<p class="MsoBodyText2" style="margin-bottom: 6.0pt; text-align: justify; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">It is submitted that the industry is large scale orange category telecom unit. The company has made telephone exchange on the Plot No. HB-1A, Phase-6, Focal Point, Ludhiana for telephonic service. </span></p>
<p class="MsoBodyText2" style="margin-bottom: 6.0pt; text-align: justify; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">Now, the company has applied fresh consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 through OCMMS on 17.02.2023 for operation of DG sets installed in its premises of the unit. The company has submitted copy of installation report of DG set of capacity 500 KVA dated 11.09.2018 only, as proof of date of commissioning of the industry. </span></p>
<p class="MsoBodyText2" style="margin-bottom: 6.0pt; text-align: justify; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The company has submitted copy of lease deed dated 27.03.2008 mentioning that the proposed site measuring 2300 sq. yard falls under Industrial Focal Point, Ludhiana for 99 years on lease. The industry is located in Phase-6, Focal Point, Ludhiana and the site is suitable for establishment of such units. </span></p>
<p class="MsoBodyText2" style="margin-bottom: 6.0pt; text-align: justify; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The company cannot be considered under WHITE CATEGORY i.e. Sr. No. 128- Type Code-4128 (Telecommunication equipment without wet process) as per new categorization of industries circulated by the Board due to following reasons:-</span></p>

<p class="MsoBodyText2" style="margin-bottom: 6.0pt; text-align: justify; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">Further, the industry is covered under ORANGE CATEGORY i.e. 2025-</span><span style="font-size: 11.0pt; line-height: 115%; font-family: 'Calibri','sans-serif'; mso-bidi-font-family: Raavi;"> </span><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">DG set of capacity >1MVA but < 5MVA as per new categorization of industries circulated by the Board.</span></p>
<p class="MsoBodyText2" style="margin-bottom: 6.0pt; text-align: justify; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">It is pertinent to mention here that the company has already obtained authorization under the Hazardous & Other Waste (Management and Trans-boundary Movement) Rules, 2016 for collection, generation, storage and disposal vide no. HWM/Fresh/LDH4/2018/8016505 dated 14/09/2018 for category-5.1 (Used or spent oil) @ 0.3 KLA with certain conditions and special conditions that the industry will get its hazardous waste category 5.1 (waste oil) regularly lifted through authorized re-processor/recycler approved by the Central Pollution Control Board or Punjab Pollution Control Board only, , which has expired on 13/09/2019. As such, the application cannot be considered under VDS scheme of the Board.</span></p>
<p class="MsoBodyText2" style="margin-bottom: 6.0pt; text-align: justify; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The company has deposited consent fee of Rs. 84,000/- (Rs. 57,600/- under the Air Act, 1981 and Rs. 26,400/- penalty fee) vide R.No. N052201070914346 dated 21.02.2020, Rs. 84,000/- vide R.No. N109221923119104 dated 19.04.2022, Rs. 2,94,000/- vide R.No. CBINR52022110810000957 dated 08/11/2022 under the Air Act, 1981 against gross value of fixed assets Rs. 3480.00 Lacs and plant & machinery Rs. 3204.00 Lacs as on 31.03.2022, which is not adequate. </span></p>
<p class="MsoBodyText2" style="margin-bottom: 6.0pt; text-align: justify; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The company is being repeatedly asked to submit the fee from the date of commissioning however, the company has failed to submit the requisite fee till date. </span></p>
<p class="MsoBodyText2" style="text-align: justify; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">From above, it is evident that the company is operating its unit without 'Consent to operate' of the Board under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981. </span></p>
<p class="MsoBodyText2" style="text-align: justify; line-height: 115%;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';"> </span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">Keeping in view of above, it is recommended as under:</span></p>

<li class="MsoNormal" style="text-align: justify; mso-list: l0 level1 lfo2;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">The company may be directed to submit the fee from date of commissioning/ date of leasing the plot from year 2008 to next five years viz a viz its C.A. certificate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. </span></li>
<li class="MsoNormal" style="text-align: justify; mso-list: l0 level1 lfo2;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">The company may be issued show cause notice under the Hazardous & Other Waste (Management and Trans-boundary Movement) Rules, 2016.</span></li>
