CTOW/Fresh/RPN/2018/8894124 dated 27/12/2018 and under the Air (Prevention &amp; Control of Pollution) Act, 1981 vide no. CTOA/Fresh/RPN/2018/8894023 dated 27/12/2018 for functioning of a marriage palace to serve 500 persons/function subject to the suitable conditions, both of which were expired on 30/09/2021.</span></h2> <p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Thereafter, the Consent to Operate under the Water (Prevention &amp; Control of Pollution) Act, 1974 and under the Air (Prevention &amp; Control of Pollution) Act, 1981 were refused vide no CTOW/Renewal/RPN/2022/20102101 dated 17.10.2022 and vide no.</span> <span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">CTOA/Renewal/RPN/2022/19921471 dated 17.10.2022 due to non-compliance of marriage palace guidelines. </span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">&nbsp;Now, the marriage palace has applied for obtaining renewal of Consent to Operate under the Water (Prevention &amp; Control of Pollution) Act, 1974 and under the Air (Prevention &amp; Control of Pollution) Act, 1981 alongwith CA certificate, compliance of previous consent and consent fee. The marriage palace has submitted the CA certificate, wherein, the total value of fixed assets is Rs. 58.00 lakhs as on 31.08.2022.</span></p> <p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The marriage palace has earlier deposited Rs. 18000/- vide UTR No. SBIN322272045588 dated 29.09.2022 under the Water Act, 1974 and Rs. 18000/- vide UTR No. SBIN322272047050 dated 29.09.2022 under the Air Act, 1981. As such, the fee deposited by the marriage palace is adequate upto 30.09.2024 after deducting 200% penalty as per circular dated 29.10.2018.<span style="color: red;">&nbsp; </span></span></p> <p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Further, the marriage palace was visited by the AEE of this office on 10.03.2023 and Sh. Ramesh Kumar, Manager was contacted. During visit, it was observed as under:-</span></p> <p class="MsoListParagraphCxSpFirst" style="margin-bottom: 12.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">During visit, the function was going on in the marriage palace. The marriage palace is also using disposable items such as glasses, spoons etc. in the function.</span></p> <p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 12.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">The marriage palace has provided compost pits for the wet waste generated. However, the compost pits are not being utilized for disposal of wet waste and the same is being lifted to piggery farms as informed by the representative.</span></p> <p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 12.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">The marriage palace has not provided suction hoods/ducting in the kitchen area for exhaust of bhathi/tandoor emissions.</span></p> <p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 12.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">The marriage palace has provided oil &amp; grease trap for kitchen effluent followed by septic tank for the disposal of domestic effluent. Further, the disposal has been provided in the plantation area along the boundaries. However the treated effluent is not being utilized onto gardening/ plantation purpose.</span></p> <p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 12.0pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; line-height: 150%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; text-indent: 72.0pt; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">From above, it is clear that the unit is not complying with the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 72.0pt; line-height: 150%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">In view of above it is recommended that application for obtaining renewal of consent to operate under the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, may be refused and </span><span style="font-family: 'Bookman Old Style','serif'; mso-ansi-language: EN-IN;">action u/s 33-A of the Water (Prevention &amp; Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention &amp; Control of Pollution) Act, 1981 shall be initiated for closure/disconnection of electric connection of the unit.</span><span style="font-family: 'Bookman Old Style','serif';"> </span></p> <p>&nbsp;</p>
