The Project Proponent had submitted layout plan approved by the Senior Town Planner, Ludhiana vide letter no: 177 STP(L)/BAI dated 28.01.2022. As per this layout plan, total site area was <span style="mso-spacerun: yes;">&nbsp;</span>61171.13 square meters. Thus, the project was covered under the EIA Notification dated 14.09.2006 and is required to obtain Environmental Clearance. <span style="mso-spacerun: yes;">&nbsp;</span>The project proponent failed to obtain Environmental Clearance as required under EIA Notification dated 14.09.2006. As per approved layout plan the green area was 1996 square meters and this green area was not sufficient to handle discharge of 140 KLD. Only possibility of discharge was into the sewer line of GLADA leading to STP Balloke as main sewer line of GLADA passes near to the proposed site. The project proponent had not obtained necessary permissions from the Greater Ludhiana Area Development Authority (GLADA) in this regard. The project proponent had not submitted any proposal regarding handling of solid waste to be generated from its premises. </span></p> <p class="MsoListParagraphCxSpMiddle" style="margin: 0in; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: 1.5in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; background: white;">The proposed site of the residential colony was suitable for establishment of residential colony (group housing), however, the project proponent had not proposed adequate measures regarding disposal of treated trade effluent &amp; for handling of solid waste to be generated from its premises.</span></p> <p class="MsoListParagraphCxSpLast" style="margin: 0in; margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: 1.5in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; background: white;">The case was processed accordingly and show cause notice for refusal of &lsquo;Consent to Establish&rsquo; / NOC was issued to the project proponent. The Project Proponent submitted reply to the SCN and the same was found non-satisfactory. Accordingly, &lsquo;Consent to Establish&rsquo; / NOC applied by the project proponent was refused vide no. The project proponent has already deposited Rs. 1,44,000/- vide UTR no. N095221903558760 dated 05.04.2022 as NOC fee which is adequate for project cost of Rs. 169 crores (orange category). Site falls in <strong style="mso-bidi-font-weight: normal;">&lsquo;Residential Zone&rsquo;</strong> as per approved Master Plan Ludhiana (2007-2031). Permission for Change of Land Use for Residential Purpose (Group Housing) has been granted. The area is mainly residential and major residential colonies like Atam Vallabh Janpath, Janpath Estates, J.P. Farms, Hero Homes and Ananta Estate are located near to the proposed site. The Sidhwan Canal is located South to proposed site, Birmi Link Road on west side, Private Agricultural land on North Side and Ananta Estate is located on East side of the proposed site. No drain and Eco-sensitive structure are located within 500 meters radius of the proposed site. Remaining 48 KLD water will be flushing water requirement and treated water from STP will be used as flushing water through dual plumbing system. As per the proposal, the estimated solid waste to be generated from the residential colony is about 440 Kg/day. Estimated bio-degradable or wet waste to be generated is 198 Kg/day and the project proponent has proposed to install bio-composter of capacity 200 Kg /day to convert the same into manure. The project proponent has proposed to dispose off recyclable components through authorized vendors and inert waste at authorized dump site through authorized collecting agency. The project proponent has submitted pointwise reply of observations of last refusal of &lsquo;Consent to Establish&rsquo; / NOC , which is attached online.</span></p> <p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; background: white;">The Proposed site was visited by undersigned on 28.02.2023 and it was observed that the proposed site is located along Sidhwan Canal Opposite to Atam Vallabh Janpath Estate in the revenue estate of village Birmi.
