File Note: <p style="text-align: justify;">The agenda note and report / recommendations of AEE/EE, RO, may kindly be perused.</p> <p style="text-align: justify;">It is submitted that the industry is a small scale red category industry and has been granted Consent to operate under the Water Act, 1974 and Air Act, 1981, both valid upto 30.09.2025.</p> <p style="text-align: justify;">The industry was earlier surprisingly visited by officer of the Board on 14.11.2022 regarding identification of the chemicals used by the industry in its process of acid pickling as the industry has made an agreement with JBR Technologies Ltd. Unit-II, Vill. Mangarh, Machhiwara Road, Kohara, Ludhiana for lifting of its trade effluent @ 5000 ltr/month. The effluent sample was collected from the acid pickling process of the industry and as per the results of analysis report, the industry has been using both HCL and H2SO4&nbsp;in the acid pickling tank. The re-processor i.e. M/s JBR Technologies Ltd. Unit-II, Vill. Mangarh, Machhiwara Road, Kohara, Ludhiana is not designed to treat the spent HCL.</p> <p style="text-align: justify;">Accordingly, the consent to operate under the Water Act, 1974 was revoked vide Board's letter no. 718 dated 14.02.2023 and directions u/s 33- A of the Water Act, 1974 was issued to the PSPCL Authorities for disconnecting the electric connection of the industry vide Board letter no. 722-25 dated 14.02.2023.</p> <p style="text-align: justify;">&nbsp;Now, the industry has applied varied consent to operate under the Water (Prevention &amp; Control of Pollution) Act, 1974 and under the Air (Prevention &amp; Control of Pollution) Act, 1981 through OCMMS. The industry has deposited consent fee, which is adequate upto 01.12.2029 (Water) 01.11.2027 (Air).</p> <p style="text-align: justify;">The industry has applied for varied consent by using both HCL and H2So4 and industry has done agreement with M/s Charanjeet and Company Technology LLP, VPO Paddi, Ludhiana dated 01.06.2021 for the lifting of H2So4 and with M/s JBR Technologies Pvt. Ltd, Ludhiana dated 22.11.2022 for lifting of HCL.</p> <p style="text-align: justify;">To verify the facts, the industry was visited by officer of Regional Office on 23.01.2023&nbsp;and it was observed as under:-</p> <p style="text-align: justify;">1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The industry was in operation during the visit and is engaged in wire drawing.</p> <p style="text-align: justify;">2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The industry has provided 2 no. tanks one for H2So4 and other for HCL and has provided two no. separate water meter for both the processes. The industry was earlier having agreement with M/s JBR Technologies Ltd. Unit-II, vill. Mangarh, Machhiwara Road, Kohara, Ludhiana @ 5000 Ltr/month and with M/s Charanjeet &amp; Co. Technology LLP, VPO Paddi, Ludhiana @ 10,000 Ltr/month.</p> <p style="text-align: justify;">3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Now, the industry has cancelled its agreement with M/s JBR Technologies Ltd. Unit-II, Vill. Mangarh, Machhiwara Road, Kohara, Ludhiana and has entered into agreement with M/s JBR Technologies Pvt. Ltd, CETP, 260-61, Phase-8, Focal Point, Ludhiana @ 10,000Ltr/month dated 22.11.2022 for lifting of HCL. Further, the industry has made agreement with M/s Charanjeet &amp; Co. Technology LLP, VPO Paddi, Ludhiana @ 10,000 Ltr/month dated 01.06.2021 for lifting of H2So4.</p> <p style="text-align: justify;">4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The industry has made separate tanks for pickling of HCL and H2SO4 and separate storage tanks for lifting of HCL and H2S04.</p> <p style="text-align: justify;">5.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The industry has made earlier agreement @ i.e. 15,000 Ltr/month and now made an agreement 10,000 (H2So4 Charanjit &amp; Co) and 10,000 (HCL M/s JBR Technologies Pvt. Ltd, Electroplating CETP) i.e. 20,000 Ltr/month. The industry has informed that the production capacity remains same and there will be no increase in the production capacity.</p> <p style="text-align: justify;">6.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The industry is maintaining the record of total water consumption viz-a-viz effluent lifted in the process for both HCL and H2So4. The industry has continued its old water meter for HCL purpose and the reading for water meter installed for HCL was noted as 219.64 KL. Further, the industry has installed new water meter for H2So4 and reading noted was 4.54 KL and for this the industry has started maintaining its separate record.&nbsp;&nbsp;&nbsp;</p> <p style="text-align: justify;">7.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The industry is discharging only domestic effluent into sewer.</p> <p style="text-align: justify;">8.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The electric connection of the industry has been disconnected vide TDCO no 298 dated 01.03.2023 and the industry has requested for restoration of electric supply.&nbsp;&nbsp;</p> <p style="text-align: justify;">9.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The site of industry falls in approved Focal Point, Ludhiana.</p> <p style="text-align: justify;">In view of the above, it is recommended that&nbsp;</p> <p style="text-align: justify;">&nbsp;</p> <p style="text-align: justify;">1.&nbsp;&nbsp;&nbsp;&nbsp;Directions u/s 33-A of the Water (Prevention &amp; Control of Pollution) Act 1974 may be issued to PSPCL Authorities to restore the electric connection temporarily for six months.</p> <p style="text-align: justify;">2.&nbsp;&nbsp;&nbsp;&nbsp;Bank guarantee of Rs. 25,000/- be imposed to the industry as an assurance to dispose only spent HCl to M/s M/s JBR Technologies Pvt. Ltd, Focal Point, Phase-8, Ludhiana and only spent H2SO4 to M/s Charanjit &amp;&nbsp;&nbsp;Co.</p> <p style="text-align: justify;">3.&nbsp;&nbsp;&nbsp;&nbsp;Consent to operate under the Water Act, 1974 and Air Act, 1981 may be granted to industry for six&nbsp;months with usual conditions and special condition that:-</p> <p style="text-align: justify;">a)&nbsp;&nbsp;&nbsp;&nbsp;The industry will setup in-house testing arrangement to check the presence/ adulteration of HCl in their raw material/ spent acid, within one week and inform the Regional Office with photographs through e-mail about the compliance.</p> <p style="text-align: justify;">b)&nbsp;&nbsp;&nbsp;The industry shall obtain training from the Zonal Lab, Ludhiana for in-house checking of adulteration of the HCL in H2SO4 solution or supply of HCl purely by the dealer in the guise of H2SO4 and obtain literature and certificate of training.</p> <p style="text-align: justify;">c)&nbsp;&nbsp;&nbsp;&nbsp;The industry shall get its spent acid analysed from Board's lab within one month.</p> <p style="text-align: justify;">Competency :</p> <p style="text-align: justify;">Consent : SEE, ZO-2, Ludhiana</p> <p style="text-align: justify;">Directions : Hon'ble Chairman of the Board</p> <p>&nbsp;</p>
