<p>It is submitted that the industry is an existing rice sheller unit operating in an area of 12 kanals 09 marlas, bearing khasra no. 119//3/2(1-3), 7/1(5-11), 8/1/1(4-14), 9/1(0-10), 8/1/2/2(0-11) in revenue estate of Village Rania, Tehsil Nihal Singh Wala, District Moga.</p>
<p>Earlier, the rice sheller was granted varied consent to operate under the Water Act, 1974 & the Air Act, 1981 for operation of unit to produce raw rice with dryer @ 2 TPH and sorted rice @ 2 TPH valid upto 30.09.2026.</p>
<p>Now, the rice sheller has applied for consent to establish (NOC - expansion) under the Water Act, 1974 & the Air Act, 1981 and has proposed to increase the land area by adding 3 kanals 11 marlas bearing khasra no. 119//12/2min(0-14), 13/1min(2-17) to the existing area of 12 kanal 9 marlas.</p>
<p><em>As per the office order dated 15.10.2013 new rice sheller can be established in </em></p>
<p><em>A(i) In Focal Point and in designated industrial Land use Zones</em></p>
<p><em>OR</em></p>
<p><em>A(ii) In rural zone of Master Plan (Statutory / Non-Statutqry), rural zone of Local Planning Area and in the agriculture land outside the rural zone of Master Plan and Local Planning Area (but shall be at a distance of 500 metres from urbanisable limits of Master Plan and 1.5 kms. from Local Body limits where the master plan are yet to be prepared.</em></p>
<p><em>A(iii) 500 metres away from bye-pass, Natipnal Highway, State Highway and Scheduled Road.</em></p>
<p><em>(Point No. (i) to (iii) to be certified by D.T.P)</em></p>
<p><em>A(iv) 500 metres away from the village Lal Dora / Phirni, Wild Life Sanctuary, Zoo, residential area*, educational institution, historical, religious places and protected monuments.</em></p>
<p><em>*The residentia/ area means the area under a scheme notified by Punjab (Urban Planning & Development Authority (PUDA), Municipa/ Corporation, Municipal Council, Improvement Trust or any other authority / agency in the State.</em></p>
<p><em>(Point No. A(iv) to be certified by Revenue Authority)</em></p>
<p><em>Also, All Rice mills/ Saila Plants located outside the Municipal limits of towns and Cities and in the designated areas within the cities established with NOC of Punjab Pollution Control Board will be allowed to expand / modernize within their existing premises if pollution load of existing unit has been effectively taken care of by the industry and no specific approval of District Town Planner Mill be required."</em></p>
<p>The land area to be added does not meet with siting guidelines for establishent of new rice sheller as it is located at 520 m from ULB and the minimum distance required is 1.5 kms.</p>
<p>However, PP has submitted that the land will be used for storage only.</p>
<p> Also, District Town Planner, Moga vide its letter no. 28-29 dated 10.01.2023 has intimated that the applicant has no proposal to install any machinery in additional land area of 3 kanal 11 marlas and the land will be used by the industry for storage purposes only. Their department has no objection for the storage activities.</p>
<p>The guidelines are not clear w.r.t. above issue in specific where expansion of land (not meeting with siting guidelines) is to be done for storage only in existing rice sheller. </p>
<p>If approved, legal opinion from SLO of the Board may be taken in the matter so as to enable RO to decide the application as relevant order dated 15.10.2013 is silent about such cases wherein the existing rice sheller established with permission of the Board proposes to expand its land area, with additional land proposed to be utilized exclusively for storage purpose but not fulfilling applicable siting guidelines as mentioned in order dated 15.10.2013, pl.</p>
