CTOW/Fresh/BTI/2020/13088752 & CTOA/Renewal/BTI/2020/13006463 dt. 18.07.2020, with validity upto 30.09.2023, for operation of brick kiln with induced draft High Draft Zig-Zag Firing Technology to manufacture bricks & tiles @ 30,000 nos./day, subject to the conditions mentioned therein. <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -34.7pt; line-height: normal; mso-pagination: none; mso-list: l2 level1 lfo2; tab-stops: 35.45pt; text-autospace: none; margin: .4pt .2pt 0cm 14.2pt;">Ø    Now, the industry has applied for renewal of consent to operate under the Air Act, 1981 and new consent to operate under Water Act, 1974 for operation of brick kiln with induced draft High Draft Zig-Zag Firing Technology to manufacture bricks & tiles @ 30,000 nos./day under orange category. <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -34.7pt; line-height: normal; mso-pagination: none; mso-list: l2 level1 lfo2; tab-stops: 35.45pt; text-autospace: none; margin: .4pt .2pt 0cm 14.2pt;">Ø    The kiln has deposited consent fee of Rs. 26,100/- through online vide R.no. 421048311 dated 15.02.2023 under Air Act, 1981 and Rs. 26,100/- through online vide R.no. 239541303 dated 26.02.2023 under Water Act, 1974, which is adequate upto 30.09.2032 against the fixed asset of Rs. 32.18 lac as per the C.A. certificate. <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -34.7pt; line-height: normal; mso-pagination: none; mso-list: l2 level1 lfo2; tab-stops: 35.45pt; text-autospace: none; margin: .4pt .2pt 0cm 14.2pt;">Ø    As per the record file no notice / direction u/s 31-A of Air Act, 1981 has ever been issued to the brick kiln. Ø    The <span lang="X-NONE" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi; color: black; mso-themecolor: text1; mso-ansi-language: X-NONE;">industry was lastly visited by AEE of this office on 14.07.2020<span lang="X-NONE" style="font-family: 'Tahoma',sans-serif; mso-fareast-font-family: Tahoma; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi; color: black; mso-themecolor: text1; mso-ansi-language: X-NONE;"> and it was observed that the industry is complying with the provisions of the Water Act, 1974 & Air Act, 1981 as well as code of practice prescribed by the Govt. vide order dt. 15.10.2013. <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -35.45pt; line-height: normal; mso-pagination: none; mso-list: l1 level1 lfo1; tab-stops: 35.45pt; text-autospace: none; margin: 0cm .2pt 0cm 14.2pt;">Ø    It is submitted that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry. <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -35.45pt; line-height: normal; mso-pagination: none; mso-list: l1 level1 lfo1; tab-stops: 35.45pt; text-autospace: none; margin: 0cm .2pt 0cm 14.2pt;">Ø    The kiln is complying with the code of practice prescribed by the Board for the brick kin in the state and directions issued by Govt./ PPCB from time to time.  The kiln is also complying with the recommendations given by the CSIR-Central Building Research Institute, Roorkee in the feasibility report for adopting operating practice as well as fuel feeding practice. The industry is also complying with the provision of Water Act, 1974. <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -35.2pt; line-height: 113%; mso-pagination: none; mso-list: l1 level1 lfo1; tab-stops: 35.45pt; text-autospace: none; margin: 0cm .2pt 0cm 14.2pt;">Ø    Moreover, the industry has filled the same production capacity of the bricks @ 30,000/day as mentioned in the previous consent to operated granted to the industry. So, there is no increase in production capacity of the industry. <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -35.2pt; line-height: 113%; mso-pagination: none; mso-list: l1 level1 lfo1; tab-stops: 35.45pt; text-autospace: none; margin: 0cm .2pt 0cm 14.2pt;">Ø    Keeping in view of above, it is re commended that consent to operate under the Water Act, 1974 & Air Act, 1981 may be granted to the brick kiln for production of bricks & tiles @ 30,000 no./day under orange category for a period up to 30.09.2032, subject to the suitable conditions along with the following specific conditions: - <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -21.25pt; line-height: 115%; mso-pagination: none; mso-list: l0 level1 lfo3; text-autospace: none; margin: 3.7pt .2pt 0cm 14.2pt;">1.        This consent is granted subject to the orders passed by the Hon'ble High Court for the States of Punjab & Haryana/ Hon'ble National Green Tribunal or Other Judicial Authority in the case spending or being filed with regard to the operation of brick kilns in the State. <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -21.25pt; line-height: 115%; mso-pagination: none; mso-list: l0 level1 lfo3; text-autospace: none; margin: 3.7pt .2pt 0cm 14.2pt;">2.        This consent is granted subject to the performance evaluation of new technology adopted by the brick kilns. <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -21.25pt; line-height: 115%; mso-pagination: none; mso-list: l0 level1 lfo3; text-autospace: none; margin: 3.7pt .2pt 0cm 14.2pt;">3.        The BKO will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as raw material for the manufacture of bricks and submit the same, within two months. <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -21.25pt; line-height: 115%; mso-pagination: none; mso-list: l0 level1 lfo3; text-autospace: none; margin: 3.7pt .2pt 0cm 14.2pt;">4.        The industry shall comply with code of practice for brick kiln and shall achieve the prescribed standard notified by MOEF&CC. <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: -21.25pt; line-height: 115%; mso-pagination: none; mso-list: l0 level1 lfo3; text-autospace: none; margin: 3.7pt .2pt 0cm 14.2pt;">5.        The industry shall not generate/ discharge any trade effluent and shall discharge only Domestic Effluent onto land for plantation after passing through septic tank.
