<p>Case Perused.</p>
<p style="text-align: justify;">The industry was granted consents to operate of the Board under the Water Act, 1974 and Air Act, 1981 vide nos. CTOW/Renewal/MKS/2019/10145134 and CTOA/Renewal/MKS/2019/10145049 both dated 20.07.2019 the production of lead alloys @ 5 TPD valid upto 30.06.2024.</p>
<p style="text-align: justify;">The industry has earlier proposed to install oven type furnace.</p>
<p style="text-align: justify;"> Therafter the industry was visited on 25.11.2022 and it was observed that the idustry was carrying out expansion by installing rotary furnace alongwith new APCD. </p>
<p style="text-align: justify;">Accordingly the industry was issued SCN for revocation of CTO and notice to issue directions u/s 33-A of Water ACt, 1974 and 31- A of Air Act, 1981 was issued to industry vide Zonal office letter no. 5716, 5720 dated 06.12.2022 alongwith an opportunity of personal hearing before Worthy Chief Environmental Engineer of the Board on 15.12.2022 and same was got postponed due to administrative reasons. Therafter the industy was issued notice to issue directions u/s 33-A of Water ACt, 1974 and 31- A of Air Act, 1981, SCN for revocation of CTO & authorization vide Board's letter no. 5920 dated 13.123.2022 to submit in writing within 07 days.</p>
<p style="text-align: justify;"> Now, the industry has applied for obtaining varied consent to operate under the Water Act, 1974 and Air Act, 1981 afer intsalling the rotary furnace & refining pot with new APCD. The industry has submitted a letter from joint Director, Director of Factories, Punjab vide no. LC/F-SA/3/2023-Factory dated 16.02.2023 which is reproduced as under : -</p>

<p style="text-align: justify;">As per the above letter, the industry has not proposed to increase production capacity. Therefore, the Department of Director of Factories has clarified that there is no requirement for obtaining permission from Site-Appraisal-Committee.</p>
<p style="text-align: justify;">The RO has visited the site of the industry on 24.02.2023 and observed that:</p>
<p style="text-align: justify;"> The industry was not in operation.</p>
<p style="text-align: justify;">2. The industry has provided dust settling chamber followed by twin cyclone, bag filter house and then alkali scrubber as APCD along with adequate sampling facility. The APCD installed by the industry with lead smelting furnace was found in line / in working condition.</p>
<p style="text-align: justify;">3. The industry has installed rotary furnace provided with dust settling chamber followed by twin cyclone, bag filter house and then alkali scrubber as APCD along with adequate sampling facility. The APCD installed by the industry with lead smelting furnace was found in line condition. The furnace is ready to commission.</p>
<p style="text-align: justify;">4. The industry has also provided the hood on the breaking section of scrap batteries and further connected with the APCD to contain the emissions to be generated during the breaking of batteries.</p>
<p style="text-align: justify;">5. The industry has provided the impervious floor for breaking of scrap batteries with proper slop to collect any acid present in the battery in pucca pit. Further, this acid has been stored in steel drum as hazardous waste storage.</p>
<p style="text-align: justify;">6. The industry has provided ETP consisting of storage tank -> reaction tank-cum-dosing tank-> outlet, to treat its effluent generated from the washing of battery cases before sale. This ETP is of capacity 1 KLD. The ETP was found not in operation due to the closing of washing section, however, the ETP was found in operational condition</p>
<p style="text-align: justify;">7. The industry has provided septic tank for treatment of its domestic effluent before discharging the same onto land for plantation.</p>
<p style="text-align: justify;">8. The industry has provide flow meter at the source of water supply and outlet of ETP and start maintaining record in this regard.</p>
<p style="text-align: justify;">9. The industry has provided display board at the main gate of the industry.</p>
<p style="text-align: justify;">10. The industry has provided 2 no. of DG sets of capacity 35 KVA and 25 KVA, respectively equipped with canopy and stack of adequate height. The industry is maintaining the record regarding hazardous waste generation / its disposal.</p>
<p style="text-align: justify;">11. The industry has now planted trees along its boundary wall.</p>
<p style="text-align: justify;">12. The industry is complying with the conditions of consents granted to it earlier under the Water & Air Act.</p>
<p style="text-align: justify;">13.The industry has stored hazardous waste under category 9.1, 9.3 i.e. spent acid of schedule-I in pucca storage room with lockable arrangement.</p>
<p style="text-align: justify;">In the point no. 5, it has been mentioned that the acid from the batteries is being stored in steel drums as Hazardous Waste and in point no. 13, it has been mentioned that category 9.3 is stored as Hazardous Waste.</p>
<p style="text-align: justify;">Further, the complete compliance w.r.t. SOP has not been provided. </p>
<p style="text-align: justify;">If approved, the case be sent to RO, BTI for clarifying the following whethter the Hazardous waste of category 9.3 is being generated from the process w.r.t. disposal of the same. RO to submit complete compliance w.r.t. SOP framed for such kind of units. </p>
