It is submitted that the industry is a small scale red category industry and has been granted CTO under the Water (Prevention & Control of Pollution) Act ,1974 vide CTOW/Renewal/LDH4/2018/8589998 dated 22.11.2018 valid upto 30.06.2022 and has been granted CTO under the Air Act ,1981 vide CTOA/Renewal/LDH4/2018/8589851 dated 22.11.2018 valid upto 30.06.22  . Now, the industry has applied for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air Act ,1981  through OCMMS. The industry has deposited consent fee of amounting to Rs 4350/- under vide UTR. no. 5171465 dated 17.02.2023 under the Water Act, 1974 including  Rs. 1100/-  as the NOC regularization fees,  and Rs 2750 vide UTR no 644909757 dated 17.02.23  which is adequate upto 30.03.24 after deducting penalty fees   against gross value of fixed assets Rs. 13.03 lacs  and plant & machinery Rs. 11.2 lacs /- as on 19.12.2022. To verify the facts, the industry was visited by undersigned on  7.3.23  and it was observed as under:-  (1) The industry is a small scale unit and engaged in manufacturing of spring with electroplating process. (2) The manufacturing process of the industry is: Raw Material (Wire) Machining Electroplating (If Reqd.) Packing To Market. (3) The industry has made an agreement with M/S J.B.R. Technologies Pvt. Ltd., Ludhiana for lifting of trade effluent @ 1000 Lts/Month. (4) The industry has provided storage  tank of capacity 1000 Lts. to store the trade effluent and during visit around  @ 500 ltrs  was lying stored . (5) . The industry has provided water meter for process area  and reading of the water meter observed during the visit was 74.17 KL . (6) .The industry is maintaining the record of total water consumption viz a viz effluent lifted .As per record maintained by the industry ,the reading on 1.11.22 was 69.57 KL and total water consumption from period 1.11.22 to till date is 4.6 KL and the industry has lifted out 4 KL  Nov 22 @ 1000 Lts/Month, Dec 22 @ 1000 Lts/Month, Jan 23@ 1000 Lts/Month,Feb 23 @ 1000 Lts/Month.       (7) The industry has installed a D.G. set of 5 KVA which was lying sealed (earlier sealed by the Board on 16.01.2016). (8) The domestic effluent is discharged into sewer. 8  Further  In light of Board's Office Order No. 21 Dated 08.06.2018, competent authority may grant consent to existing industrial units for 15 years from the date of notification of the master plan. The relevant extract of the above said office order is reproduced as under:- " the existing industrial units/other establishment, which were established before the notification of the master plan of the respective citifies shall be allowed consents/extension under the provisions of Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 and authorization under the provisions of Hazardous waste Management Rules, 2016 for a period of 15 years from the date of the notification of master plan after taking the concrete documentary proof regarding the date of commissioning of such units. No Separate approval from local bodies/other authorities is required to be obtained.  Keeping in view of above , it is recommended that:- 1) Renewal of  Consent to operate under Water Act, 1974 and Air Act, 1981 may be granted upto  31.08.23  with suitable condition and with special condition that 1 .        The industry shall shift its unit to the designated industrial area as per the provisions laid down under the notified Master Plan of Ludhiana or when asked by the Government/ Punjab Pollution Control Board.
