File Note: <p style="text-align: justify;"><span lang="EN-US">It is intimated that the industry is a small-scale unit, which was granted consent to operate under the Water Act, 1974 vide no. CTOW/Fresh/FGS/2017/6682235 dated 22/12/2017 and under the Air Act, 1981 vide no. CTOA/Fresh/FGS/2017/6682237 dated 22/12/2017 both valid upto 30/9/2022 for manufacturing of Desi Ghee @ 2.89 MTD and Skimmed Milk Powder 3.4 MTD with suitable conditions mentioned therein.</span></p> <p style="text-align: justify;"><span lang="EN-US">It is further intimated that earlier the industry was served notice to issue directions u/s 33-A of the Water Act, 1974 and u/s 31-A of the Air Act, 1981 and notice for the imposition of EC have been issued to the industry with an opportunity of personal hearing before the Chairman on 19/1/2023. After hearing, it was decided as under:</span></p> <p style="text-align: justify;"><span lang="EN-US">1)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The bank guarantee bearing no. 01311ILG000122 dated 20/10/2022, valid upto 19/10/2023 amounting to R. 2.0 Lakhs submitted by the industry be encahsed in addition to the Environmental Compensation amounting to Rs. 50,000/- be imposed upon the industry and got deposited within a week. </span></p> <p style="text-align: justify;"><span lang="EN-US">2)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry shall apply for consent to operate under the Water Act, 1974 and the Air Act, 1981 alongwith requisite documents and fee within 7-days.</span></p> <p style="text-align: justify;"><span lang="EN-US">3)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry is advised to operate the ETP regularly and efficiently and utilize the entire treated effluent onto land for plantation in scientific manner, so as to avoid any stagnation in the plantation area. </span></p> <p style="text-align: justify;"><span lang="EN-US">4)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; It was made clear that the industry, if the industry fails to comply with the provisions of the Water Act, 1974 and the Air Act, 1981 and Environmental Law in future, punitive action will be taken against the industry, which may include the closure of the unit. </span></p> <p style="text-align: justify;"><span lang="EN-US">5)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Environmental Engineer, Regional Office, Fatehgarh Sahib shall visit the industry after one week, to verify the submission made during the hearing and process the consent applications of the industry on merits. </span></p> <p style="text-align: justify;"><span lang="EN-US">The proceedings of the personal hearing were also conveyed to the industry vide Board's </span><span lang="EN-US">letter no. 361-62 dated 30/01/2023 for making compliance.&nbsp;</span></p> <p style="text-align: justify;"><span lang="EN-US">The industry was applied for obtaining varied CTO under the Water Act, 1974 and the &nbsp;Air Act, 1981 which was returned at the scrutiny level being incomplete.</span></p> <p style="text-align: justify;"><span lang="EN-US">Now, the industry has again applied for obtaining varied CTO under the Water Act, 1974 and the Air Act, 1981 for manufacturing of </span><a name="_Hlk128768402"></a><span lang="EN-US">Desi Ghee @ 0.5 MTD and Skimmed Milk Powder 0.6 MTD, Fermented Milk Products @ 0.47 MTD and Polypack Milk @ 4.7 MTD by using Raw Milk @ 40 MTD as raw material and for discharge of trade effluent @ 43 KLD &ndash; Discharged onto land for plantation (1.5 Acres) and domestic effluent @ 4 KLD &ndash; Discharged onto land for plantation after septic tank </span><span lang="EN-US">with requisite documents.</span></p> <p style="text-align: justify;"><span lang="EN-US">The industry has also deposited Rs. 41300/- vide NEFT/ UTR no. 000701996645 dated 31/10/2022 as water consent fee and Rs. 60000/- vide UTR no. SBIN322321743677 dated 17/11/2022 as air consent fee against the total fixed assets of the industry as per CA certificate Rs. 631.21 Lakhs as on 15/1/2023 as per CA certificate dated 30/1/2023. As per the record file of this office, the industry has earlier submitted CA certificate of Rs. 481 Lakhs as on 15/10/2017 and now the CA certificate of Rs. 631 Lakhs as on 15/1/2023. As such, there is an increase in the fixed assets of Rs. 1.52 Crores. &nbsp;Therefore, the consent fee deposited by the industry is </span><span lang="EN-US">adequate upto 30/9/2024 under the Water Act, 1974 and upto 31/3/2025</span><span lang="EN-US"> under the Air Act, 1981 after deducting the penalty and NOC Regulation of fee of Rs. 8400/-.</span></p> <p style="text-align: justify;"><span lang="EN-US">The industry has also submitted effluent sampling report of the wastewater from outlet of ETP carried out by M/s Evapo Tech Technical Service &amp; consultants (NABL Lab) on 23/9/2022. As per the report, all parameters are within permissible limits prescribed by the Board. The industry has also submitted stack emission sampling report carried out by same lab on 23/9/2022 and the concentration of SPM is 54 mg/Nm3, which is within permissible limits.</span></p> <p style="text-align: justify;"><span lang="EN-US">To verify the compliance made by the industry w.r.t decisions of hearing as well as to check the facts mentioned in the application applied by the industry, the industry was visited by the undersigned on 28/2/2023 and contacted Sh. Sanjeev Arora, CEO was present at the time of visit. During the visit, it was observed as under:</span></p> <p style="text-align: justify;"><span lang="EN-US">1)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry is a milk processing unit and was in operation during visit, as the operation time of the plant. </span></p> <p style="text-align: justify;"><span lang="EN-US">2)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Manufacturing process of the industry is Raw material (milk)- Dump tank- Chilling- Storage Silo- Pasteurization- Packing. </span></p> <p style="text-align: justify;"><span lang="EN-US">3)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry has installed one submersible pump as source of water supply and water meter and the industry has now maintained record regarding the generation of wastewater as well as water consumed water in process.&nbsp; </span></p> <p style="text-align: justify;"><span lang="EN-US">4)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry has installed ETP to treat its trade effluent having components grit chamber, oil and grease trap, equalization tank, aeration tank, settler, sand and activated charcoal filters as major components. </span><span lang="EN-US">The industry will discharge its treated trade effluent onto land for plantation. During the visit, the effluent sample from the final outlet of ETP was collected and sent to Head Office Lab for analysis. </span></p> <p style="text-align: justify;"><span lang="EN-US">5)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry is developing approximately 1.5 acres of land under Karnal Technology, which is adequate in principle.</span></p> <p style="text-align: justify;"><span lang="EN-US">6)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The domestic effluent is being discharged onto land for plantation after septic tank. </span></p> <p style="text-align: justify;"><span lang="EN-US">7)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry has installed thermax boiler of capacity 5.5 Tonne/hr thermax boiler in which rice husk @ 9.6 Tonne/day is being used as fuel. </span></p> <p style="text-align: justify;"><span lang="EN-US">8)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry has installed air pre-heater (APH) followed by trema-cyclone separator as APCD alongwith stack of adequate height. </span></p> <p style="text-align: justify;"><span lang="EN-US">9)&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The industry has installed two D.G. sets of capacities 250KVA equipped with canopy alongwith adequate with stack heights stack.</span></p> <p style="text-align: justify;"><span lang="EN-US">&nbsp;</span></p> <p style="text-align: justify;"><span lang="EN-US">Further, as per decision of the hearing, the industry has deposited environmental compensation of Rs. 50,000/- vide DD no. 441287 dated 13/2/2023. </span></p> <p style="text-align: justify;"><span lang="EN-US">Also, the Branch Manager, PNB, Amritsar vide Regional Office letter no. 286 dated 1/3/2023 was requested to encash the bank deposited by the industry deposited bearing no. 01311ILG000122 dated 20/10/2022 (valid upto 19/10/2023) amounting to R. 2.0 Lakhs. However, the industry approached this office and has deposited Rs. 2.0 Lakhs vide R. no. 84/5513 dated 3/3/2023 instead of encashment of said bank. &nbsp;</span></p> <p style="text-align: justify;"><span lang="EN-US">As per the guidelines issued by Central Ground Water Authority (CGWA), Khanna Block of Ludhiana District falls in the list of notified area. As this industry does not fall in the list of water intensive industries and only require water for cooling and drinking purposes. Moreover, the Board has also clarified vide SEE (HQ-1) Head Office letter no. 7956-97 dated 9/3/2018, the operative part of this letter is as under:</span></p> <p style="text-align: justify;"><span lang="EN-US">It has been decided that the Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the authorities concerned as notified by the Central Ground Water Authority. However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries.</span></p> <p style="text-align: justify;"><span lang="EN-US">Now, the Punjab Govt. has constituted the Punjab Water Regulation and Development Authority (PWRDA) under the Punjab Water Resources (Regulation and Management) Act, 2020, which is mandated to regulate the water resources of the State for ensuring their judicious, equitable and sustainable utilization and management.</span></p> <p style="text-align: justify;"><span lang="EN-US">Further, the Master Plan of Bassi Pathana is yet to be prepared. In this regard, the industry has submitted affidavit. The industry is complying with the decisions of the hearing held on 19/1/2023 as well as provisions of the </span><span lang="EN-US">Water Act, 1974 and u/s 31-A of the Air Act, 1981. </span></p> <p style="text-align: justify;"><span lang="EN-US">In view of facts mentioned above, if approved, ZO may be recommended to grant varied consent to operate applied under the Water Act, 1974 and Air Act, 1981 to the industry upto 30/9/2024 for the manufacturing of </span><span lang="EN-US">Desi Ghee @ 0.5 MTD and Skimmed Milk Powder 0.6 MTD, Fermented Milk Products @ 0.47 MTD and Polypack Milk @ 4.7 MTD by using Raw Milk @ 40 MTD as raw material and for discharge of trade effluent @ 43 KLD &ndash; Discharged onto land for plantation (1.5 Acres) and domestic effluent @ 4 KLD &ndash; Discharged onto land for plantation after septic tank </span><span lang="EN-US">with suitable and special conditions as under:</span></p> <p style="text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US">1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span><!--[endif]--><span lang="EN-US">The industry is advised to obtain necessary clearance for Abstraction of Ground Water from the Punjab Water Regulation and Development Authority (PWRDA). </span></p> <p style="text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US">2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span><!--[endif]--><span lang="EN-US">The industry shall provide environment data board outside the main gate of the industry. </span></p> <p style="text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US">3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span><!--[endif]--><span lang="EN-US">The industry shall provide thick plantation of spreading crown varieties of evergreen trees all along the boundary wall of the industry. </span></p> <p style="text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US">4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span><!--[endif]--><span lang="EN-US">The industry will submit the emission/ effluent analysis reports from Board's Lab/ NABL Lab at once in a year </span></p> <p style="text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US">5.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span><!--[endif]--><span lang="EN-US">The industry shall obtain NOC Expansion of the Board in case future expansion of raw milk handling capacity beyond 40000 litre/day alongwith adequate proposal for the upgradation of existing ETP/APCD and land area for the disposal of treated wastewater.</span></p> <p style="text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US">6.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span><!--[endif]--><span lang="EN-US">The effluent discharged through the authorized outlet shall conform to the standards prescribed by the Board for such discharges onto for plantation/ irrigation.</span></p> <p style="text-align: justify;"><!-- [if !supportLists]--><span lang="EN-US">7.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span><!--[endif]--><span lang="EN-US">The industry shall obtain necessary statutory permissions/ clearances from all other concerned departments. </span></p> <p style="text-align: justify;"><span lang="EN-US">&nbsp;</span></p>
