The RMC plant was established in the non-designated area after the finalization of Master Plan of Ludhiana and has been established without NOC/ consents of the Board, as such, directions were issued for disconnection of the electric connection of RMC plant.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->&middot;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The RMC has now applied for consents to operate under Water Act, 1974 and Air Act, 1981 and submitted consent fee which is adequate upto 28.02.2024 under both Acts.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->&middot;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The project proponent has submitted a letter issued by District Town Planner, Ludhiana mentioning that the site of the industry falls under commercial zone (Wholesale Fruit and Vegetable and Grain Market, timber market, ware house, cold storage, oil depot).</p> <p style="text-align: justify;"><!-- [if !supportLists]-->&middot;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->It has also submitted a letter issued by Assistant Town Planner, Zone-C, Municipal Corporation, Ludhiana mentioning that the said site falls under the jurisdiction of District Mandi Officer, Ludhiana. He further mentioned that if Mandi Board has not any objection regarding establishment of said RMC plant than the MCL has also not any objection regarding the same.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->&middot;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->It is further intimated the Project Proponent has submitted a letter issued by the MCL Authorities to the District Mandi Officer, Ludhiana vide no. 884/EE/C dated 10.02.2022 to allow the said RMC plant at Grain Market&rsquo;s land for smooth work of the said project. The said RMC plant has been installed for concrete paving of Gill Road. As the project is important for public interest.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->&middot;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The Project Proponent has also submitted an agreement made with Market Committee, Ludhiana for installation of said RMC Plant.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->&middot;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <!--[endif]-->The RMC plant was visited lastly by officers of RO on 09.03.2023 and it was observed as under:-</p> <p style="text-align: justify;"><!-- [if !supportLists]-->1.&nbsp;&nbsp;&nbsp; <!--[endif]-->The RMC plant was not in operation. The electric connection of the plant has already been disconnected vide PSPCL&rsquo;s TDCO no. 081/82667 dated 17.10.2022.&nbsp;&nbsp;Raw material like aggregates/sand was also not available at the site. During visit, only watchman was available at the site.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->2.&nbsp;&nbsp;&nbsp; <!--[endif]-->The project proponent has provided a D.G set of capacity 82.5 KVA equipped with canopy for operation of RMC plant.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->3.&nbsp;&nbsp;&nbsp; <!--[endif]-->The project proponent has provided metal sheets as fencing around the premises having height of about 5-6 ft. to control dust emissions generated from vehicular movement.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->4.&nbsp;&nbsp;&nbsp; <!--[endif]-->The RMC plant has provided fully covered room for storage of cement. The project proponent has provided an automatic mechanical arrangement for feeding of the cement in the mixing machine directly from the storage area to avoid any dust emissions in the area in a closed manner.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->5.&nbsp;&nbsp;&nbsp; <!--[endif]-->There is a commercial area adjacent at the backside of the plant. The residential houses are also there at a distance of 70-75 meters on the other side of the road i.e. at front side of the plant. Further, there is a Grain Market on one side of the plant i.e. on right hand side and some slums/quarters are there on the other side of the plant i.e. along the Dhuri Railway Line i.e. on left hand side. It is pertinent to mention here that currently the RMC plant is not in operation. Hence, its effect onto surrounding areas cannot be determined. However, the project proponent was asked to make best efforts to control dust emissions.&nbsp;</p> <p style="text-align: justify;"><!-- [if !supportLists]-->6.&nbsp;&nbsp;&nbsp; <!--[endif]-->The project proponent has also intimated Regional office vide his letter that the said allotted work to be finished within 06 months.</p> <p style="text-align: justify;">It is submitted that similar nature application M/s G.R. Infraprojects Limited (RMC), Khasra No. 37/4, Village Rajjowal, Ludhiana, Rajjowal, Ludhiana sent for legal opinion from SLO as under:- "The matter was considered by the Competent Authority of the Board and it has been decided that the case be forwarded to SLO HO, Patiala for his legal opinion with regard to decision to decide the CTE application in lieu of the prevailing policy of the Board for the establishment of the such industries viz-a-viz the temporary establishment for a shorter period for establishment in a non-complying zone for completion of project by NHAI."</p> <p style="text-align: justify;">In this case, the area of RMC plant is in non-designated area and the site of Dana Mandi falls under Punjab Mandi Board, which has no objection for establishment of RMC plant.</p> <p style="text-align: justify;">In view of the above, it is recommended that the following action be taken after taking legal opinion:-</p> <p style="text-align: justify;"><!-- [if !supportLists]-->1.&nbsp;&nbsp;&nbsp; <!--[endif]-->Directions u/s 31-A of Air (Prevention &amp; Control of Pollution) Act, 1981 and u/s 33-A of Water (Prevention &amp; Control of Pollution) Act, 1974 may be issued for temporarily restoration of Electric connection i.e. for six months only.&nbsp;&nbsp;</p> <p style="text-align: justify;"><!-- [if !supportLists]-->2.&nbsp;&nbsp;&nbsp; <!--[endif]-->&lsquo;Consent to Operate&rsquo; under Air (Prevention &amp; Control of Pollution) Act, 1981 and Water (Prevention &amp; Control of Pollution) Act, 1974 be granted to the project proponent for shorter period i.e. for six months subjected to suitable conditions and special conditions as under:-</p> <p style="text-align: justify;"><!-- [if !supportLists]-->a.&nbsp;&nbsp;&nbsp; <!--[endif]-->The project proponent shall make best efforts to control dust emissions in the vicinity.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->b.&nbsp;&nbsp;&nbsp; <!--[endif]-->The project proponent shall provide water sprinkling facility to control dust emissions.</p> <p style="text-align: justify;"><!-- [if !supportLists]-->c.&nbsp;&nbsp;&nbsp; <!--[endif]-->The project proponent&nbsp;is liable to complete the allotted work in said period. No further extension in the &lsquo;Consent to Operate&rsquo; shall be granted to the project proponent.</p> <p style="text-align: justify;">Competency :</p> <p style="text-align: justify;">Consents : EE (RO)</p> <p style="text-align: justify;">Directions : Hon'ble Chairman of the Board</p>
