<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">The industry has not submitted building plan approved under the Factories Act 1948 which is a pre-requisite for grant of CTO as per PSSTE notification dated 02.03.2022. However, the industry has submitted its ‘Certificate of In Principle Approval’ issued on 19.06.2021, which is valid upto 18.12.2024, wherein in principle approval for factory building plan is included.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">Also, the industry was earlier granted ‘Consent to Establish’ subject to one of the additional condition that:</span></p>
<p class="MsoNormal" style="text-align: justify;"><em style="mso-bidi-font-style: normal;"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">“This NOC/CTE is being granted provisionally assuming the industry to be falling under orange category, however, in case, later on the industry is decided to be falling under red category of industries, the industry will have to obtain NOC afresh under red category & comply with the rules / regulations applicable to red category units and this NOC/CTE shall be accordingly considered revoked.”</span></em></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">However, the Board has not yet issued any specific categorisation for such units and the unit has still filed application under Orange Category with cat code 2999-Misc.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 107%; font-family: 'Tahoma',sans-serif;">In consideration of the above and the recommendations sent by RO; if approved, the Consent to Operate under the Water Act, 1974 and the Air Act, 1981 be granted to the industry upto 30.09.2024, subject to suitable general & additional conditions with one of the specific additional condition that “<em style="mso-bidi-font-style: normal;">This CTO is being granted provisionally assuming the industry to be falling under orange category, however, in case, later on the industry is decided to be falling under red category of industries, the industry will have to obtain CTO afresh under red category & comply with the rules / regulations applicable to red category units as well as deposit differential/ balance CTO/CTE fees and this CTO shall be accordingly considered revoked.”</em>”</span></p> |
