RECOMMENDATIONS: It is submitted that the industry was granted 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/FGS/2018/7871566dated 16/07/2018 valid upto 30/09/2022 and The Air (Prevention & Control of Pollution) ACT, 1981 vide no. CTOA/renewal/FGS/2019/10776148 dated04/09/2019       valid    upto 30/09/2022 for manufacturing of Steel Ingots 72 MTD with suitable conditions. Now, the industry has applied for obtaining renewal 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of steel Ingots @ 72.0 MTD with requisite documents through OCMMS.            As per the record file, the previous consent fee deposited by the industry was adequate upto 30/06/2023. The industry has deposited consent fee of Rs. 54000/- each vide receipt no. 136475943 & 840753992 dated 04.10.2022 and Rs.36000/- each vide Receipt No.219945837 & 841366504 dated 24/01/2023 under the Water Act, 1974 and the Air Act, 1981 against the un-depreciated of fixed assets of Rs. 628.92 Lacs as on 31/07/2022 as per CA Certificate dated 02/09/2022 which is adequate upto 30/09/2028 under both the acts, separately after deducting penalty charges 25%. There is an increase in the cost of fixed assets of about Rs. 3.6 Cr from previous C.A. certificate. The through clarification has submitted the details of increase in the cost of plant and machinery which is mainly attributed towards upgradation of APCD, Crane, machinery part etc.. The industry has submitted that with such  addition there will be neither increase in the production capacity nor pollution load of the unit. The industry has further submitted that the new land has been purchased for future expansion in the name of the firm and no machinery has been installed on it. The copy of undertaking is attached. The industry has deposited Rs.10800/- vide Receipt No.841366504 dated 24/01/2023 as NOC regularization fee, which is adequate. The industry has got its stack emission samples analyzed by Board’s lab on 11/05/2022 and as per analysis report, the concentration of SPM was found to be 72 mg/Nm3, which is within permissible limits as prescribed by the Board.                    To verify the contents of the application the industry was visited by AEE of this office on 02/03/2023 and contacted Sh. Sourav Jain, representative of the industry at site. During visit, it was observed as under: 1.        The industry was in operation. 2.        The industry has already provided dust collector followed by Bag filters as APCD which was in operation. 3.        The industry has installed 1 no. new D.G set of capacity 125 KVA, which is equipped with canopy. 4.        The industry is maintaining record of SOPs framed for operation and maintenance of APCD. 5.        The industry has provided interlocking tiles on front side of the unit and was advised to provide complete pavement of roads wherever vehicle movement has to take place for suppression of dust. 6.        The industry has provided cooling towers for cooling of water which comes into contact with the furnace. The entire cooling water is being recycled. 7.        No water is used in the process, so no trade effluent is generated. 8.        The industry has provided septic tank for treatment of domestic effluent.                    The Board vide letter no. 1955-57 dated 18/01/2023 has informed that department of Water Resources (RD and GR), Central Ground Water Authority, Ministry of Jal Shakti Govt. of India, New Delhi under Section 5 of the Environment (Protection) Act, 1986 has issued directions vide order dated 6/4/2022 that “It shall be mandatory for the project proponent abstracting ground water to obtain No objection Certificate from Central Ground Water Authority or the concerned State/UT Ground Water Authority as the case may be in the compliance conditions in consent to operate and consent to establish issued by the State pollution control Board” The Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under: The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries                    In view of above mentioned facts, if approved, it is recommended that renewal of 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 for production of Steel Ingots @ 72 MTD, may be granted to the industry upto 30/09/2027 with suitable conditions and following special conditions: 1.        The industry shall comply with the guidelines/SOPs provided by PSCST, Chandigarh in the effective operation of APCD. 2.        The industry shall comply with PWRDA guidelines. 3.        The industry shall not generate and discharge any kind of trade effluent. 4.        The industry shall bound to install adequate and appropriate pollution control device/system as per the design of reputed institute for control of secondary emissions generated from furnace unit. 5.        The industry shall provide complete pavement of roads within the premises within one month and submit compliance. 6.        The industry shall keep a qualified person to handle the operation and maintenance of the APCD. 7.        The industry shall comply with the EIA notification dated 14/09/2006 w.r.t. item no. 3a and keeping the production capacity less than 30,000 TPA. <span lang="EN-US" style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma',sans-serif; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;">
