<p class="MsoListParagraphCxSpFirst" style="margin: 0in 0in 12pt; text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">Accordingly, the industry was issued a show cause notice u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 vide letter no. 2151 dated 01.04.2022, along with an opportunity of personal hearing before the Chief Environmental Engineer on 09.03.2022, wherein, it was decided as under:</span></p>

<p class="MsoListParagraphCxSpLast" style="margin: 0in 0in 6pt 0.25in; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The Regional Office, Mohali shall process the consent application of the industry on merits and send further recommendations in the matter.</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 0in; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">Now, the industry has applied for fresh ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, for plating of Gravure cylinder @</span> <span style="font-family: 'Bookman Old Style', 'serif';">12000 Number/Year, along with requisite document. </span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 0in; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry has deposited Rs. 18,100/- vide UTR. no. N063221858484346 dated 04.03.2022 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 15,900/- vide UTR. no. N063221858507242 dated 04.03.2022 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 30.09.2026 (Considering of NOC fee @ Rs. 2200 and penalty as Rs. 4400/- for each Acts) for both the Acts against the fixed assets of Rs. 15.72 lakhs on 23.02.2023 (Considering the value of lease amount also).</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 0in; text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry has also submitted a copy of building plan signed by Sh. Jasvir Singh, Competent Person, under the Factories Act, 1948.</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 0in; text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry has submitted a copy of GST registration certificated dated 14.07.2021, as a proof of date of commissioning of the unit, alongwith the online application form.</span></p>
<p class="MsoNormal" style="margin-right: 0.2pt; text-align: justify; line-height: 24px;"><strong><u><span style="font-family: 'Bookman Old Style', 'serif';">Suitability of Site:</span></u></strong></p>
<p class="MsoNormal" style="margin: 0in 0.2pt 6pt 0in; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">The industry has submitted a classification of land use issued by DTP, SAS Nagar vide letter no. 404 dated 14.03.2022, wherein it has mentioned that Khasra no. 167/6 total 00 Bigha, 16 Biswa, 14 Biswasi is falls under ‘F.E.Z’ as per Proposed Land Use Plan, Lalru as such the site of suitable for setting up of the unit.</span></p>

<p class="MsoNoSpacing" style="margin: 0in 0.2pt 0.0001pt 0.25in; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry has executed an agreement dated 26.02.2022 with M/s Bantech Water Private Limited, Kurali for lifting of trade effluent @ 2000 ltrs/month.</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 0.0001pt 0.25in; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry has not installed any DG set from its premises.</span></p>

The industry has provided wet scrubber as APCD followed by stack of height 03 mtr. above ground level, to contain the emissions being generated from said tank.</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 0.0001pt 0.25in; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">8.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">The industry has constructed a 02 stage septic tank for the domestic effluent being generated from the unit, after passing through which, the same is discharged onto land for plantation developed in front of boundary wall.</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 0.0001pt 0.25in; text-align: justify; line-height: 24px;"><span style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';"> </span></p>
<p class="MsoNoSpacing" style="margin-right: 0.2pt; text-align: justify; line-height: 24px;"><strong><u><span style="font-size: 10.5pt; line-height: 21px; font-family: 'Bookman Old Style', 'serif';">Recommendations:</span></u></strong></p>

<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 22.5pt; text-align: justify; text-indent: -22.5pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation at any time, under any circumstances.</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 22.5pt; text-align: justify; text-indent: -22.5pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry shall develop its project strictly in accordance with the layout / building plans approved / to be approved by the Competent Authority.</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 22.5pt; text-align: justify; text-indent: -22.5pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">7.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry obtain permission from PWRDA for abstraction of groundwater and shall comply with the guidelines issued by PWRDA from time to time.</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 22.5pt; text-align: justify; text-indent: -22.5pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">8.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry shall get its final building plan approved from Director of Factories within 02 months and shall submit a copy of the same to the Board within 15 days thereafter.</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 22.5pt; text-align: justify; text-indent: -22.5pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">9.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry shall ensure that due to operation of the project at the site, no nuisance for general public is created at any time and no public complaints are received.</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 22.5pt; text-align: justify; text-indent: -22.5pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">10.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.</span></p>
<p class="MsoBodyText" style="margin: 8.05pt -2.3pt 0.0001pt 22.5pt; text-align: justify; text-indent: -22.5pt; line-height: 24px; background: white;"><span style="line-height: 24px;">11.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="line-height: 24px;">The unit shall ensure that no nuisance is created in the vicinity of its premises from the operations of its service station. In case, any complaint is received against the unit, the Board shall be at liberty to revoke/ cancel this consent without giving any opportunity of hearing to the industry.</span></p>
<p class="MsoListParagraph" style="margin: 0in -2.3pt 0.0001pt 22.5pt; text-align: justify; text-indent: -22.5pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">12.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The adequacy/ efficacy of the pollution control and disposal arrangements shall be the sole responsibility of the project proponent and the project proponent shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time.</span></p>
<p class="MsoListParagraph" style="margin: 0in -2.3pt 0.0001pt 22.5pt; text-align: justify; text-indent: -22.5pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">13.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The Consent is being granted to the industry based upon the undertaking/ documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.</span></p>
<p class="MsoBodyText" style="margin: 8.05pt -2.3pt 6pt 22.5pt; text-align: justify; text-indent: -22.5pt; line-height: 24px; background: white;"><span style="line-height: 24px;">14.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="line-height: 24px;">In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.</span></p>
