CTOW/Renewal/RPN/2020/13974277 dated 21/10/2020 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/RPN/2020/13974024 dated 21/10/2020, both were valid upto 30/09/2022 for operation of screening & washing of aggregates only @ 4,000 CFT/Day subject to the suitable conditions mentioned therein in the name of Sh. Gurmukh Singh, Partner.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">Thereafter, the Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act 1981 was revoked/cancelled vide no. 934 dated 26.04.2022 due to the non-submission of the mining certificate as per the decision no. 02 of the personal hearing held on 31.08.2021 in light of the instructions issued by the Board vide letter no. 16536 dated 23.07.2021 for processing the CTE/CTO applications for stone crushers/screening/washing plants.</span></p>
<p class="MsoListParagraph" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%; mso-pagination: none; mso-layout-grid-align: none; punctuation-wrap: simple; text-autospace: none; margin: 12.0pt 6.0pt 10.0pt 4.5pt;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">Now, the unit has applied for fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 </span><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">for operation of screening & washing aggregates only @ 4,000 CFT/Day in the name of Sh. <p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">The unit has attached ownership documents such as affidavit dated 20.01.2023 by Sh. Gurmukh Singh S/o Sh. Gurbaksh Singh, wherein, it has mentioned that he has no partnership in the unit. </span><span lang="EN" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-ansi-language: EN;">He only looked after the maintenance and operation of the plant. </span><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">The unit has attached Partnership Deed executed on 30.09.2020 between Sh. Hardeep Singh and Sh. Kultar Singh, from which it is clear that Sh. Hardeep Singh and Sh. Kultar Singh are the current partners of the unit.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 72.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">Further, the unit has submitted the CA certificate dated 17.01.2023, wherein, the value of fixed assets of the unit as on 31.12.2022 is of Rs. 24.30 Lakhs with the value of plant and machinery of Rs. 15.00 lakhs. As per the record file, the fee was adequate upto 30.07.2023 under both the Acts. Now, the unit has deposited additional fee amounting to Rs. 4500/- vide UTR. No. N033232314076658 dated 02.02.2023, Rs. 1800/- vide UTR. No. N054232343416006 dated 23.02.2023 under the Water Act, 1974 and Rs. 4500/- vide R. No. 871417267 dated 20.01.2023, Rs. 1800/- vide UTR. No. N054232343403202 dated 23.02.2023 under the Air Act, 1981. After deducting 100% penalty as late application fee, the fee is now adequate upto 31.01.2026 under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 as per circular dated 29.10.2018.</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-justify: inter-ideograph; text-indent: 76.5pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;"> It is pertinent to mention here that the unit has not submitted the slips of obtaining raw material from the O/o Executive Engineer-cum-District Mining, Drainage cum Mining Division, Rupnagar/Sri Anandpur Sahib due to the non-operation of the unit from a long period and as per the undertaking attached, the unit shall get itself registered with the Deptt. of Mining after obtaining consent to operate under the Water Act, 1974 and the Air Act, 1981.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 78.0pt; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-weight: bold;">Further, the unit was visited by the AEE on 10.03.2023 and Sh. Hardeep Singh, Partner was contacted. During visit, it was observed as under:</span></p>

<p style="text-align: justify;"><span style="font-size: 11.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: 'Times New Roman'; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN; mso-bidi-language: PA;">The industry shall inform the Board in writing as and when any change is occurred in the Partnership Deed / Proprietorship / Memorandum of Article of Association, especially with regard to the name and address of the Partner / Proprietor / Director / Subscriber etc, and in any case the industry fails to do so and later on it comes to the notice of the Board that there is any change in Partnership Deed / Proprietorship / Memorandum of Article of Association, action as deem fit under the provision of said Act shall be taken.</span></p> |
