CTOA/ Varied/ SAS/ 2022/ 19454979 dated 31/8/2022, validity upto 30/11/2022, respectively, for Residential Colony for 218 flats, subject to certain condition as mentioned therein. </span></p> <p class="MsoListParagraph" style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">The project proponent was granted consent to Establish (NOC) under the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 vide no. CTE/ Fresh/ SAS/ 2022/ 19453737 dated 14/10/2022 having validity upto 13/10/2023 for Residential colony having 486 flats (442 flats + 44 EWS flats) project namely Sandwoods Opulencia in the revenue estate of Vill. Bhagomajra, Distt. SAS Nagar in an area of 6.45 acres having built up area of 72892.6 Sqm, subject to certain condition as mentioned therein.</span></p> <p class="MsoListParagraph" style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">Earlier, the project proponent has applied for renewal of consent to operate under the Air (Prevention &amp; Control of Pollution) Act, 1981 (App. ID.&nbsp;20323767) but the same was returned due to some discrepancies. The project proponent was not installed mechanical composter at the site.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; margin: 0in 0in .0001pt .5in;"><span style="mso-bidi-font-family: Tahoma;">5)<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>The solid waste generated from the premises and same is being lifted by the private venders for the further treatment.</span></p> <p class="MsoListParagraph" style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">The project proponent has not installed Mechanical Bio-Composter for management of Solid Waste and also not provided smog gun to control dust emissions. </span></p> <p class="MsoListParagraph" style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">The project proponent is continuously violating the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 as well as has failed to comply with the conditions imposed in the consent to operate earlier granted to it under the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 as well as Environment Clearance conditions granted to it. It is evident that the project proponent is violating the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981, willfully causing pollution in the vicinity, thus violating the provisions of the said Acts, intentionally and deliberately. It was proposed to refuse the renewal of consent to operate applied by the project proponent under the provisions of the Air (Prevention &amp; Control of Pollution) Act, 1981, after affording an opportunity of personal hearing.<span style="mso-spacerun: yes;">&nbsp; </span></span></p> <p class="MsoListParagraph" style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">Therefore, the project proponent was served show cause notice <span style="mso-bidi-font-weight: bold;">for refusal of consent to operate applied</span> under the Air </span><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-fareast-language: EN-IN;">(Prevention &amp; Control of Pollution) </span><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">Act, 19814 and notice to issue directions u/s 33-A of the Water </span><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-fareast-language: EN-IN;">(Prevention &amp; Control of Pollution) </span><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">Act, 1974 vide Board's letter no. 1435-36 dated 28/2/2023 along with an opportunity of personal hearing before the Chairman of the Board on 10/3/2023.</span></p> <p class="MsoListParagraph" style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">But neither any representative of the industry attended the hearing nor submitted any reply in the matter. </span><span style="mso-bidi-font-family: Tahoma;">After hearing the officers of the Board, the Chairman of the Board decided as under:</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; margin: 0in .7pt .0001pt .5in;"><span style="mso-bidi-font-family: Tahoma;">1) <span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>The consent to operate applied by the project proponent under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 be refused as </span><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">project proponent has not installed smog gun and hence not complying with the environmental clearance conditions.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; margin: 0in .7pt .0001pt .5in;"><span style="mso-bidi-font-family: Tahoma;">2)<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>The Environmental Engineer, Regional Office, SAS Nagar shall visit the industry to verify its statements, process the application of the industry for consent to operate under the Water Act, 1974 and the Air Act, 1981 on merits and send the flash report report well before the date of hearing to be held before the Chairman of the Board. </span></p> <p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; margin: 0in .7pt .0001pt .5in;"><span style="mso-bidi-font-family: Tahoma;">3)<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>Notice u/s 31-A of the Air (Prevention and Control of Pollution) Act, 1981 be issued to the project proponent along with the personal hearing before the Chairman of the Board. </span></p> <p class="MsoListParagraph" style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="mso-bidi-font-family: Tahoma;">If approved, proceedings of the personal hearing as above may be conveyed to the project proponent and Environmental Engineer, PPCB, RO, SAS Nagar for compliance and sending the report, respectively.</span></p> <p><strong>(Note-Press the Reufsal Button, please)</strong></p>
