File Note: <p style="text-align: justify;">The agenda note and report / recommendations of AEE/EE, RO, may kindly be perused.</p> <p style="text-align: justify;">The poultry farm was granted &lsquo;Consents to Operate&rsquo; under the Water Act, 1974 vide no. CTOW/Fresh/LDH3/2022/20102876 dated 30.11.2022 valid upto 31.01.2023 and under the Air Act, 1981 vide no. CTOA/Fresh/LDH3/2022/20102861 dated 30.11.2022 valid upto 31.01.2023 for 10,000 birds.</p> <p style="text-align: justify;">The poultry farm had also applied for &lsquo;Consent to Establish&rsquo;/NOC Expansion under the Water Act, 1974 and the Air Act, 1981 for 90,000 birds.</p> <p style="text-align: justify;">There was complaint from MLA Dakha &amp; village panchayat regarding the operation of the poultry farm. The application was considered and it was decided to constitute a special team to check the compliance of Environmental Laws by the poultry farms and grievance of complaint. Thereafter, the application for obtaining &lsquo;Consent to Establish&rsquo;/NOC Expansion under the Water Act, 1974 and the Air Act, 1981 was returned by the Competent Authority.</p> <p style="text-align: justify;">The poultry farm was given personal hearing before the Chief Environmental Engineer, Ludhiana on 30.09.2022, wherein it was decided that:-</p> <p style="text-align: justify;">1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The poultry farm shall apply for consent to operate under Water (Prevention &amp; Control of Pollution) Act 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981, within 15 days.</p> <p style="text-align: justify;">2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Environmental Engineer, Regional Office-3, Ludhiana shall visit the poultry farm, verify the contentions made by it, send conclusive report / recommendations w.r.t. siting criteria laid down by the Board, pollution control arrangements &amp; PPCB/ CPCB guidelines for poultry farm and process the application, within 20 days.</p> <p style="text-align: justify;">3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Further action in the matter will be taken after receipt of report from Regional Office-3, Ludhiana.</p> <p style="text-align: justify;">Then, the poultry farm has applied for &lsquo;Consent to Operate&rsquo; under the Water Act, 1974 and the Air Act, 1981 for 150000 birds. The poultry farm has deposited consents fee, which is adequate upto 06.02.2031 under both Acts.</p> <p style="text-align: justify;">It is pertinent to mention here that the proposed site has already been visited by AEE of RO on 07.11.2022 and it was observed that the site is&nbsp;located along a kacha rasta leading from road connecting village Bassian Bet with village Khanjarwal. The site is located adjacent (separated by revenue rasta of 04 karams) to canal colony of Department of Water Resources. However, the residential colony is abandoned state and only one family of chowkidar is residing in one quarter of the colony. Matter was also discussed with Sub-Divisional Engineer, Sidhwan Canal and it was informed that the colony is abandoned since 2017. Further compliance of the siting guidelines is under:</p> <p style="text-align: justify;">As per Guidelines prescribed by CPCB for Poultry farms, siting criteria is as under:</p> <p style="text-align: justify;">1.&nbsp;&nbsp;&nbsp;&nbsp;500 m from residential zone in order to avoid nuisance caused due to odour &amp; flies &ndash; No village phirni/lal lakir is located within 500 m distance of the site. Both nearby Village Khanjarwal and Bassian bet are located at a distance more than 800 m from site.</p> <p style="text-align: justify;">2.&nbsp;&nbsp;&nbsp;&nbsp;100 m from major water course like River, Lakes, canals and drinking water source like wells, summer storage tanks, in order to avoid contamination due to leakages/spillages, if any &ndash; Sidhwan Canal is located at a distance of about 190 m from site. No other water source is located within 100 m distance of site.</p> <p style="text-align: justify;">3.&nbsp;&nbsp;&nbsp;&nbsp;100 m from national Highway (NH) and 50 m from State Highway (SH) in order to avoid nuisance caused due to odour&amp; flies &ndash; No NH &amp; SH fall within 100 m distance of site.</p> <p style="text-align: justify;">4.&nbsp;&nbsp;&nbsp;&nbsp;10-15 m from rural roads/internal roads/village pagdandis &ndash; Road connecting village Bassian Bet with Kanjarwal is at a distance of 90 m from site.</p> <p style="text-align: justify;">5.&nbsp;&nbsp;&nbsp;&nbsp;The Poultry sheds should not be located within 10 m from farm boundary for cross ventilation and odour dispersion &ndash; Sheds are under construction and are located at a distance more than 10 m from boundary.</p> <p style="text-align: justify;">It is further submitted that the Government School of Bassian Bet is at a distance of 102 m from the proposed site. Thus, the site is suitable for establishment of such type of units.</p> <p style="text-align: justify;">A team of officers of the Board was constituted comprising of Sh. Harpreet Singh, AEE &amp; Sh. Varun Kumar, JEE to visit the poultry farm, meet the complainants and submit the report vide this office letter no. 7722-23 dated 23.12.2022. Accordingly, the poultry farm was visited by the team on 05.01.2023 and report has been received through e-mail dated 21.02.2023 (Copy attached) and during visit, it was observed as under.</p> <p style="text-align: justify;">1.&nbsp;&nbsp;&nbsp;&nbsp;The poultry farm was in operation during visit.</p> <p style="text-align: justify;">2.&nbsp;&nbsp;&nbsp;&nbsp;The poultry farm has currently 1,00,000 birds in Its premises and the construction of remaining sheds are going on. The poultry farm has also applied for varied Consent to Operate under both acts which are under process with Regional Office-3, Ludhiana.</p> <p style="text-align: justify;">3.&nbsp;&nbsp;&nbsp;&nbsp;During visit, it was found that proper ventilation and free flow of air over manure collection points under sheds have been provided by the farm. No foul smell observed outside the sheds.</p> <p style="text-align: justify;">4.&nbsp;&nbsp;&nbsp;&nbsp;Carcasses of dead birds are collected on regular basis and disposed into a pit of 10 ft in environmentally sound manner as Informed by the representative of the farm.</p> <p style="text-align: justify;">5.&nbsp;&nbsp;&nbsp;&nbsp;Feed mill and Godown are constructed with concrete floor at entrance of poultry farm at elevated ground level and in a closed shed.</p> <p style="text-align: justify;">6.&nbsp;&nbsp;&nbsp;&nbsp;Dust collector system are Installed to control emissions from mixing and grinding section of the feed mill.</p> <p style="text-align: justify;">7.&nbsp;&nbsp;&nbsp;&nbsp;The complainant was contact telephonically and he did not attend the call.</p> <p style="text-align: justify;">8.&nbsp;&nbsp;&nbsp;&nbsp;During visit, it was observed that the poultry farm was undergoing construction of septic tanks at site.</p> <p style="text-align: justify;">9.&nbsp;&nbsp;&nbsp;&nbsp;The poultry farms need to provide green cover all across the boundary in its premises.</p> <p style="text-align: justify;">In view of the report from Regional Office and special team of officers, no violation has been observed.</p> <p style="text-align: justify;">May if approved, it is recommended that the applications be forwarded to Regional Office-3 to decide the consents applications on merit.</p> <p style="text-align: justify;">Competency : EE, RO</p> <p>&nbsp;</p>
