It is intimated that the industry is a small scale orange category unit and the industry was earlier granted consent to operate under Water Act, 1974 vide no. CTOW/Varied/LDH3/2022/18129423 dated 23.03.2022 and Air Act, 1981 vide no. CTOA/Varied/LDH3/2022/18129428 dated 28.03.2022 for the production of Polyester cotton and cotton on job basis (washing) @ 9000 Kg/day & Polyester cotton and cotton on job basis (Finishing) @ 12000 Kg/day with trade effluent @ 47 KLD and domestic effluent @ 3.0 KLD into 15 MLD CETP. Both are valid upto 22.03.2023.                                Now, the industry has applied for renewal of consent to operate under Water Act, 1974 and Air Act, 1981 for the washing of  PC and cotton on job basis (washing) @ 9000 kgs/day and finishing of PC and cotton on job basis @ 12000 kgs/day with trade effluent @ 47.0 KLD and domestic effluent @ 3.0 KLD into 15 MLD CETP. The industry had already deposited Rs. 54,000/- vide R no. N202211573047801 dated 21.07.2021 under Water   Act, 1974 & Rs. 5600/- vide R. no. N201211572342047 dated 20.07.2021 as NOC regularization fee and Rs. 54,000/- vide R no. N202211573047400 dated 21.07.2021 under Air Act, 1981, which are adequate upto 30.06.2026 under both acts. The industry was visited by AEE of this office on 13.03.2023 and observed as under:- 1.    The industry was in operation and was engaged in washing and finishing of fabric. 2.    The industry is situated on the first floor and at the ground floor there exist a separate industry namely M/s Prime Processor, Swami Vivekananad Marg, Bahadurke Road, Bhattian, Ludhiana. 3.    The industry has installed 01 soft flow machine of 300 KG for the washing purpose and has also installed one stunter inside the premises. Both were in operation. 4.    The entire trade effluent and domestic effluent was being discharged into dedicated sewer system leading to CETP 15 MLD. 5.    The industry has installed a digital flow meter at the final outlet leading to CETP and the same was in operation. The industry is also connected with the server of CETP through SCADA system and the same was also operational. 6.    The record from the online SCADA system was checked and it was found that the average discharge of the industry during the month of September 2022, October 2022, November 2022, December, 2022, January 2023 and February, 2023 were found as 27 KLD, 21 KLD, 18 KLD, 14 KLD, 58 KLD & 34 KLD respectively, which are within the quantum of shares obtained and consent granted except one month i.e. January 2023, which is marginally beyond. 7.    The industry has installed a Thermo pack of Capacity 1500000 Kcal/hour with cyclones separate as APCD and having adequate stack height. During the visit rice husk was being used as fuel. 8.    The industry has installed 1 DG of capacity 300 KVA set with canopy inside the premises.    It is pertinent to mention here that, earlier the effluent samples from the outlet of industry leading to the inlet of the CETP were collected on 25.08.2021 and the same was sent to the Board’s lab for analysis. As per the effluent analysis report of the unit received from the Board’s lab, the concentration of such parameters i.e. COD and TDS was found as 1284 mg/l and 2184 mg/l, which are abnormally high as compare to the inlet design parameters of the CETP as per the DPR. Accordingly, notice issued u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 was issued to the industry with an opportunity of personal hearing before the Hon’ble Chairman of the Board on 29.09.2022 due to non-achievement of inlet effluent discharge standards as per the DPR of the CETP-15 MLD. During the hearing following decisions were taken:- 1.    Environmental Compensation amounting to Rs. 2.0 lacs shall be imposed upon the industry for violations under the provisions of Water Act, 1974. 2.    The industry shall install pretreatment plant, so as to achieve the inlet effluent standards of CETP as per DPR. The industry has failed to submit the compliance of above mentioned decisions till date and has also not deposited the EC amount of Rs. 2.0 lac imposed upon it.  In view of above, it is recommended that: <p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l2 level1 lfo2; mso-layout-grid-align: none; text-autospace: none; margin: 0in 0in .0001pt .75in;">1.    Show cause notice for refusal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 may be issued to the industry due to non- compliance of the decision taken by the Competent Authority of the Board during the hearing dated 29.09.2022. <p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l2 level1 lfo2; mso-layout-grid-align: none; text-autospace: none; margin: 0in 0in .0001pt .75in;">
