<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; background: white;">It was brought out that the residential project namely “Silver Oaks Homes” has been developed in </span><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">an area of 4.275 acres with 78 residential plots alongwith 08 commercial booths at Bibiwala Road, Bathinda. </span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The residential colony was granted consent to operate under the provisions of the Water Act, 1974 on 25.04.2013 (valid upto 30.09.2017) for discharge of domestic effluent @ 38 KLD onto land for plantation after treatment in common STP of capacity 500 KLD installed for four projects i.e. Silver Oaks City, Part-I; Silver Oaks City, Part-II; Silver Oaks Homes and Silver Oaks Avenue.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 135%;"><span style="font-size: 11.0pt; line-height: 135%; font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>Due to violations under the Water Act, 1974, the further consent applied by the project proponent was refused on 15.7.2019 and subsequently, environmental compensation of Rs. 1,18,750/- for the period from 16.08.2019 to 03.09.2019, was imposed on the project proponent. Thereafter, due to continuous non-<span style="background: white;">compliance</span> of provisions of Water Act, 1974 by the project proponent, following directions u/s 33-A of the Water Act, 1974 were issued to the project proponent and authorities concerned:-<span style="mso-tab-count: 2;"> </span></span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: .25in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-text-indent-alt: -.25in; line-height: 150%; mso-list: l2 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">i.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The project proponent was directed vide Board's letter no. 1465 dated 22.04.2021 not to sell any vacant residential / commercial plot or construct any house under group housing project or construct any house on the plot allocated for construction of house or make any expansion within the premises of colonies or shall not get released any electric power connection from PSPCL for newly constructed house, where no occupancy has been given without obtaining valid consent to operate under the Water Act, 1974.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .25in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-text-indent-alt: -.25in; line-height: 150%; mso-list: l2 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">ii.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">PSPCL authorities were directed vide Board's letter no. 1467-68 dated 22.04.2021 not to release any new electric power connection to any house / commercial shop / building already constructed or being constructed within the residential colony developed by the project proponent without no objection certificate and / or consent to operate of PPCB.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .25in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-text-indent-alt: -.25in; line-height: 150%; mso-list: l2 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">iii.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">Punjab Urban Planning & Development Authority was directed vide Board's letter no. 1471 dated 22.04.2021 to cancel the license issued to the project proponent for development of residential colony.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin-left: .25in; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-text-indent-alt: -.25in; line-height: 150%; mso-list: l2 level1 lfo2;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">iv.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">Sub Registrar-cum-Tehsildar, Bathinda vide Board's letter no. 1473 dated 22.04.2021 not to register any sale deed pertaining to the residential colony.</span></p>
<p class="MsoNormal" style="margin-bottom: 4.0pt; text-align: justify; line-height: 135%;"><span style="font-size: 11.0pt; line-height: 135%; font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>The project proponent has now applied for obtaining 'consent to operate' under provisions of the Water Act, 1974. From the perusal of the consent application submitted by the project proponent, it has been observed that assets of the colony have reduced from Rs. 12.0 crore to Rs. 2.12 crores as per CA certificate dated 30.03.2022.</span></p>
<p class="MsoNormal" style="margin-bottom: 4.0pt; text-align: justify; line-height: 135%;"><span style="font-size: 11.0pt; line-height: 135%; font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>The site of the colony was visited by the officer of the Board on 02.01.2023 and observed that:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: 22.5pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">Common STP installed for four projects i.e. Silver Oaks Homes, Silver Oaks City-I, Silver Oaks City-II and Silver Oaks Avenue. Present occupancy of the colony is of 234 houses. Approximate domestic effluent generation at present is 130 KLD.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 22.5pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The treated domestic effluent is discharged onto land for stagnation in the adjoining land area of the colony. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 22.5pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The plantation area developed by the colony is not properly maintained. </span></p>
<p class="MsoListParagraphCxSpLast" style="margin-left: 22.5pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The colony is a bulk waste generator, however no in-house management provided for treatment of the bio-degradable solid waste in compliance to the Solid Waste Management Rules, 2016.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 135%;"><span style="font-size: 11.0pt; line-height: 135%; font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>The <span style="background: white;">project proponent </span>was issued show cause notice before refusal of consent to operate under the Water Act, 1974 alongwith an opportunity personal hearing on 13.02.2023, which was postponed due to administrative reasons.</span></p>
<p class="MsoNormal" style="margin-left: 4.5pt; text-align: justify; line-height: 135%;"><span style="font-size: 11.0pt; line-height: 135%; font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>In view of above, the <span style="background: white;">project proponent </span>has been afforded another opportunity of personal hearing on 07.03.2023.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 140%; background: white;"><span style="font-size: 11.0pt; line-height: 140%; font-family: 'Tahoma','sans-serif'; background: white;">The hearing was attended by </span><span style="font-size: 11.0pt; line-height: 140%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-family: 'Times New Roman'; background: white;">Sh. Shawinder Singh, President (RWA) & Sh. Mangal Chand Mittal, Estate Officer. The representatives of the colony stated that </span><span style="font-size: 11.0pt; line-height: 140%; font-family: 'Tahoma','sans-serif'; background: white;">sewage treatment plant installed for the treatment of wastewater generated from all the four projects is working regularly & properly and the treated wastewater is utilized in the parks / along the roadside plantation and / or land area developed inside / outside the project boundary and stagnation has been removed. Compost pits provided for in-house treatment of the wet solid waste in the project premises. The balance consent fee alongwith amended C.A certificate submitted and thus requested for grant of consent. </span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; background: white;">After hearing the representatives of the project as well as officers of the Board, </span><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-family: 'Times New Roman'; background: white;">it has been decided by the Chairman of the Board that:</span></p>
<p style="text-align: justify; text-indent: -22.5pt; line-height: 150%; mso-list: l1 level1 lfo3; background: white; margin: 0in 0in .0001pt 22.5pt;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">i.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-family: 'Times New Roman'; background: white;">The</span><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"> project proponent shall operate the STP regularly & scientifically and will ensure no stagnation in the plantation area developed for disposal of the treated wastewater. </span></p>

<p style="text-align: justify; text-indent: -22.5pt; line-height: 150%; mso-list: l1 level1 lfo3; background: white; margin: 0in 0in 6.0pt 22.5pt;"><!-- [if !supportLists]--><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">iii.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The project proponent shall promote use of alternatives of single use plastics (SUP) and awareness to discourage use of plastic, through their Corporate Environment Responsibility (CER) activities.</span></p>
