It is submitted that the industry is a small scale Green category industry and has been granted Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. R15LDH4CTOW3143854 dated 19.11.2015 is valid upto 30.05.2018 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. R15LDH4CTOA3143639 dated 17.11.2015 is valid upto 30.06.2018 under the red category for disposing off trade effluent @ 1 KLD lifted by M/s J.B.R Technologies Pvt. Ltd., Ludhiana (CETP operator) and Domestic effluent @ 0.5 KLD into sewer. Earlier, the industry has been visited by officer of this office on 13.09.2022 and it was observed as under: 1.           The industry was in operation during the visit. Only Hot Dip Galvanizing process was being operated. Zinc plating was not in operation during visit and seem to be not operated since long. 2.           The hood of the Hot Dip Galvanizing was found completely corroded and the APCD was not in operation during visit. 3.           The industry has neither maintained the record of the water consumption and trade effluent lifting to the CETP operator nor produced any record of trade effluent lifting as well. The last trade effluent lifting to M/s JBR Technologies Pvt. Ltd., Ludhiana was @ 5,000 ltr vide 393513 on 31.12.2020 as shown during visit. 4.           The industry has provided an underground sewer line adjoining to the drain line of the collection tank of capacity 14,500 ltr leading to the sewer line and around 20% of the tank was found filled with the trade effluent. It seems that the industry is discharging its trade effluent directly into sewer without any treatment as observed in previous visits two times. Accordingly, the Directions u/s 33- A of the Water Act, 1974 was issued to the PSPCL Authorities for disconnecting the electric connection of the industry vide Board letter no. 294-95 dated 17.01.2023 and this office was directed to calculate the amount of EC to be imposed for degrading the environment. Now, the industry has applied for varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 through OCMMS under Green category by closing its polluting process. The industry has deposited Rs. 31000/- vide UTR no. AXIC230529906143 dated 21.02.2023 under Water Act 1974 and Rs. 31000/- vide UTR no. AXIC230529911921 dated 21.02.2023 under the Air Act, 1981 which is adequate upto 31.03.2029 against gross value of fixed assets Rs. 35,07,128/- and plant & machinery Rs. 14,41,082/- as on 31.03.2022. To verify the facts, the industry was visited by the officer of this office on 28.02.2023 and it was observed as under :- 1.   The industry was not in operation during visit and electric connection of the industry has been found disconnected vide TDCO no. 298 dated 20.01.2023. 2.   The industry has installed power press machines of various capacities. 3.   The industry has also installed one zinc plating plant and Hot Dip Galvanizing process which were not in operation during visit and lying in dismantled conditions. In this regard, the industry has given letter in this office and has requested to seal the polluting section.   4.   No trade effluent is generated by the industry and domestic effluent discharged into sewer. 5.   The industry has provided one D.G. set of 125 KVA with canopy and adequate stack height.   In view of above, it is recommended that :- 1.   Consent to Operate under the Water Act, 1974 and Air Act, 1981 may be granted to the industry for six months. 2.   Electric connection of the industry may be restored temporary for six months. 3.   Environmental compensation of Rs. 13,10,000/- may be imposed on the industry for previous violation after verification from EC committee (EC calculations attached). 4.   The polluting machinery i.e. Zinc Plating section and hot dip galvanizing section be sealed.     CC:-Hon’ble Chairman of the Board. <span style="font-size: 12.0pt; line-height: 107%; font-family: 'Bookman Old Style',serif; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi; mso-ansi-language: EN-IN; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;">
