CTOW/Varied/RPN/2022/19773471 dated 12/10/2022 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/RPN/2022/19772437 dated 12/10/2022 both were valid upto 11/01/2023 for manufacturing of Chlorinated Paraffin Wax (CPW) @ 38,400 MT/Year and by-product as HCl @76,800 MT/Year subject to the suitable conditions and special conditions as below:</span></span></p>
<p class="MsoListParagraph" style="margin-left: 0.25in; text-indent: -0.25in; line-height: 115%; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px; font-family: Calibri, sans-serif;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px; font-family: Calibri, sans-serif; background: white;">The industry shall not generate or discharge any kind of trade effluent without prior permission of the Board.</span></p>

<p class="MsoListParagraph" style="margin-left: 0.25in; text-indent: -0.25in; line-height: 115%; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px; font-family: Calibri, sans-serif;">7.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px; font-family: Calibri, sans-serif; background: white;">The industry shall apply for authorization as required under the HWM Rules, 2016 specifically in reference to category no. 33.3 (empty containers). Further, the unit shall stop the trading of empty containers in open market and shall dispose-off the empty containers through authorized venders/entities, having valid authorization of the Board.</span></p>
<p class="MsoListParagraph" style="margin-left: 0.25in; text-indent: -0.25in; line-height: 115%; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px; font-family: Calibri, sans-serif;">8.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px; font-family: Calibri, sans-serif; background: white;">The industry shall ensure compliance of all the conditions imposed in the environmental clearance granted by MoEF&CC, Govt. of India, New Delhi vide letter no. J-11011/335/2012-IA II(I) dated 28.12.2020, in true spirit and shall submit pointwise compliance report to the Board.</span></p>
<p class="MsoListParagraph" style="margin-left: 0.25in; text-indent: -0.25in; line-height: 115%; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px; font-family: Calibri, sans-serif;">9.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px; font-family: Calibri, sans-serif; background: white;">The industry has already been established without leaving 5-10 m green belt all around the periphery of the unit as per the condition of the EC, therefore, the industry shall either have got the EC conditions amended as already decided or may get the existing plantation area plan approved from the SEIAA within a period of 03 months or the industry may seek exemption for this condition from the Competent Authority.</span></p>
<p class="MsoListParagraph" style="margin-left: 0.25in; text-indent: -0.25in; line-height: 115%; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px; font-family: Calibri, sans-serif;">10.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px; font-family: Calibri, sans-serif; background: white;">The industry shall not throw, burn or burry any solid wastes in open, outside premises or in drain / water bodies.</span></p>

<p class="MsoListParagraph" style="margin-left: 0.25in; text-indent: -0.25in; line-height: 115%; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px; font-family: Calibri, sans-serif;">12.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px; font-family: Calibri, sans-serif; background: white;">The industry shall ensure that there are no usages of single use plastic- thermocol disposable items such as water bottles / water pouches/water cups, plates, forks, spoons, straw etc. and single use decorating material made of plastic-thermocal or any other non-biodegradable material in the premises.</span></p>
<p class="MsoListParagraph" style="margin-left: 0.25in; text-indent: -0.25in; line-height: 115%; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px; font-family: Calibri, sans-serif;">13.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px; font-family: Calibri, sans-serif; background: white;">The industry shall properly handle and manage the solid wastes as per the provisions of the Solid Waste Management Rules 2016 and ensure that the solid waste is segregated & disposed of in an environmentally sound manner.</span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px;"> The industry has applied for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 alongwith compliance of EC conditions and previous compliance, location plan and layout plan. The industry has been issued Environmental Clearance from MoEF&CC for the products i.e. Chlorinated Paraffin Wax and Hydrochloric acid vide letter no. J-11011/335/2012-IA II(I) dated 28.12.2020.</span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px;"> The industry was visited by the officers of the Board on 17.01.2023 and Sh. Varinder Singh, Manager was contacted. During visit, it was observed as under:</span></p>
<p class="MsoListParagraph" style="margin-left: 18.75pt; text-indent: -18.75pt; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; font-family: Calibri, sans-serif;">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 11.5pt; font-family: Calibri, sans-serif; background: white;">The industry is currently engaged in the manufacturing of Chlorinated Paraffin Wax (CPW) @ 38,400 TPA and HCl @ 76,800 TPA by using chlorine gas evolved from the PACL, Naya Nangal for 300 working days of the year. HCL is produced as by-product.</span></p>
<p class="MsoListParagraph" style="margin-left: 18.75pt; text-indent: -18.75pt; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; font-family: Calibri, sans-serif;">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 11.5pt; font-family: Calibri, sans-serif; background: white;">The industry has installed 11 no. of reactors in its existing unit. Chlorine is transferred in gaseous form from the M/s PACL unit adjoining to it. Chlorine leakage sensors have been provided. The excess chlorine fumes/unabsorbed chlorine is sent back to PACL campus for final scrubbing. Before sending the final scrubbing, 12 no. absorbing tanks have been installed which absorb the excess chlorine and dilute HCL is formed. This HCL is thereafter stored in 9 no. of storage tanks having total capacity of 250 tonnes.</span></p>
<p class="MsoListParagraph" style="margin-left: 18.75pt; text-indent: -18.75pt; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; font-family: Calibri, sans-serif;">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 11.5pt; font-family: Calibri, sans-serif; background: white;">The unit under expansion has installed 16 no. reactors for manufacturing of Chlorinated Paraffin Wax (CPW) and the same is in operation. The excess chlorine absorption fumes/unabsorbed chlorine is sent back to PACL campus for scrubbing. The unit has not installed chlorine leakage sensors with the unit after expansion. As informed, quotation has been called and will be installed shortly.</span></p>
<p class="MsoListParagraph" style="margin-left: 18.75pt; text-indent: -18.75pt; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; font-family: Calibri, sans-serif;">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 11.5pt; font-family: Calibri, sans-serif; background: white;">The unit has not provided storm water collection tank for reusing in the industrial activities. Further, it has provided the provision/pucca drain for carrying the same outside the unit for open flow.</span></p>
<p class="MsoListParagraph" style="margin-left: 18.75pt; text-indent: -18.75pt; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; font-family: Calibri, sans-serif;">5.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 11.5pt; font-family: Calibri, sans-serif; background: white;">The industry has not provided 5-10 m plantation along the periphery of the unit in compliance to the EC condition and has not obtained exemption in the Environmental Clearance for the condition of leaving 5-10 m green belt all around the periphery of the unit from the Competent Authority. Further, the unit has not left any space on three sides of the plot to provide the said green belt.</span></p>
<p class="MsoListParagraph" style="margin-left: 18.75pt; text-indent: -18.75pt; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; font-family: Calibri, sans-serif;">6.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 11.5pt; font-family: Calibri, sans-serif; background: white;">The domestic effluent generated is being treated in septic tank which has been provided outside the premises without any provision/arrangements for utilization onto land for plantation.</span></p>
<p class="MsoListParagraph" style="margin-left: 18.75pt; text-indent: -18.75pt; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; font-family: Calibri, sans-serif;">7.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 11.5pt; font-family: Calibri, sans-serif; background: white;">The fresh water is obtained from M/s PACL for addition into process for production of HCL with excess chlorine and also to be used as cooling towers. Further, the industry has not provided water meter for the water consumption on the pipeline and as informed, the water meter has been installed on the pipeline coming from the M/s PACL industry in the PACL. No record is being maintained. The unit has been advised to install a separate water meter in the premises in compliance to the EC condition and maintain its record so that HCL generation can be matched viz-a-viz consented capacity.</span></p>
<p class="MsoListParagraph" style="margin-left: 18.75pt; text-indent: -18.75pt; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; font-family: Calibri, sans-serif;">8.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-kerning: auto; font-optical-sizing: auto; font-feature-settings: normal; font-variation-settings: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 11.5pt; font-family: Calibri, sans-serif; background: white;">The unit has not established a separate Environmental Management Cell (having qualified person with Environmental Science/Environmental Engineering/ specialization in the project area) equipped with full- fledged laboratory facilities shall be set up to carry out the Environmental Management and Monitoring functions as per EC condition. Further, as informed, the unit is using the laboratory already established in the PACL campus.</span></p>

During visit, there were some observations which are as above and the industry was advised to remove the said observations within 10 days. The industry on 27.01.2023 informed that they have removed the observations as observed during the visit on 17.01.2023. To verify the statement of the industry, the industry was visited on 27.01.2023 and observed as under:</span></p>

The representative of the industry informed that during obtaining the Environmental Clearance, the layout plan of the industry was shown and on the basis of this plan, the Environmental Clearance was granted and hence, no further, green belt is required in the industrial premises. In this regard, it is intimated that the industry was established without leaving the space of the 5-10 meter for the green belt all around the periphery of the industry. Therefore, the industry will have to get the EC conditions amended or may get the existing plantation area plan approved from the SEIAA within a period of 03 months or the industry may seek exemption for this condition from the Competent Authority.</span></p>

<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px;"> It is pertinent to mention here that the industry has not applied for obtaining authorization as required under the HWM Rules, 2016 specifically in reference to category no. 33.3 (empty containers). Further, the industry is not complying with all the conditions imposed in the environmental clearance granted by MoEF&CC, Govt. of India, New Delhi vide letter no. J-11011/335/2012-IA II(I) dated 28.12.2020.</span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px;"> The unit is not complying with the Environmental Clearance conditions and NOC/CTO conditions issued by the Board and is operating in violations to the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 intentionally and deliberately.</span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px;"> It was proposed to refuse the consent applied under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, after affording an opportunity of show cause.</span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px;"> The matter was considered by the Competent Authority and it was decided to take the action against the industry under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, after affording an opportunity of show cause- due to aforesaid reasons.</span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify;"><span lang="EN-US" style="font-size: 11.5pt; line-height: 17.6333px;"> Therefore, the industry was given an opportunity to show cause in person before the Chief Environmental Engineer, Patiala of the Board, in his office at Vatavaran Bhawan, Nabha Road, Patiala on 02.03.2023 vide letter no. 1357-58 dated 24.02.2023 which was postponed to 03.03.2023 due to administrative reasons.</span></p>

This layout plan is appended in the ElA report submitted to the MoEF&CC and is available on the Parivesh Portal of the MoEF&CC. Further, during presentation of the case before the Expert Appraisal Committee of the MoEF&CC, this layout plan and green belt shown in this layout plan was thread barely discussed there. We have made the plantation in an area of 2150 sqm within the boundary of the unit and 1875 sqm land area of the unit left outside the boundary to protect the plantation from due to movement and material handling activities. In addition to above, we have also maintained 33% area as green area within premises too.</span></p>
