File Note: <p class="MsoNormal" style="margin-bottom: 3pt; text-align: justify; line-height: 24px; background: white;"><span style="font-size: 12pt; line-height: 24px;">It is submitted that the project proponent has applied for obtaining 'consent to establish'(NOC) from pollution angle for Approved Industrial Park with no. of industrial plots @ 82 under orange category.</span></p> <p class="MsoNormal" style="margin-bottom: 3pt; text-align: justify; line-height: 24px; background: white;"><span style="font-size: 12pt; line-height: 24px;">The industry has deposited Rs. 10800/- vide UTR no. SBIN12218251928 dated 01.07.2022 as NOC fee, which is adequate for one year as per project cost of Rs. 4.86 Cr. The industry has submitted change of land use certificate from the office of Deptt. of Town &amp; Country Planning, Punjab vide memo no. 152 dated 13.01.2022 for area 17.097 Acres. As per CLU, permission is granted for industrial park as per provisions of Punjab Regional and Town Development Act,1995.</span></p> <p class="MsoNormal" style="margin-bottom: 3pt; text-align: justify; line-height: 18pt; background: white;"><span style="font-size: 12pt;">Earlier, the application of the project proponent for obtaining was returned due to following reasons:</span></p> <p class="MsoListParagraphCxSpFirst" style="margin-bottom: 3pt; margin-left: 27pt; text-align: justify; text-indent: -27pt; line-height: 18pt; background: white;"><span style="font-size: 12pt;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-size: 12pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">No certificate from the revenue authority, such as DC/ADC/SDM submitted by the promoter to adjudge the suitability of site.</span></p> <p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 3pt; margin-left: 27pt; text-align: justify; text-indent: -27pt; line-height: 18pt; background: white;"><span style="font-size: 12pt;">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-size: 12pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">The promoter has not submitted any proposal in which it has mentioned the type of industries to be established in the proposed industrial park, so as the applicability of EIA notification may be adjudged.</span></p> <p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 3pt; margin-left: 27pt; text-align: justify; text-indent: -27pt; line-height: 18pt; background: white;"><span style="font-size: 12pt;">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-size: 12pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">The promoter has not submitted any proposal for effluent to be generated from the upcoming industrial units in the park and its disposal arrangements.</span></p> <p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 3pt; margin-left: 27pt; text-align: justify; text-indent: -27pt; line-height: 18pt; background: white;"><span style="font-size: 12pt;">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-size: 12pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">As per the layout plan submitted by the project promoter, no green area has been earmarked for disposal of the treated wastewater.</span></p> <p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 3pt; margin-left: 27pt; text-align: justify; text-indent: -27pt; line-height: 18pt; background: white;"><span style="font-size: 12pt;">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-size: 12pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">As per the report of visiting officer of the Board, there is one school namely M/s Edumont World School, Nabha of having 800 students and staff members falling adjacent to the proposed site.</span></p> <p class="MsoListParagraphCxSpLast" style="margin-bottom: 3pt; margin-left: 27pt; text-align: justify; text-indent: -27pt; line-height: 18pt; background: white;"><span style="font-size: 12pt;">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span></span><span style="font-size: 12pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">The PP has submitted an undertaking that it shall left a green buffer Zone towards the said premises. However, the promoter is required to submit revised layout plan along with the application clearly indicating the green buffer towards the school.</span></p> <p class="MsoNormal" style="margin-bottom: 3pt; text-align: justify; line-height: 18pt; background: white;"><span style="font-size: 12pt;">Now, the project proponent has resubmitted the application for obtaining consent to establish (NOC) of the Board for establishment of the approved industrial park.</span></p> <p class="MsoNormal" style="margin-bottom: 3pt; text-align: justify; line-height: 18pt; background: white;"><span style="font-size: 12pt;">The project proponent has submitted undertaking dated 16.12.2022 with submission as under:</span></p> <p class="MsoNormal" style="margin-bottom: 3pt; text-align: justify; line-height: 18pt; background: white;"><span style="font-size: 12pt;">I Ashok Kumar S/o Sh. Brij Lal R/o Opposite Shahi Samadh,Preet Vihar, Nabha, Distt. Patiala, Anupam Jindal W/o Ashok Kumar,R/o Preet Vihar,Opposite Shahi Samadh,Nabha, Distt. Patiala,Prem Kanta Bhardwaj W/o Subhash Chander Bhardwaj R/o Ajit Nagar, Patiala and Chander Shekhar S/o Sh. Joginder Rai R/o Sham Bagh Enclave , Nabha, Distt. Patiala, Partners M/s Nabha Industrial Zone(Park) with its correspondence office C/o Ashok Kumar, Preet Vihar, Nabha, Distt Patiala do, hereby, solemnly affirm and declare as under:</span></p> <p class="MsoNormal" style="margin-bottom: 3pt; text-align: justify; line-height: 18pt; background: white;"><span style="font-size: 12pt;">1. That, we are developing an industrial park M/s Nabha Industrial Zone(Park) having total land area of about 17.097 acre in the revenue estates of Villages, Rohti Channa &amp; Rohti Khas of Tehsil Nabha, Distt. Patiala.</span></p> <p class="MsoNormal" style="margin-bottom: 3pt; text-align: justify; line-height: 18pt; background: white;"><span style="font-size: 12pt;">2. That we have already approved the industrial park from Senior Town Planner, Patiala vide letter No.329 dated 14/02/2022.</span></p> <p class="MsoNormal" style="margin-bottom: 3pt; text-align: justify; line-height: 18pt; background: white;"><span style="font-size: 12pt;">3. That project is located outside the MC limits of Nabha whose Master Plan is yet to be notified shortly. 4. That, the project land has already been granted CLU by Senior Town Planner, Patiala vide their office letter no152 dated 13/01/2022</span></p> <p class="MsoNormal" style="margin-bottom: 3pt; text-align: justify; line-height: 18pt; background: white;"><span style="font-size: 12pt;">5. That project plans have also been sanctioned by the Competent authority vide drawing no. letter No.329 dated 14/02/2022.</span></p> <p class="MsoNormal" style="margin-bottom: 3pt; text-align: justify; line-height: 18pt; background: white;"><span style="font-size: 12pt;">6. That an education institute (Edmount World School, Nabha) is located within 100 meter in NE direction towards (Patiala side) along the boundary wall of proposed industrial park.</span></p> <p class="MsoNormal" style="margin-bottom: 3pt; text-align: justify; line-height: 18pt; background: white;"><span style="font-size: 12pt;">7. That, as per prevailing stipulation/notification of Punjab Pollution Control Board, the project proponent (PP) is supposed to provide an buffer zone of 15 M towards education institute boundary of which are located within 100 meters from the boundary of such air polluting industries(Proposed industrial park).</span></p> <p class="MsoNormal" style="margin-bottom: 3pt; text-align: justify; line-height: 18pt; background: white;"><span style="font-size: 12pt;">8. That, to ensure compliance with applicable norms, we will providel5 M buffer zone towards education institute boundary wall which is located within 100 meters from the boundary of the proposed industrial park.</span></p> <p class="MsoNormal" style="margin-bottom: 3pt; text-align: justify; line-height: 18pt; background: white;"><span style="font-size: 12pt;">9. That, the condition of the buffer zone gets waive off if the colony happens to fall in a residential zone when the master plan will be notified.</span></p> <p class="MsoNormal" style="margin-bottom: 3pt; text-align: justify; line-height: 18pt; background: white;"><span style="font-size: 12pt;">10. That, Nabha Industrial Zone(Park) shall leave 50 Feet/15M distance from the boundary wall of Edmount World School, Nabha which shall be used as green buffer zone till such time the Master Plan of Nabha will be notified.</span></p> <p class="MsoNormal" style="margin-bottom: 3pt; text-align: justify; line-height: 18pt; background: white;"><span style="font-size: 12pt;">Further, the project proponent has submitted site plan and as per site plan total land area in 82750 square yards, thus project does not cover under the EIA Notification dated 14.09.2006 (8 (b) -&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Townships and Area Development projects as well as industrial sheds, educational institutions, hospitals and Hostels for educational institutions applicable for&nbsp;&nbsp;&ge; 1,50,000 sq. mtrs and &lt;3,00,000 sq. mtrs built up area or covering an area &ge;50 ha) .</span></p> <p class="MsoNormal" style="margin-bottom: 3pt; text-align: justify; line-height: 18pt; background: white;"><span style="font-size: 12pt;">The project proponent has proposed to install STP of adequate capacity based on Biological treatment for domestic effluent @ 29 KLD generated from the operation of its project. The project proponent has proposed to utilize treated effluent onto land for irrigation and watering of green area @ 2800 sqm within township. In this regard, the project proponent has submitted feasibility report prepared by Alliance Consultants, Patiala.&nbsp;&nbsp;</span></p> <p class="MsoNormal" style="margin-bottom: 3pt; text-align: justify; line-height: 18pt; background: white;"><span style="font-size: 12pt;">The site was already visited by the AEE of this office on 10.11.2022&nbsp;and during visit, it was observed as under:</span></p> <p class="MsoNormal" style="margin: 0in 0in 3pt 27pt; text-align: justify; text-indent: -27pt; line-height: 18pt; background: white;"><span style="font-size: 12pt;">1.&nbsp;&nbsp;&nbsp;&nbsp;The industry has not started&nbsp;any construction work at site and site was found vacant.</span></p> <p class="MsoNormal" style="margin: 0in 0in 3pt 27pt; text-align: justify; text-indent: -27pt; line-height: 18pt; background: white;"><span style="font-size: 12pt;">2.&nbsp;&nbsp;&nbsp;&nbsp;There is no Zoo and air polluting industry falls within 500 m of the site.</span></p> <p class="MsoNormal" style="margin: 0in 0in 3pt 27pt; text-align: justify; text-indent: -27pt; line-height: 18pt; background: white;"><span style="font-size: 12pt;">3.&nbsp;&nbsp;&nbsp;<span style="background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">&nbsp;There is a school namely M/s Edumont World School, Nabha of having 800 students and staff members falling adjacent to the proposed site.&nbsp;</span></span></p> <p class="MsoNormal" style="margin-bottom: 3pt; text-align: justify; line-height: 18pt; background: white;"><span style="font-size: 12pt;">In view of above, if approved, recommendation may be sent to SEE, Zonal Office-1, Patiala may be granted to the project proponent for setting up of Industrial Park with no. of industrial plots @ 82 Nos. under the Water Act, 1974 and the Air Act, 1981 for one year with suitable conditions as per policy of the Board.</span></p>
