<p class="MsoNoSpacing" style="margin-right: 0.2pt; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">It is submitted that the subject cited industry was earlier granted Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2021/17428535 dated 27/12/2021 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2021/17428353 dated 27/12/2021, both having validity upto 28/02/2023, for production of Recovered solvent after Distillation of spent solvents @ 15 Kilo Liters/Day and Thinners @ 05 Kilo Liters/Day.</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin: 0in 0in 0.0001pt 28.35pt; text-align: justify; line-height: 24px;"><span style="font-size: 1pt; line-height: 2px; font-family: 'Bookman Old Style', 'serif';"> </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 12pt; text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">Thereafter, the industry was issued a show cause notice u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 vide letter no. 7824 dated 30.12.2022, along with an opportunity of personal hearing before the Chief Environmental Engineer on 10.01.2023, wherein, it was decided as under:</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 0.0001pt 28.35pt; text-align: justify; text-indent: -21.25pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">On the bases of best assessment and judgment, an interim environmental compensation of Rs. 50,000 is imposed to the industry for the violations committed by it and the industry shall deposit the environmental compensation in the office of Environmental Engineer, Punjab Pollution Control Board, Regional Office, Mohali within one week.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 0.0001pt 28.35pt; text-align: justify; text-indent: -21.25pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">That the consent to operate granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 0.0001pt 28.35pt; text-align: justify; text-indent: -21.25pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry shall operate its wastewater treatment devices installed by it regularly and efficiently and achieve the ZLD.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 0.0001pt 28.35pt; text-align: justify; text-indent: -21.25pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry shall provide the flow meter on the line carrying condensate of reactor (ETP) to the cooling tower and shall maintain the record so as to verify the ZLD.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 0.0001pt 28.35pt; text-align: justify; text-indent: -21.25pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry shall ensure that no effluent (treated/untreated) is discharged into any sewer/nallah/choe etc.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 0.0001pt 28.35pt; text-align: justify; text-indent: -21.25pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry shall store the entire hazardous waste in a closed room in a scientific manner to comply with HWM Rules, 2016.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 0.0001pt 28.35pt; text-align: justify; text-indent: -21.25pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">7.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry shall comply with the SOP for recovery of spent solvent issued by the CPCB in March, 2018 in true letter and spirit.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 0.0001pt 28.35pt; text-align: justify; text-indent: -21.25pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">8.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The Environmental Engineer, Regional Office, SAS Nagar shall visit the industry personally to verify the statements of the industry made during the hearing, check the contents of the video (complaint) to identify the industry by whom the wastewater has been discharged and send his report/recommendations accordingly within 07 days, positively.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin: 0in 0in 6pt; text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';"> </span></p>
<p class="MsoNoSpacing" style="margin-right: 0.2pt; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">Accordingly, the ‘consent to operate’ granted to the industry was revoked by the Board, vide letter no. 441 dated 20.01.2023, as per decision no. 2 of the hearing above.</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 0in; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">Further, as per decision no. 1 above, the industry has deposited to Rs. 50,000/- as EC in this office, vide R. no. 79/5463 dated 02.02.2023.</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 0in; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">Now, the industry has applied for obtaining Fresh of ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Renewal of Air (Prevention & Control of Pollution) Act, 1981, for production of Recovered solvent after distillation of spent solvents @ 15 <span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-caps: small-caps;">KLD</span>.</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 0in; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">As per the record file, the earlier fee deposited by the industry is adequate upto 28.02.2023. Now, the industry has deposited additional fee of Rs. 47300/- vide R. no. 875813661 dated 28.02.2023 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 43200/- vide R no. 382996973 dated 28.02.2022 (considering NOC regularization fee of Rs. 3600/-), which is adequate upto 30.09.2026 for both the Acts against the fixed assets of Rs. 306.81 lakhs on 31.01.2023.</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 0in; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">It is worth to mention here that, as per record file of this office, the industry was granted authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 vide no. HWM/renew/SAS/2021/14400086 dated 22/01/2021 having validity upto 27/07/2021, subject to certain condition as mentioned therein. The said authorization was further extended upto 31.03.2026 subject to certain terms and conditions mentioned therein.</span></p>
<p class="MsoNoSpacing" style="margin: 0in 0.2pt 6pt 0in; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">Further, the industry was issued actual user certificate-cum passbook vide no. PPCB/ZP-I/2021/AUC/F-7 dated 22/01/2021 having validity upto 21/07/2021, for the procurement and processing of spent solvents @ 4500 T/year (category no. 20.2) of Schedule-I of HWM Rules, 2016 which was further extended upto 31.03.2026.</span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: 1in; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">Now, the site of the industry was visited by EE & AEE of this office on 14.03.2023 and it was observed as under:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin: 12pt 0in 0.0001pt 27pt; text-align: justify; text-indent: -27pt; line-height: 24px; background: white;"><span style="font-family: 'Bookman Old Style', 'serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry is engaged in business of solvent recovery of various chemical and same was in operation at the time of visit.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 6pt 27pt; text-align: justify; text-indent: -27pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry has installed plant consisting of 3 no. reactor (2 no. SS reactors of capacity 8 kl each and 1 no. SS reactor of capacity 3 kl) & 1 no. GLR reactor of capacity 8 KL with 3 no. distillation column with each reactor.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin: 0in 0in 6pt 27pt; text-align: justify; text-indent: -27pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry has still kept heaps of plastic drums consisting of raw materials as well as final products, in open space all over the premises of the unit.</span><span style="font-family: 'Bookman Old Style', 'serif';"> The industry has provided a small shed of 60’x25’ size only for storage of drums, which is inadequate to shelter all the drums. As such, heaps of plastic drums was found stored within the preemies in unscientific manner. Pictures are attached in the agenda note.</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin: 0in 0in 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; line-height: normal;"><span style="font-family: Bookman Old Style, serif;">4. </span></span><span style="font-family: 'Times New Roman'; font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal;"> </span><span style="font-family: 'Bookman Old Style', 'serif';">During visit, it was also observed that the industry has kept its raw material/product (solvents) at 02 locations nearby the premises of the unit in open and unscientific manner, the details of which is as under:</span></p>
<p> </p>
<p class="MsoListParagraphCxSpLast" style="margin: 0in 0in 6pt 21.3pt; text-align: justify; line-height: 24px;"><span style="font-size: 2pt; line-height: 4px; font-family: 'Bookman Old Style', 'serif';"> </span> <span style="font-size: 11pt; line-height: 16.8667px; font-family: 'Bookman Old Style', 'serif';">a. At a land parcel, which is located at a distance around 200 mtr. from the site of the industry. The said land is kutcha from the bottom and the drums are placed in unscientific manner. Further, spillage of solvent were also observed from the drums in the said land area. It was also observed that some half burnt drums were also lying in the said area. </span><span style="font-family: 'Bookman Old Style', 'serif'; text-indent: -36px;">Pictures are attached in the agenda note.</span></p>
<p class="MsoListParagraph" style="margin: 0in 0in 6pt 39.3pt; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">b.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">Further, the industry has also stored drums at another vacant land located at the distance of around 150 mtrs. from the site of the industry in open space and in unscientific manner. </span><span style="font-family: 'Bookman Old Style', 'serif'; text-indent: -36px;">Pictures are attached in the agenda note.</span></p>
<p class="MsoListParagraph" style="margin: 0in 0in 6pt 39.3pt; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="text-indent: -21.3pt; font-family: 'Bookman Old Style', 'serif';"><span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';">5. </span></span><span style="text-indent: -21.3pt; font-family: 'Bookman Old Style', 'serif';">The industry has now started the stabilization work of the area inside the premises of the unit and has provided pucca interlocking tiles in around 40% of area. However, half of the area is still kutcha and drums are still placed in the said area in unscientific manner. Picture are attached in the agenda note.</span></p>
<p class="MsoListParagraph" style="margin: 0in 0in 6pt 39.3pt; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-size: 11pt; line-height: 16.8667px; font-family: 'Bookman Old Style', 'serif';">6. The industry has installed 03 no. recovered solvent storage tank of different capacities (i.e. MS tanks of capacity 15 KL, 10 KL and 8 KL) and has installed 04 no. spent solvent storage tanks [2 no. PP storage tanks (20 kl each) & 2 no. SS 316 storage tanks (15 KL tank each)]. The vents are provided on all the recovered solvent storage as well as mixing tank / reactors and connected with common pipeline passing through condenser followed by dual carbon filters along with stack height, connected to the common header pipe leading to condenser and further venting out. However, the display of VOC analyzer was found out of operation during the visit and was thus not connected to server of CPCB and PPCB. </span><span style="font-family: 'Bookman Old Style', 'serif'; text-indent: -28.4px;">Picture are attached in the agenda note.</span></p>
<p class="MsoListParagraph" style="margin: 0in 0in 6pt 39.3pt; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif'; text-indent: -28.4px;">7.</span><span style="text-indent: -21.3pt; font-family: 'Bookman Old Style', 'serif';"><span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="text-indent: -21.3pt; font-family: 'Bookman Old Style', 'serif';">During the visit, it was observed that the katcha road outside the premises of the unit has now been stabilized with gatka by the nearby upcoming industrial unit of M/s Jai Parvati Forgings, which is just procuring land and is re-carpeting the entire road. No discharge from the industry was observed on the said road.</span></p>
<p class="MsoListParagraph" style="margin: 0in 0in 6pt 39.3pt; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-size: 11pt; line-height: 16.8667px; font-family: 'Bookman Old Style', 'serif';">8. The industry has installed an ETP for treatment of trade effluent generated from the plant such as cooling tower blow down, reactor CIP effluent etc. which comprises of collection tank, pH collection tank, clarifier, reactor, condenser and sludge drying beds (SDBs). The industry has not provided flow meter at the line through which treated wastewater is to be reused in cooling towers. Further, the entire area near the ETP was found in very unhygienic and bad condition. The ETP was not in operation during the visit and no record of operation of the ETP was provided during the visit. </span><span style="font-family: 'Bookman Old Style', 'serif'; text-indent: -28.4px;">Picture are attached in the agenda note.</span></p>
<p class="MsoListParagraph" style="margin: 0in 0in 6pt 39.3pt; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif'; text-indent: -28.4px;">9.</span><span style="font-family: 'Bookman Old Style', 'serif'; font-size: 11pt;">During visit, it was observed that the industry has also kept hazardous waste (distillation residue) being generated from its process, in open space at various places in its premises, in very unscientific manner. In this regard, as per the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, any process or distillation residue from purification process of solvent is covered under Category 36.1 of the said rules. However, the representative of the industry contended that the salt being generated from distillation process is non-hazardous in nature and is sold to some vendors. But the industry has not submitted any testing report of the said residue, mentioning its non-hazardous nature. </span><span style="font-family: 'Bookman Old Style', 'serif'; text-indent: -28.4px;">Picture are attached in the agenda note.</span></p>
<p class="MsoListParagraph" style="margin: 0in 0in 6pt 39.3pt; text-align: justify; text-indent: -0.25in; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif'; text-indent: -28.4px;">10.</span><span style="font-family: 'Bookman Old Style', 'serif'; font-size: 11pt;">During visit, it was also observed that the industry has cut down the waste plastic containers into smaller parts/pieces. The industry could not produce any agreement executed with the authorized waste collector for lifting hazardous waste of category 33.1, thus, apprehended that the industry might</span><span style="font-family: 'Bookman Old Style', 'serif'; font-size: 11pt;"> </span><span style="font-family: 'Bookman Old Style', 'serif'; font-size: 11pt;">sale these plastic parts to some</span><span style="font-family: 'Bookman Old Style', 'serif'; font-size: 11pt;"> </span><span style="font-family: 'Bookman Old Style', 'serif'; font-size: 11pt;">unauthorized vendors.</span><span style="font-family: 'Bookman Old Style', 'serif'; text-indent: -28.4px;">Picture are attached in the agenda note.</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin: 0in 0in 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">11.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry has installed one wood fired thermo pack of capacity 10 LKcal/hr, which is equipped with dust collector as APCD along with stack of adequate height.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">12.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The industry has installed 1 no. DG set of capacity 125 KVA, which is equipped with canopy and a stack of adequate height.</span></p>
<p class="MsoListParagraph" style="margin: 0in 0in 6pt 39.3pt; text-align: justify; text-indent: -0.25in; line-height: 24px;"> </p>
<p class="MsoListParagraphCxSpLast" style="margin: 0in 0in 6pt 21.3pt; text-align: justify; text-indent: -21.3pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">13.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">Over all housekeeping inside the premises of the unit was found in very bad condition.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';"> It is worth to mention here that it is very likely that the solvent being kept by the industry in open space can catch fire and become a huge environmental hazard, at any time. Further, it is also evident that the solvent / lechate getting stagnated in katcha space can contaminate soil as well as groundwater of the area.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span style="font-family: 'Bookman Old Style', 'serif';">From above, it is clear that the industry is not complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and with the decisions of the personal hearing held on 10.01.2023, intentionally and deliberately.</span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; line-height: 13.8pt; background: white;"><strong><u><span lang="EN-IN" style="font-family: 'Bookman Old Style', 'serif';">Recommendations:</span></u></strong></p>
<p class="MsoNoSpacing" style="margin-right: 0.2pt; text-align: justify; text-indent: 70.9pt; line-height: 24px;"><span lang="EN-IN" style="font-family: 'Bookman Old Style', 'serif';"> </span><span style="font-family: 'Bookman Old Style', 'serif';">In view of above, if may approved, following actions may be taken:</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0.2pt 12pt 0in; text-align: justify; text-indent: 76.5pt; line-height: 24px;"><span style="font-size: 2pt; line-height: 4px; font-family: 'Bookman Old Style', 'serif';"> </span><span style="font-family: 'Bookman Old Style', 'serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span style="font-family: 'Bookman Old Style', 'serif';">The application of the industry for obtaining fresh ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and renewal of ‘consent to operate’ under the Air (Prevention & Control of Pollution) Act, 1981, may be refused.</span></p>
