<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">It is submitted that the industry was granted 'consent to operate' under the Water Act, 1974 vide no. CTOW/Varied/FGS/2019/12868435 dated 19/07/2020 and under the Air Act, 1981 vide no. CTOA/Renewal/FGS/2020/1286402 dated 19/07/2020 both valid upto 30/09/2023 for manufacturing of Steel Ingots @ 78.0 MTD with suitable conditions and special conditions following:</span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: -27.0pt; line-height: normal; mso-list: l1 level1 lfo4; margin: 0in 0in .0001pt .75in;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">The industry shall be liable to obtain environmental clearance as required under the EIA notification dated 14/09/2006, in case it increases its production capacity.</span></p>

<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -27.0pt; line-height: normal; mso-list: l1 level1 lfo4; margin: 0in 0in .0001pt .75in;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">9.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">The industry shall not install any furnace, D.G. set or other Air Polluting sources without obtaining prior. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: 45.0pt; line-height: normal; margin: 0in 0in .0001pt 9.0pt;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">The industry had applied for obtaining NOC for expansion from the Board in July, 2022 but the application were returned due to following reason:</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: 45.0pt; line-height: normal; margin: 0in 0in .0001pt 9.0pt;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">While processing the subject cited application, it has been observed that the industry has mentioned its present production capacity as 130 TPD in its DPR, whereas, in application form as well as consent to operate granted to it, the production capacity is 78 TPD. Further, the capacity of induction furnace is 6 T/heat, which can maximum go upto 72 TPD taking 2 hrs time for each batch including breakdown / cleaning etc. Further, Amended DPR was sought from the industry, which has still not been submitted. Accordingly, it has been decided by the Comp. Authority that the subject cited application be retuned back to the industry immediately with directions to submit fresh NOC application complete in all respect.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: 20.55pt; line-height: normal; tab-stops: 9.0pt; margin: 10.15pt 0in 10.0pt 9.0pt;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';"> Meanwhile, the industry was given personal hearing by the Chairman of the Board u/s 31-A of the Air Act, 1981 and notice for imposition of Environmental compensation (EC) due to the environmental damaged caused by operation of the industry was issued on 5/01/2023 and it was decided as under:</span></p>
<p class="MsoListParagraph" style="text-align: justify; text-indent: -30.9pt; line-height: normal; mso-pagination: none; mso-list: l0 level1 lfo3; tab-stops: 29.6pt .75in; text-autospace: none; margin: 0in 0in .0001pt .75in;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">Environmental compensation amounting to Rs. 2.5 Lacs be imposed upon the industry and the industry shall deposit the same within a week at Regional Office, Fatehgarh Sahib.</span></p>
<p class="MsoListParagraph" style="text-align: justify; text-indent: -30.9pt; line-height: normal; mso-pagination: none; mso-list: l0 level1 lfo3; tab-stops: 29.6pt .75in; text-autospace: none; margin: 0in 0in .0001pt .75in;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">The industry is advised to maintain & operate its Air Pollution Control Device in optimum and efficient manner in future, so as not to cause air pollution in the area.</span></p>
<p class="MsoListParagraph" style="text-align: justify; text-indent: -30.9pt; line-height: normal; mso-pagination: none; mso-list: l0 level1 lfo3; tab-stops: 29.6pt .75in; text-autospace: none; margin: 0in 0in .0001pt .75in;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">The industry shall apply for consent to operate under Air Act, 1981 alongwith requisite documents & fee within 3 days.</span></p>
<p class="MsoListParagraph" style="text-align: justify; text-indent: -30.9pt; line-height: normal; mso-pagination: none; mso-list: l0 level1 lfo3; tab-stops: 29.6pt .75in; text-autospace: none; margin: 0in 0in .0001pt .75in;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">It was made clear to the industry, if the industry falls to comply with aforesaid decisions and any Environmental Law in future, punitive action will taken against the industry, which include closure of the unit.</span></p>
<p class="MsoListParagraph" style="text-align: justify; text-indent: -30.9pt; line-height: normal; mso-pagination: none; mso-list: l0 level1 lfo3; tab-stops: 29.6pt .75in; text-autospace: none; margin: 0in 0in .0001pt .75in;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif';">Environmental Engineer, Regional Office, Fatehgarh Sahib shall visit the industry immediately, to verify the submission made during hearing and process the consent case of the industry on merits.</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: 83.5pt; line-height: 115%; margin: 10.15pt 0in .0001pt 11.55pt;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The proceedings were conveyed to the industry vide Board’s. Letter no. 213 dated 17/01/2023. </span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: 83.5pt; line-height: 115%; tab-stops: 6.5in; margin: 10.15pt 0in .0001pt 11.55pt;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The consent to operate under the Air Act, 1981 was cancelled by the Board vide letter no. 3275 dated 8/12/2022 due to violations reported by the Regional Office.</span></p>
<p class="MsoBodyText" style="margin-top: 10.15pt; text-align: justify; text-indent: 83.5pt; line-height: 115%; tab-stops: 6.5in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">In compliance decision no. 1 of the hearing, the industry has deposited EC of Rs. 2.5 Lacs vide no. 77/5512 dated 23/01/2023.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">In compliance decision no. 3 of the hearing, the industry has now applied for obtaining varied of 'consent to operate' under the Water Act, 1974 and fresh consent to operate under the Air Act, 1981 for manufacturing of </span><span style="font-family: 'Tahoma','sans-serif';">Billets (With CCM Plant) Or Round, Square, Hexa and Flats etc. (with rolling mill without reverberatory furnace) @ 78.0 MTD with</span><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';"> requisite documents and consent fee. The industry has submitted amended DPR for present production of steel ingots @ 78 MTD.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The consent fee earlier deposited by the industry was adequate upto 30/09/2023 against fixed assets of Rs. 544 lacs. The industry has now deposited consent fee of </span><span style="font-family: 'Tahoma','sans-serif';">Rs. 120000/- vide R. No. 272682818 dated 02/02/2023 under the Water Act, 1974 and Rs. 66000/- vide R. No. 780352712 dated 02/02/2023 and Rs. 54000/- vide R. no. 564687097 dated 5/01/2023 under the Air Act, 1981 </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">against the un-depreciated of fixed assets of Rs. 1582.70 Lacs as on 30/01/2023 as per CA Certificate dated 30/01/2023 and which is adequate upto <strong>31/07/2028</strong>. </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry has already deposited NOC regularization fee Rs. </span><span style="font-family: 'Tahoma','sans-serif';">21600/- vide UTR NO. N203222047840411 dated 21/07/2022 alongwith NOC application where the proposed project cost was Rs. 10.15 Cr and now has deposited addional NOC regularization fee of Rs. 2900/- vide R. no. 564687097 dated 5/01/2023. The total NOC fee is adequate for one year. </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The increase in the cost of fixed assets of about Rs. 1051.94 lacs<span style="color: red;"> </span>is mainly attributed towards installation of CCM plant & rolling mill section etc. </span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The industry has got its building plans approved from Er. Rishi Garg on 27/08/2022 (Competent person approved from Director of Factories, Punjab) after installation of CCM and rolling mill section only the type of product is being changed i.e. from ingots to billets.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';"> To verify the contents of the application and to check the compliance of decision of the hearing the industry was visited by undersinged of this office on <strong>06/03/2023</strong> and contacted Sh. Narinder Kumar, Director of the industry at site. During visit, it was observed as under:</span></p>

<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.5in; mso-list: l2 level1 lfo1; margin: 0in 0in .0001pt 1.0in;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-font-weight: bold;">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif'; mso-bidi-font-weight: bold;">The APCD i.e dust collector followed by bag house was checked and the representative of the industry claimed that they have replaced all the bag cloth filter with new ones and reconditioned its manometer’s from Sohan Pal Engineering Works, Mandi Gobindgarh. Sohan Pal Engineering Works, Mandi Gobindgarh (Manufacture and fabricators) have submitted the inspection report dated 12/12/2022 for the same. The industry has also submitted the invoice of the expenditure done on the purchase of new bag filters.</span></p>

<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';"> The Board vide letter no. 1955-57 dated 18/01/2023 has informed that department of Water Resources (RD and GR), Central Ground Water Authority, Ministry of Jal Shakti Govt. of India, New Delhi under Section 5 of the Environment (Protection) Act, 1986 has issued directions vide order dated 6/4/2022 that “It shall be mandatory for the project proponent abstracting ground water to obtain No objection Certificate from Central Ground Water Authority or the concerned State/UT Ground Water Authority as the case may be in the compliance conditions in consent to operate and consent to establish issued by the State pollution control Board”</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: 75.7pt; line-height: 115%; tab-stops: 7.0in; margin: 9.8pt 2.5pt .0001pt 12.0pt;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: 75.7pt; line-height: 115%; tab-stops: 7.0in; margin: 9.8pt 0in .0001pt 12.0pt;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries.</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: 75.7pt; line-height: 115%; tab-stops: 7.0in; margin: 9.8pt 0in .0001pt 12.0pt;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">The industry has claimed that it has taken adequate steps to comply with provision of the Air Act,1981 and operate its APCD efficiently but the compliance w.r.t. its claim shall be checked when the industry is in operation. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';"> </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify;"><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';"> In view of above mentioned facts, if approved, it is recommended that varied 'consent to operate' under the Water (Prevention & Control of Pollution) Act, 1974 and fresh consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 for production of </span><span style="font-family: 'Tahoma','sans-serif';">Billets (With CCM Plant) Or Round, Square, Hexa and Flats etc. @ 78.0 MTD</span><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';">, by installing CCM machines and </span><span style="font-family: 'Tahoma','sans-serif';">with rolling mill without reverberatory furnace</span><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Tahoma','sans-serif';"> may be granted to the industry upto <strong>30/09/2024</strong> with suitable conditions and following special conditions:</span></p>
