<p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; text-indent: -0.25in; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">B)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Now, the industry has applied for obtaining varied consent to operate under Air (Prevention & Control of Pollution) Act, 1981 through OCMMS mode for change of fuel from Pet Coke to Sugar Cane Straw & Wood Chips as a fuel. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; text-indent: -0.25in; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">C)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry has already deposited Rs. 1,26,000/- vide UTR No. N067211431653048 dated 08/03/2021 as consent to operate under Air (Prevention & Control of Pollution) Act, 1981 fee, which is adequate upto 31/03/2027.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; text-indent: -0.25in; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">D)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry was visited by the officer of the Board on 07/10/2022 and observed and the industry was in operation during visit. The industry has installed one no. boiler of capacity 8 TPH. During visit, pet coke was being used as fuel. APH cyclone & wet scrubber is installed as APCD, however scrubbing tanks were completely empty i.e. no scrubbing liquor was present for scrubbing operation. As such scrubbers were not being used. SO2 meter was not working. The industry was not following the code of practice prescribed for use of pet coke as fuel.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; text-indent: -0.25in; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">E)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Thereafter, SCN for revocation of consent to operate granted Air (Prevention &. Control of Pollution) Act, 1981 was issued to the industry along with opportunity of personal hearing before the CEE, Jalandhar on 31/10/2022, wherein following decisions were taken:-</span></p>
<p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -0.25in; line-height: 24px; margin: 0in 0in 0.0001pt 0.75in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry shall not restart the unit without taking all corrective measures to comply with Environmental norms.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -0.25in; line-height: 24px; margin: 0in 0in 0.0001pt 0.75in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The Regional Office, Batala shall confirm non-operational period of industry considering electric consumption and calculate Environmental Compensation to be imposed to the industry for the period of violations made.</span></p>
<p class="MsoListParagraphCxSpLast" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; text-indent: -0.25in; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">F)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Thereafter, the area was visited by SEE, ZO, ASR; EE, RO, Batala and AEE of this office on 22/02/2023. During the visit, the industry was found emitting black smoke continuously. The team stayed in the area for about one hour. The industry remained continuously emitting black smoke. It is evident that the APCD was not in operation as also observed during the previous visit carried out on 07/10/2022. </span></p>
<p class="MsoNormal" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; text-indent: 0.5in; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">Thereafter, the industry was visited by the undersigned on 28/02/2023 and observed as under:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -0.25in; line-height: 24px; margin: 0in 0in 0.0001pt 0.75in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry was in operation during visit.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -0.25in; line-height: 24px; margin: 0in 0in 0.0001pt 0.75in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">During visit, it was found that the industry had stored sugarcane waste bales in the premises to be used as fuel.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -0.25in; line-height: 24px; margin: 0in 0in 0.0001pt 0.75in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The stock stored at site caught fire on the preceding day and the fire was still going on at the time of visit.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -0.25in; line-height: 24px; margin: 0in 0in 0.0001pt 0.75in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The entire area was engulfed in white smoke.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -0.25in; line-height: 24px; margin: 0in 0in 0.0001pt 0.75in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">As per the representative, about 1000 tons of sugarcane waste bales were acquired to be used as fuel. As per the field condition, it was apparent that more than 80% of stock had been burnt in fire accident.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -0.25in; line-height: 24px; margin: 0in 0in 0.0001pt 0.75in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The industry has not obtained CTO under Air (Prevention & Control of Pollution) Act, 1981 for use of sugarcane waste as fuel.</span></p>
<p class="MsoListParagraphCxSpLast" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; text-indent: -0.5in; line-height: 24px; margin: 0in 0in 0.0001pt 0.75in;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">G)<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">The matter has been moved through enoting no. <a href="../../enotification/popPreviousEnoting/20689942"><span style="color: windowtext; text-decoration-line: none;">20689942</span></a>.</span></p>
<p class="MsoNormal" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; text-indent: 0.5in; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">It is clear from the above, that the industry is a habitual violator and is not serious towards Environment Protection Norms.</span></p>
<p class="MsoNormal" style="color: #5d5d5d; font-family: Verdana, Arial, Helvetica, sans-serif; text-align: justify; background-color: #ffffff; margin-bottom: 0.0001pt; text-indent: 0.5in; line-height: 24px;"><span lang="EN-US" style="font-family: 'Bookman Old Style', 'serif';">In view of the above, RO has recommended that varied consent to operate under Air (Prevention & Control of Pollution) Act, 1981 may be refused and action already recommended through enoting no. <a href="../../enotification/popPreviousEnoting/20689942"><span style="color: windowtext; text-decoration-line: none;">20689942</span></a> may be taken please. May if approved show cause notice be issued for refusal of the v</span><span style="font-family: 'Bookman Old Style', 'serif';">aried consent to operate under Air (Prevention & Control of Pollution) Act, 1981</span><span style="font-family: 'Bookman Old Style', 'serif';"> for 07 days.</span></p> |
