It is intimated that earlier directions u/s 33-A of Water (Prevention & Control of Pollution) Act 1974 were issued against the industry for its closure and to deposit Environmental Compensation amounting Rs. 2.0 lacs vide Board’s no. 3005 dated 19.05.2022. Accordingly, the PSPCL authorities were also directed vide Board’s letter no.  3007-10 dated 19.05.2022 to disconnect the power supply of the industry. The PSPCL Authorities have disconnected the power supply of the industry vide TDCO no. 106/1016 dated 23.05.2022.                     Thereafter, the industry applied for obtaining ‘Consent to Operate’ through OCMMS. The industry was give personal hearing before the Chairman of the Board on 25.07.2022 for not depositing Environmental Compensation @ 2 lacs, wherein it was decided as under:- <p class="MsoListParagraphCxSpMiddle" style="margin-left: 1.0in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -22.5pt; line-height: 150%; mso-list: l2 level1 lfo3;">1.     The industry shall deposit the EC of Rs. 2 lacs in 08 monthly installments of Rs. 25000/- each. <p class="MsoListParagraphCxSpMiddle" style="margin-left: 1.0in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -22.5pt; line-height: 150%; mso-list: l2 level1 lfo3;">2.     Consent to Operate under the Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act, 1981 be granted to the industry for six months. <p class="MsoListParagraphCxSpMiddle" style="margin-left: 1.0in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -22.5pt; line-height: 150%; mso-list: l2 level1 lfo3;">3.     Directions u/s 33-A of Water (Prevention & Control of Pollution) Act 1974 be issued to the PSPCL Authorities to restore the electric connection of the industry temporarily for six months.                        Accordingly, the industry was granted Consent to Operate under green category under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renew/LDH3/2022/18926542 dated 08.08.2022 and under Water (Prevention & Control of Pollution) Act 1974 vide no. CTOW/Renew/LDH3/2022/18926539 dated 08.08.2022, both were valid upto 07.02.2023 subjected to the conditions mentioned therein. The electric connection of the industry has also been restored vide Board’s letter no. 5112-15 dated 04.08.2022 for six months i.e. upto 02.02.2023.                      Now, the industry has applied for renewal of ‘Consent to Operate’ through OCMMS. The industry has deposited Rs. 2900/- vide UTR no. 606516847 dated 04.03.2023 as Air consent fee and Rs. 2900/- vide UTR no. 875987599 dated 04.03.2023 as Water Consent fee against the CA certificate of Rs. 54.33 lacs. The consent fee is adequate upto 31.01.2024 under both Acts. The industry was visited by the undersigned on 07.03.2023 and it was observed as under:- 1.    The industry is a small scale, green category plastic unit engaged in the manufacturing of industrial packing material of about 150 microns. 2.    The industry was in operation during the visit and the electric connection has not been disconnected by the PSPCL Authorities. <p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo2; tab-stops: 512.6pt; margin: 0in 4.7pt 10.0pt 22.5pt;">3.    The industry has installed 03 tube machines, 01 cutting machine and 01 printing machine. 4.    There is no source of trade effluent and only domestic effluent is being discharged into sewer. 5.    The industry has not installed any DG set. 6.    There was also a non-woven bag manufacturing machine installed in a room inside the premises. The said room was locked from outside. The said machine was not in operation. The representative informed that the said machinery is on rent and the tenant has not yet started any work. He further informed that they have not allowed the tenant to operate the industry, when they came to know about the action taken by the Board on other non-woven manufacturing units in the area as the manufacturing of non-woven bags has been banned by the Govt. of Punjab. He further informed that the said machinery will not be operated and sold out. 7.    The industry has deposited Environmental Compensation in 08 installments i.e. 25000 each/- vide receipt nos. 10/5480 dated 04.08.2022, 31/5480 dated 27.09.2022, 32/5480 dated 27.09.2022, 50/5480 dated 27.10.2022, 73/5480 dated 29.11.2022, 01/5481 dated 27.12.2022, 22/5481 dated 27.01.2023 and 48/5481 dated 27.02.2023.     8.    The industry was granted registration under Plastic Waste Management Rules, 2016 vide no. REG/PWM/Fresh/LDH/2020/F-36 dated 31.12.2020, which was expired on 30.12.2021.     9.     The PSPCL Authorities have been requested  to disconnect the electric supply of the industry vide this office letter no. 714 dated 24.02.2023, the Assistant Executive Engineer ( Commercial ), Estate Division, Giaspura has also been requested by the undersigned to submit compliance of directions issued by the Competent Authority of the Board. But, he informed that the PSPCL shall not disconnect the electric supply of any industry for non-compliance of other departments as per PSERC order dated 10.01.2023. The matter has already been reported through E-noting no.  21288546 dated 01.03.2023. <span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; font-weight: normal; mso-bidi-font-weight: bold;">  It is pertinent to mention here that as per Board's order no. 21 dated 08.06.2018, it has been decided that the existing industrial units/ other establishments which were established in residential/mix land zones before the notification of the master plan of the respective cities shall be allowed “consents/extension under the provisions of Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981 and authorization under the provisions of Hazardous Waste Management Rules, 2016 for a period of 15 years from the date of the notification of master plan alter taking the concrete documentary proof regarding the date of commissioning of such units. No separate approval from local bodies/other authorities is required to be obtained. The industry is complying with the previous conditions of consent to operate granted to it under Water (Prevention & Control of Pollution) Act, 1974.   Recommendations:- Keeping in view of above, it is recommended as under :- A. Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974  may be granted to the industry up to 30.06.2023 with suitable terms & conditions and with special conditions as under:- <p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level4 lfo1; margin: 0in 0in .0001pt 67.5pt;">1.    The industry shall shift its unit to the designated industrial area as per the provisions laid down under the notified Master Plan of Ludhiana or when asked by the Government/ Punjab Pollution Control Board. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level4 lfo1; margin: 0in 0in .0001pt 67.5pt;">2.    The industry shall obtain registration under Plastic Waste Management Rules, 2016 within 01 month. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level4 lfo1; margin: 0in 0in .0001pt 67.5pt;">3.    The Industry shall get registered on centralized portal developed by the CPCB as per EPR guidelines within 01 month.   <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level4 lfo1; margin: 0in 0in .0001pt 67.5pt;">4.    The industry will not provide any submersible pump and shall use only municipal supply as source of water consumption. <p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level4 lfo1; margin: 0in 0in .0001pt 67.5pt;">5.    The industry shall provide adequate arrangement for firefighting and against any accidental leakage/discharge of any air pollutant/gas/ liquids from the vessels, mechanical equipment's etc, which are likely to cause environmental pollution. The industry shall be obtained necessary permissions from the concerned authorities like Municipal Corporation, Ludhiana and Department of Labor/Director of Factories, Punjab with respect to the above safety measures.   B. Directions u/s 33-A of Water Act, 1974 may be issued to the PSPCL Authorities to restore the electric connection upto 30.06.2023.          Competency to decide the application:  Environmental Engineer, Regional Office-3, Ludhiana. Competency to decide the directions :- Hon’ble Chairman of the Board.
