Subject:      Application for obtaining renewal of 'consent to operate' under the Water Act, 1974 and Air Act, 1981 – M/s G.K. Cold Storage, Vill. Alipur, Tehsil Khanna, Distt. Ludhiana. Ref:             Industry's Application ID 21156265 (W) and 21157503 (A) dated 15/02/2023. It is submitted that the industry was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/LDHKH/2019/9258070 dated 31/01/2019 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/LDHKH/2019/9258086 dated 31/01/2019, both valid upto 31/12/2022 for the storage of Fruits and Vegetables etc of Capacity @ 5343 MT/Year. Now, the industry has applied for renewal of consents to operate under the Water Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 with requisite documents under Orange Category. The industry has deposited Rs. 55080/- vide e-R no. 918726230 dated 08/02/2023 on account of Water consent fee and Rs. 63980/- vide e-R no. 83822762 dated 08/02/2023 on account of Air consent fee against fixed assets of Rs. 632.97 Lacs as on 31/03/2022 as per CA certificate dated 08/02/2023, which is adequate upto 31/12/2027 as per Board's Office Order dated 29/10/2018 after deducting NOC regularization and penalty charges. The industry was visited by the A.E.E. of this office on 22/02/2023 and it was observed as under: 1.        The industry is cold store. 2.        There is no generation of trade effluent as whole of the water used for the cooling purposes is being re-circulated. 3.        There is only generation of domestic effluent which is being discharged onto land for plantation after passing through septic tank. 4.        There is no generation of any air emissions as the industry has not installed any boiler/ bhathi/ furnace. 5.        The industry has installed D.G. set of capacity 125 KVA, which is equipped with canopy and stack of adequate height. 6.        Further, the industry is complying with the conditions of consents granted to it. 7.        The industry has submitted building plan approved on 20/02/2023 from competent person Er. Jasvir Singh approved under Factories Act, 1948. Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under: "The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries." It is intimated that CPCB has already issued modified directions u/s 18(1)b of the Water Act, 1974 & the Air-Act, 1981 regarding Harmonization of Classification of Industrial sectors under Red/Orange/Green/White categories vide its letter no. B 29012/ESS/CPA/2015-16/85-84 dated 7.3.2016 alongwith the "Final document on revised classification of Industrial sectors under Red, Orange, Green & White categories" which also includes the consent period for which the consents are to be granted to Red, Orange and Green category industries for 5 years, 10 years and 15 years respectively. Further, Board vide Head Office letter no. SEE(HQ-2)/2018/ 9982-10003 dated 27/08/2018 has directed to strictly follow the consent validity criteria for Red, Orange and Green category industries as mentioned in the modified directions issued by CPCB u/s 18(1)b of the Water Act, 1974 & the Air Act, 1981 i.e. consent to Red, Orange and Green category industries may be granted for 5 years, 10 years and 15 years respectively. But, in the subject cited case, the industry has deposited consent fee only upto 31/12/2027. It is further submitted that as per Board Office Order no. 244 dated 03/06/2013, the powers have been delegated to the Environmental Engineers of the Regional Offices of the Punjab Pollution Control Board to grant 'consent to establish' / operate under the Water Act, 1974 and Air Act, 1981 for Cold Storage irrespective of its capacity. Further, the industry is complying with the conditions of the consents granted to it under the Water Act, 1974 and the Air Act, 1981. In view of the above, if approved, the consent to operate granted under the Water Act, 1974 and the Air Act, 1981 may be renewed upto 31/12/2027 with suitable conditions alongwith special conditions that: a.    The industry is advised to obtain necessary clearance for Abstraction of Ground Water from the Punjab Water Regulation and Development Authority (PWRDA). <span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">b.    The industry shall not generate any trade effluent from washing of fruits etc. <span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-ansi-language: EN-US; mso-bidi-language: AR-SA;">c.    The industry shall make adequate arrangements for disposal of solid waste as well as spoiled goods to avoid any nuisance problem in the area.
