Compliance of siting criteria of poultry farm is attached herewith as Annexure-B.</span></p> <p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: .5in; line-height: 150%;"><span style="font-size: 12.0pt; mso-bidi-font-size: 10.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">It is pertinent to mentioned here that as explained in Annexure-B the poultry farm is not complying with the siting criteria as per Para No. 1 (</span><span style="font-size: 14.0pt; mso-bidi-font-size: 10.0pt; line-height: 150%; font-family: 'GurmukhiLys 020'; mso-bidi-font-family: Tahoma;">J</span><span style="font-size: 12.0pt; mso-bidi-font-size: 10.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">), 5 &amp; 8. However, as per report of DTP, Gurdaspur the site is suitable for the establishment of poultry farm.</span></p> <p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: .5in; line-height: 150%;"><span style="font-size: 12.0pt; mso-bidi-font-size: 10.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">As above in light of my agenda note dated 04/03/2023, it is therefore again recommended as under:-</span></p> <p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: .5in; line-height: 150%;"><span style="font-size: 12.0pt; mso-bidi-font-size: 10.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">Legal Opinion from Senior Law Officer, Patiala may be obtained for deciding the consent application of the poultry farm in question on below mention grounds as the report of DTP, Gurdaspur, conforms the suitability of site for the establishment of poultry farm:-</span></p> <p class="MsoListParagraphCxSpFirst" style="margin-left: .25in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; mso-bidi-font-size: 14.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">a.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 12.0pt; mso-bidi-font-size: 14.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The poultry farm in question i.e. M/s AOV Perfect Foods LLP, Village-Panj Graian, Tehsil-Batala, Distt-Gurdaspur is located at less than 500 meters from boundary of nearest poultry farm i.e. M/s Perfect Poultry Products BWI LLP, Village-Panj Graian, Tehsil-Batala, Distt-Gurdaspur.</span></p> <p class="MsoListParagraphCxSpMiddle" style="margin-left: .25in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; mso-bidi-font-size: 14.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">b.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-size: 12.0pt; mso-bidi-font-size: 14.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">Boundary wall of Poultry farm is located on the edge of Village Pagdandi, however, shed of the farm is located more than 10 mts from village pagdandi.</span></p> <p class="MsoListParagraphCxSpMiddle" style="margin-left: .25in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 14.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-ansi-language: EN-US;"><span style="mso-list: Ignore;">c.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-size: 12.0pt; mso-bidi-font-size: 14.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-ansi-language: EN-US;">There are 20 Pucca Houses (Cluster) are located at a distance of 200 mts from the site of poultry farm and ownership lies with Department of Rural Development and Panchayat as reported by Tehsildar, Batala.</span></p> <p class="MsoListParagraphCxSpLast" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify;"><strong style="mso-bidi-font-weight: normal;"><span lang="EN-IN" style="font-size: 14.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">&nbsp;</span></strong></p> <p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: .5in; line-height: 150%;"><span style="font-size: 12.0pt; mso-bidi-font-size: 10.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">It is pertinent to mention here that the proceedings of the personal hearing dated 13.02.2023 before the Chief Environmental Engineer (J) are awaited.</span></p>
