A)   It is submitted that the industry is small scale red category dyeing unit. The industry was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOW/Renewal/LDH3/2019/10891648 dated 16.09.2019 & CTOA/Fresh/LDH3/2022/17650906 dated 06.01.2022, which are valid upto 30.06.2023 & 30.06.2025 respectively for Dyeing of Polyester Fabric @ 12 MTD with discharge of trade effluent @ 190 KLD into sewer after treated through ETP & domestic effluent @ 1.0 KLD into sewer and one boiler of capacity 05 TPH with Twin cyclone separator along with adequate stack height and two DG sets of 250 KVA and 125 KVA with subject to suitable conditions, please. B)   Thereafter, the industry was visited by AEE of this office on 01.12.2022 and it was observed that the industry was not in operation during visit. However, no machinery was found sealed during visit. The representative of the industry submitted that seals have been opened for repair/ maintenance. The industry had removed the seals of 02 soft flow of 300 kg each its own without any intimation/ approval of the Board. Accordingly, Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 was revoked vide letter no. 726-27 dated 14.02.2023 & Competent Authority of the Board has issued directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 vide Board's letter no. 730-33 dated 14.02.2023 to PSPCL authorities to disconnect the electric supply of the industry. This office has also requested vide this office letter no. 692 dated 20.02.2023 to PSPCL authorities to disconnect the supply of the industry. The PSPCL Authorities has disconnected the electric supply of the industry vide TDCO no. 116/298 dated 07.03.2023. C)   Now, the industry has applied for varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 through OCMMS for Dyeing of Polyester Fabric @ 18 MTPD with discharge of trade effluent @ 348 KLD & domestic effluent @ 1.5 KLD into conveyance system of CETP 50 MLD and one boiler of capacity 05 TPH & DG set of 250 KVA. D)  The industry has deposited consent fee of Rs. 14,400/- vide online receipt no. <span style="font-size: 8.0pt; line-height: 150%; font-family: 'Verdana','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: #2b4973; mso-bidi-language: PA;"> 613358082 dated 09.03.2023 under the Water Act, 1974, which is adequate upto 31.03.2024 & Rs. 43,200/- vide UTR. No. N312211705953936 under Air Act, 1981, which is adequate upto 31.08.2025. The industry has deposited Rs. 2200/- vide online receipt no 527719421 dated 09.03.2023 as NOC regularization fee. E)   The industry was visited by AEE of this office on 11.03.2023 and it was observed that:- 1.         The industry was not in operation during visit, due to electric disconnection. 2.         The industry has installed 4 soft flow of 450 Kg, 4 soft flow of 300 Kg, 1 soft flow of 150 Kg & 01 sample soft flow machine i.e. total 23 chambers of soft flow machines. The industry has removed the 02 soft flow machines of 100 Kgs each and installed 01 soft flow of 150 Kgs in place of it. Earlier, 02 soft flow of 300 Kg were sealed by the Board due to excess discharge as compare to the share allotted to it. 3.         The study on effluent generation has been done by the Guru Nanak Dev Engineering College (GNE) and as per report it has total effluent generation as 420 KLD from its total 21 chambers of soft flow machines. However, presently the industry has total 23 chambers. The total effluent generation as per GNE calculation from 23 chambers will be 460 KLD, however, the industry has granted 348 KLD shares on 22.07.2022 of CETP, hence the discharge of the industry is 112 KLD more than the share allotted to it. Hence around 24% machinery of the industry i.e. total 5 chambers is required to be sealed i.e. 01 soft flow of 450 Kg (03 chambers) & 01 soft flow 300 Kg (02 chambers) with 05 % tolerance. 4.         The industry has submitted the detail of nos of lots, nos of bath, liquor ratio, production and corresponding effluent generation and same is enclosed in the list of the documents submitted by the industry and matching with the data given in the application form. As per the data the total production of the industry will be dyeing of polyester fabric @ 18 MTPD and effluent generation will be around 374 KLD from its entire machinery in 24 Hours. 5.         Presently the minimum value between the effluent generation as per GNE report and CETP share allotted to the industry is being considered by the Competent Authority for grant of consent as already approved in such cases. Accordingly, the industry presently has applied for trade effluent & domestic effluent discharge @ 348 KLD into CETP. 6.         The industry has also provided the arrangements for reusing its cooling water and steam condensate. 7.         The industry is connected with the conveyance system of CETP 50 MLD, Tajpur Road, Ludhiana for discharge its effluent. The industry has provided the flow meter at its final outlet leading to CETP and at tubewell. 8.         Further, some units have made the complaint regarding in judicial allotment of the shares by the PDA, Tajpur Road, Ludhiana, which is under process at Board and at Govt. Level. 9.         The industry has installed a boiler of capacity 05 TPH attached withTwin cyclone separator followed wet scrubber alongwith adequate stack height. 10.      Rice husk was lying at site used as fuel in its boiler. 11.      The air emission sample was collected on 20.09.2021 and as per analysis report, the SPM was found within prescribed limits. However, presently the industry is not in operation due to disconnection. 12.      The industry has installed two DG sets of 250 KVA and 125 KVA with canopy along with adequate stack height.                          Hence, till the finalization of the allotment of the shares of CETP 50 MLD, it is recommended that: 1.    Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 may be considered for grant for six month as approved by the Competent Authority in such cases for the discharge of trade effluent & domestic effluent @ 348 KLD into conveyance system of CETP 50 MLD at existing machinery subject to the condition that:- (i)      The industry shall make the necessary arrangements to achieve the effluent standards as per the inlet designed parameters of the CETP. (ii)    The industry shall stop discharging its effluent in case due to any reason the CETP is not operational or dedicated conveyance system is overflowing. (iii)   The industry shall maintain the record of flow meter installed at outlet leading to CETP. (iv)   The industry shall not generate/discharge trade & domestic effluent more than 348 KLD without obtaining prior permission of the Board. 2.    Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 be issued to the PSPCL authorities to temporarily restoration of electric supply of the industry for six month, please. 3.    Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 be issued to the industry to seal 01 soft flow of 450 Kg (03 chambers) & 01 soft flow 300 Kg (02 chambers) and suitable amount of Environmental Compensation be imposed on the industry due to de-sealing of its dyeing machinery at its own.
