation of BKO from 19.03.2019. However, the BKO got completion certificate issued to it by PSCST, Chandigarh vide letter no. PSCST/CC/2105 dated 29.03.2019. Further the BKO has submitted coal register from 01.03.2019 duly attested by CA. <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; background: white; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">The BKO has submitted compliance report with the conditions of previous consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 granted to it. <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; background: white; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">Accordingly, the industry was visited on 15.02.2023 and it was observed as under: 1.          The kiln was not in operation during visit. 2.          The kiln has stabilized the periphery road / movement area with Keri so as to suppress the dust emission generated during the vehicle movement. 3.          The kiln has provided septic tank for the treatment of domestic effluent and after that same is being discharged onto land for plantation. 4.          No unauthorized fuel was observed present at the site of the kiln.   5.          The pulverized coal was found lying in the premises to use the same as fuel in the kiln. 6.          The kiln has provided plantation along the boundary wall. The Board vide office order SEE(HQ-2)/2018/606 dated 18.12.2018 has issued directions as under: <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; letter-spacing: -.05pt; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">1.      The brick kilns which have adopted induced / high draft zig-zag technology certified by Punjab State Council for Science & Technology (PSCST) or other technology provider approved by the Punjab Pollution Control Board are allowed to operate their brick kilns in the State of Punjab. (Category – I) <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; letter-spacing: -.05pt; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">2.      The brick kilns which have adopted induced / high draft zig-zag technology but yet to obtain the completion / adequacy certificate from Punjab State Council for Science & Technology (PSCST) or other technology provider approved by the Punjab Pollution Control Board OR t whom the provisional certificate has been given by the technology provider for making corrective measures, are allowed to operate their brick kilns in the State of Punjab, (Category – II). <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; letter-spacing: -.05pt; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">3.      The consent to operate to above brick kiln owners / brick kiln shall be granted with the following special condition: - <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; letter-spacing: -.05pt; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">a)    Regular consent shall be granted to Category – I brick kilns and consent for shorter period of one year with condition to submit the final completion / adequacy certificate within three months shall be granted to Category-II brick kilns as mentioned above. <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; letter-spacing: -.05pt; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">b)    The consent is subject to the orders passed by the Hon’ble High Court for the States of Punjab & Haryana / Hon’ble National Green Tribunal or other Judicial Authority in the cases pending or being filed with regard to the subject matter of the office order. <span lang="EN-US" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; color: black; letter-spacing: -.05pt; mso-ansi-language: EN-US; mso-fareast-language: EN-IN; mso-bidi-language: PA;">c)    The consent is subject to the performance evaluation of new technology adopted by the brick kilns. The industry is complying with the provisions of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981.  Keeping in view of the above, it is recommended that the renewal Consent to Operate may be granted to industry under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention and Control of Pollution) Act, 1981 upto 30.09.2027 for manufacturing of Bricks @15000Numbers/Day by using Clay @ 45000Kgs/day, coal @3Metric Tonnes/Day as raw material under orange category, subject to the suitable conditions along with following special condition that: a)      The consent is subject to the orders passed by the Hon’ble High Court for the States of Punjab & Haryana / Hon’ble National Green Tribunal or other Judicial Authority in the cases pending or being filed with regard to the subject matter of the office order. b)      The consent is subject to the performance evaluation of new technology adopted by the brick kilns. c)      The brick kiln will pave moving area around the main brick kiln with the bricks to minimize the fugitive dust emissions. d)      The kiln shall ensure that proper sampling arrangements be provided for collection of air emission sample by the Board.
