CTOW/Varied/FGS/2022/18897908 dated 08/08/2022 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/FGS/2022/18896127 dated 08/08/2022 both valid upto 31/03/2023 for the manufacturing of Billets, MS bars, Flats and HR coil @ 250 MTD with special conditions that:</span></p>

<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Now, the industry has applied for obtaining renewal of 'consent to operate' under the Water Act, 1974 and Air Act, 1981 with requisite documents through OCMMS. The industry has deposited consent fee of Rs. 112800/-vide UTR no. 76753684 dated 13/02/2023 under Water Act, 1974 consent fee and Rs. 112800/-vide UTR no. 338265093 dated 13/02/2023 under Air Act, 1981 consent fee against the un-depreciated of fixed assets of Rs. 2294.71 lacs as on 30/04/2022 as per C.A. Certificate dated 07/05/2022. The consent fee deposited by the industry is adequate <strong>upto 30/11/2027</strong> as per Board's Office Order dated 29/10/2018. </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Accordingly, the site was visited by the AEE of this office alongwith ASO, Air Lab, Head Office, Patiala on <strong>13/09/2022</strong> and observed as under:</span></p>

<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">It is pertinent to mention here that the industry has already obtained Environmental Clearance under EIA notification dated 14/09/2006 vide no DECC/SEIAA/2020/1962 dated 08/09/2020 for manufacturing of Steel ingot/Billets @ 1,05,000 MTA and Rounds, Square, TMT/MS Bars, Angles, Channel, Flats @ 80,000 MTA.<span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-justify: inter-ideograph;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; color: red; mso-bidi-font-weight: bold;"><span style="mso-tab-count: 2;"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">It is pertinent to mention here that the Hon'ble National Green Tribunal while disposing of OA No.837 of 2018 titled as Sandeep Mittal Versus Ministry of Environment, Forests and Climate Change and others vide order dated 01.02.2021 has observed that Environment Impact Assessment is an essential component of the "Precautionary as well as the 'Sustainable Development' principles. Laying down conditions for EC based on appraisal is not enough unless compliance thereof is duly monitored and ensured with a view to achieve the said object. The Hon'ble NGT vide the said order dated 01.02.2021 had issued certain directions to Ministry of Environment, Forest & Climate Change and also directed that the Central Pollution Control Board and the State Pollution Control Boards may take measures to conduct monitoring of EC conditions.</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-justify: inter-ideograph;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;"><span style="mso-tab-count: 2;"> </span>The point wise compliance Environmental Clearance condition is as mentioned below this case. <p class="MsoListParagraphCxSpMiddle" style="margin-left: 27.0pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph;"><strong style="mso-bidi-font-weight: normal;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">But, the industry has not obtained revised Environmental Clearance as per consent condition imposed earlier.</span></strong></p>

For this, a village pond having volume @ 28713 m3 located at Village Bhadla Neecha shall be adopted for desalting to recharge the water @ 43070 m3/annum (50% of total recharge 86139 m3annum.) As an additional safety measure, the stream carrying waste water of the village shall be diverted in one corner of Phytorid plants trench (designed based on the technology developed by CSIR-NEERI's) divided in different parts, the overflow of each chamber shall be allowed to enter into another chamber which will ultimately lead to the purification of water and collected into the pond to avoid any contamination of ground water aquifer, Pond water will percolate through natural strata (without injection) to augment the ground water and remaining water shall be used for irrigation purposes by pumping method in nearby fields.</span></p>

However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries."</span></strong></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">In view of above, if approved it is recommended that show cause notice before refusal of 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be issued due to non compliance of Environmental Clearance conditions and consent conditions.</span></p> |
