<p>Sir RO has reported that earlier a complaint regarding noise pollution due to operation of machinery in residential area was received in this office. Accordingly the site was visited by officer of this office on 04/10/2022 and it was and it was observed as under:-</p>
<p>1. The unit was in operation.</p>
<p>2. The unit is engaged in the manufacturing of artificial jewellery.</p>
<p>3. The unit has installed 03 no. dye cutting machines and 01 no. sheet cutting.</p>
<p>4. During visit, the representative of the unit could not produce any proof regarding classification of area.</p>
<p>5. Noise monitoring was carried out and the results were as following:-</p>

<p>The contribution of noise with operation of the unit is more than 10 db(A)</p>
<p>As per record of this office the unit has not obtained NOC/Consents from the Board. As the unit is violating the provisions of Air (Prevention and Control of Pollution) Act, 1981.</p>
<p>In view of the above, it is therefore recommended that action under the provisions of Air Act, 1981 may be initiated against the unit.</p>
<p>Accordingly, show cause notice has been issued vide Zonal Office letter no. 3740-41 dated 22/11/2022 before the Senior Environmental Engineer, Zonal Office, Amritsar on 07/12/2022.</p>
<p>Thereafter, the proceedings of the personal hearing were issued vide Zonal Office letter no. 3982-83 dated 13/12/2022, in which it was decided as under:-</p>
<p>1. The Industry shall take additional measures to control the noise further and to achieve noise levels well within prescribed norms, within 20-days.</p>
<p>2. The industry shall get the permission of Municipal Corporation, Amritsar u/s 79 of the Punjab Regional Town Planning & Development Act, 1995 amended in 2006 for operation of industry at existing site, within 20-days.</p>
<p>3. The Regional Office, Amritsar shall verify the status, measure noise levels also after stipulated period and submit detailed report along with clear cut recommendations accordingly.</p>
<p>As directed by <span lang="EN-IN">Competent Authority </span>of the Board the industry was visited by officer of this office on 27/12/2022 and it was observed as under:-</p>
<p><span lang="EN-IN">1. </span><span lang="EN-IN">The industry has not taken any additional measure to control the noise pollution and repeated complaints are being received against the industry.</span></p>
<p>2. <span lang="EN-IN">The industry has not submitted permission of Municipal Corporation, Amritsar u/s 79 of the Punjab Regional Town Planning & Development Act, 1995 amended in 2006, for operation of industry at existing site and noise monitoring of the industry is as under</span>:-</p>

<p>The contribution of noise with operation of the industry is more than 10 db(A) as compared to the industry not in operation.</p>
<p>Accordingly, it was again recommended that action u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 may be initiated against the unit for it closure please.</p>
<p>Thereafter, the <span lang="EN-IN">Competent Authority </span>of the Board has directed this office to seal the <span lang="EN-IN">plant and machinery of the industry. T</span>he industry was again visited by officer of this office on 01/02/2023 and <span lang="EN-IN">plant & machinery of the unit </span>has been sealed in the presence of representative.</p>
<p>Now, the unit has applied for obtaining consent to operate under Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974, under Green Category through OCMMS with required documents for manufacturing of Artificial Jewellery @ 30 Kgs/day by using Iron Sheet @ 25 Kgs/day & Copper Sheet @ 25 Kgs/day as Raw Materials.</p>
<p>The unit has deposited Rs. 10,000/- vide UTR No. CLBLN23058603119 dated 27/02/2023 under Air Act, 1981 and Rs. 10,000/- vide UTR/Ref. No. CLBLN23058603115 dated 27/02/2023 under Water Act, 1974 under VDS Scheme (Voluntarily Disclosure Scheme).</p>
<p>The unit has also deposited Rs. 8,100/- vide UTR/Ref. No. CLBLN23058603152 dated 27/02/2023 as consent fee under Air Act, 1981 and Rs. 8,100/- vide UTR/Ref. No. CLBLN23058603157 dated 27/02/2023 as consent fee under Water Act, 1974, which is adequate up to 31/12/2027 under both Acts.</p>
<p>The unit has also deposited Rs. 900/- vide UTR No. CLBLN23058603164 dated 27/02/2023 as NOC regularization fee and Rs. 500/- vide UTR/Ref. No. CLBLN23058603181 dated 27/02/2023 as an application form fee.</p>
<p>The unit has submitted Registered Deed, Copy of Trade License issued by MC, Amritsar vide no. PB-TL-2022-09-29-049121, Copy of receipt issued for Building Certificate issued by MC, Amritsar dated 31/03/2014, Copy of Building Plan NOC issued by Asstt. Town Planner, MC, Amritsar vide no. STP/ATP(B) dated 31/03/2014, Majornama signed by nearby residents, Copy of letter issued by MTP, MC, Amritsar vide no. MTP/1070 dated 08/02/2023, in which it is reported that the unit is in operation before the notification of the Master Plan of Amritsar and the industries/unit operating before the notification of Master Plan, Amritsar (2010-2031) are accommodated up to 2026 and CA Certificate. Further, the unit has submitted a request letter dated 01/03/2023, in which it is stated that even though the machinery installed by the unit has minimum impact and hardly make any contribution in ambient noise, yet they have installed rubber damper to control the noise and vibration of its machinery and also installed the glass enclosures/windows to keep the noise inside its premises.</p>
<p>The site of the industry was visited by officer of this office on 07/03/2023 and observed that:-</p>
<p>1. The unit was not in operation.</p>
<p>2. The unit is engaged in the manufacturing of artificial jewellery.</p>
<p>3. The unit has installed 03 no. dye cutting machines and 01 no. sheet cutting.</p>
<p>4. The machines installed by the unit was lying sealed.</p>
<p>5. During visit, the representative of the unit produce the proof regarding classification of area which is issued by MTP, MC, Amritsar vide no. MTP/1070 dated 08/02/2023 as per which the unit is operating before the notification of Master Plan, Amritsar (2010-2031) and accommodated up to 2026.</p>
<p>6. The unit has also installed rubber damper beneath its machinery to control the noise and vibration of its machinery. Further, the unit has also installed the glass enclosures on the windows to keep the noise inside the premises.</p>
<p>It is further intimated that the unit is now complying with the provisions of under Water Act, 1974 and Air Act, 1981. </p>
<p>RO has recommended that </p>
<p>1) The consent to operate under Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 may be granted to the unit under Green Category up to 31/12/2026 with usual terms and conditions and special condition that the unit shall not discharge fugitive emissions/trade effluent from its premises.</p>
<p>2) The unit shall comply with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 issued from time to time.</p>
<p>3) The application of the unit may be sent to Zonal Office, Amritsar for de-sealing of plant & machinery please.</p>
<p>Accordingly, Consents approved by EE RO . then submitted for issuance of directions for de-sealing of the machinery of the unit as per details mentioned by AEE please.</p>
<p>In view of the above, it is recommended that the directions may be issued for desealing of the machinery as mentioned by the AEE. </p>
