CTOW/Fresh/LDH2/2016/4423306 dated 19/10/2016, valid upto 30/06/2021 for the manufacturing of Ni. Plating of needle on job basis @ 2000 No/day. </span></p>
<p class="MsoBodyTextIndent" style="text-align: justify; margin: 12.0pt 0in 6.0pt 0in;"><strong><u><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi; mso-bidi-language: PA;">History</span></u></strong></p>
<p class="MsoBodyText" style="margin-bottom: 12.0pt; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; background: white;">Under Environment surveillance campaign, the industry was surprisingly visited on 01/12/2022 by the officer of the Board and observed as under:</span></p>

It has installed 2 no. washing drums, 1 no. acid dip drum and 1 no. electroplating tank. However, water polluting process was not in operation.</span></p>

Thus, it has disposed off its untreated effluent in illegal manner w.e.f. 26.07.2019 to August, 2022.</span></p>
<p class="MsoBodyText" style="margin-left: .25in; text-indent: -.25in; line-height: 115%; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; background: white;">The industry is not having valid agreement with CETP operator for lifting of trade effluent. </span></p>

<p class="MsoBodyText" style="text-indent: -.25in; line-height: 115%; mso-list: l1 level1 lfo3; margin: 0in 0in 12.0pt .25in;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">6.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; background: white;">The Industry was operating its unit without having valid consent to operate of the Board under the Water (Prevention & Control of Pollution) Act, 1974 and violating the conditions of the consent earlier granted to it. Thus, violating the provisions of the said Act intentionally & deliberately.</span></p>
<p class="MsoBodyText" style="margin-bottom: 12.0pt; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; background: white;">Accordingly, notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 proposing for closure of the unit was issued to the industry vide</span> <span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; background: white;">letter no. 49 dated 07/01/2023 with an opportunity of personal hearing before the Chief Environmental Engineer on 19/01/2023. Sh. Bhupinder Kumar, Proprietor of the Industry attended the hearing and submitted the written reply, which was taken on record. He further stated that some time may please be given to attend the observations made during visit dated 01.12.2022 and to make an agreement with the CETP operator for lifting of effluent. He could not give satisfactory reply for non lifting of untreated effluent from 26.07.2019 onwards.</span></p>
<p class="MsoBodyText" style="margin-bottom: 12.0pt; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; background: white;">It was observed that the industry is not maintaining its record regarding fresh water consumption in the process area as well as untreated effluent lifted by CETP operator since long. Thus, the Industry is disposing of its untreated effluent in illegal manner and causing water pollution. Moreover, the Consent to Operate granted to the industry had expired on 30.06.2021 and the industry is also not having valid agreement made with the CETP operator for lifting of untreated trade effluent.</span></p>
<p class="MsoBodyText" style="margin-bottom: 12.0pt; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; background: white;">After hearing the officers of the Board and proprietor of the industry, Chief Environmental Engineer (B) Patiala decided that: </span></p>

<p class="MsoBodyText" style="margin-bottom: 12.0pt; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; background: white;">Accordingly, the proceedings of the personal hearing has been conveyed to the industry as well as Environmental Engineer, Regional Office, Fatehgarh Sahib vide letter no. 380-81 dated 31/02/2023 for ensuring the compliance.</span></p>
<p class="MsoBodyText" style="margin-bottom: 12.0pt; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; background: white;">Now, the subject cited industry has applied for obtaining fresh consent to operate under the Water Act, 1974 and Air Act, 1981 with requisite documents. </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; letter-spacing: .05pt; mso-bidi-font-weight: bold;">The industry has deposited </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Rs. 13100/- vide e-R No. 395735934 dated 13/02/2023 as Water consent fee and Rs. 7000/- vide e-R no. 540901053 dated 20/02/2023 <span style="background: white;">against the un-depreciated fixed assets of Rs. 9.35 Lacs as on 31/01/2023 as per CA certificate dated 13/02/2023, which is adequate </span><strong>upto 30/06/2028</strong><span style="color: red;"> </span>under the Water Act, 1974 (after deducting 200 % penalty charges under Water Act). Further, the industry is required to deposit Rs. 25222/- under the Air Act, 1981 to get validity of 'consent to operate' under Air (Prevention & Control of Pollution) Act, 1981 upto 30/06/2028 after deducting 500 % penalty charges), as per Board's Office Order dated 29/10/2018<span style="background: white;">.</span></span></p>
<p class="MsoBodyTextIndent" style="margin-left: 0in; text-align: justify; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">The industry has submitted written request vide letter dated 02.03.2023, which is reproduced as under:</span></p>
<p class="MsoBodyTextIndent" style="margin-left: 0in; text-align: justify; text-indent: 1.0in; line-height: 115%;"><strong><em><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">"I, Bhupinder Kumar, Partner of M/s Daulat Industries hereby request that I am in huge financial debt. Till date, I have not obtained 'consent to operate' under the Air (Prevention & Control of Pollution) Act, 1981 and had only obtained 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974. I have paid Rs. 13100/- vide e-R no. 395735934 dated 13/02/2023 as Water consent fee and Rs. 7000/- vide e-R no. 540901053 dated 20/02/2023 as Air consent fee. Our industry's commissioning date is Aug/2006. I am not in position to pay balance consent fee under the Air (Prevention & Control of Pollution) Act, 1981. Kindly, give relaxation in the same."</span></em></strong></p>
<p class="MsoBodyTextIndent" style="margin-left: 0in; text-align: justify; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Now, the industry was visited on <strong>02.03.2023</strong> by undersigned and observed as under:</span></p>

However, PSPCL authorities have not disconnected the electric supply of the industry till date.</span></p>

<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:</span></p>
