text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Thereafter, the project proponent applied for fresh Consent to Establish under the provisions of Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 for Industrial Plots @ 30.877 acres and Commercial Plots @ 3.432 acres and same was processed through OCMMS.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">Thereafter, the project proponent was issued show cause notice for refusal of consent to establish (NOC) from pollution angle alongwith an opportunity to submit reply within 15-days has been issued to the project proponent vide Board's letter no. 6650-51 dated 26.11.2021.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent had got zoning plan approved from CTP, Punjab vide no. 7723-CTP(Pb)/SP-454 dated 17.12.2021 as per which &ldquo;only green and orange category industries shall be permitted in the industrial park as per provisions of Master/Zonal Plan, SAS Nagar with approval of PPCB.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent was issued SCN for refusal of consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981 vide Board's letter no. 885-86 dated 28.01.2022 alongwith an opportunity of personal hearing before the Chairman of the Board through WEBEX on 23.02.2022.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent has submitted brief project report as per which total project cost is Rs. 111.86 crore. Further, the project proponent has submitted copy of Change in Land Use for an area of 5.1375 acres located at Village- Dehri &amp; Dhurali, Distt SAS Nagar obtained from Department of Town &amp; Country Planning, Punjab vide memo no. 632 CTP (PB)/SP-432-M dated 29.01.2019. As per layout plan approved by CTP on 30.10.2019, the project consists of 221 industrial plots in an area of 124955 sqm and 113 SCOs having FAR area of 29807 sqm, services such as STP, water-works &amp; toilets etc.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">As per the feasibility report the total estimated population for the overall project will be 8,909 persons. The total water requirement will be 356 KLD which will be met through ground water. About 285 KLD of wastewater will be generated from the full project. The wastewater generated will be treated in proposed Sewage Treatment Plant (STP) of capacity 350 KLD based on MBBR technology. Further, 11.61 acre of land (bearing Khetwat Number 37/34, Khatoni Number 42, Khasra Numbers, 16//14 (8-0), 15(8-0), 16 (2-0), 17 (6-0), 18 (8-0), 19 (8-0), 22 (5-16), 23 (1-6), Khatoni number 49 Khsra Number 17//11 (6-0) total 53 Kanal 02 Marla and Khsara Number 28 (383-15) of which 40 Kanal total 93 Kanal 02 Marla situated at Village Derri Tehsil and District SAS Nagar) has been taken on lease from Gram Panchayat and out of total 7.8 acre of land will be developed as green area for utilization of treated wastewater and 3.81 acres land has been reserved under Karnal Technology for utilization of excess treated wastewater, till GMADA sewer is laid &amp;connected. The treated waste water from 350 KLD STP will be used for horticulture demand in an area of 7.8 acre @ 174 KLD during summer; 57 KLD during winter and 16 KLD during monsoon and remaining will be used onto land for plantation onto 3.81 acre land to be developed as per Karnal Technology.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent has proposed to install 1 no. DG set of 63 KVA with canopy and adequate stack height. The project proponent had proposed that solid waste @ 1,782 kg/day will be generated from the project site and the solid waste shall be duly segregated into biodegradable and non-biodegradable components. A separate area will be earmarked for segregation of solid waste. Biodegradable waste will be composted by use of Mechanical Composter. The recyclable waste shall be sold to authorized vendors. Remaining waste will be dumped to authorized dumping site.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">As per master plan of SAS Nagar, the proposed site is classified as industry and warehouse zone intended for intended to be used for green industry, orange industry and warehouse uses such as Computer software development, Knowledge Park, Assembly and repair of computer hardware and electronic equipment, Printing, publishing and allied industries, Packing of dried foodstuff and Warehouse except for storage of chemicals. The sewerage plan and storm water plan enclosed with the application are not approved by GMADA.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project is a plotted industrial colony, bay shops and commercial SCOs. The built up area of the commercial SCOs is more than 20,000 sqm and as per reply submitted by the proponent vide clarification dated 25.10.2021 has submitted that only development work will be done by the promoter company and empty plots are being sold to individual plot owners.<span style="mso-spacerun: yes;">&nbsp; </span>Hence, the project not covered under of the EIA Notification, 2006.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">The project proponent has got zoning plan approved from CTP, Punjab vide no. 7723-CTP(Pb)/SP-454 dated 17.12.2021 as per which &ldquo;only green and orange category industries shall be permitted in the industrial park as per provisions of Master/Zonal Plan, SAS Nagar with approval of PPCB.</span></p> <p class="MsoNormal" style="text-align: justify; The project proponent has provided 71 ft wide area for choe and will develop green are of 100 ft width on either banks of this choe.</span></p> <p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l6 level1 lfo6;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">9.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The project proponent has proposed to provide mechanical composter for treatment of wet biodegradable waste and other solid waste will be sold to recyclers.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi;">It is worth to mention that the promoter company has procured 56.53 acres of land and has obtained CLU of 56.53 acres for development of Industrial park </span><span style="font-family: 'Tahoma','sans-serif';">the project consists of 221 industrial plots in an area of 124955 sqm and 113 SCOs having FAR area of 29807 sqm, services such as STP, water-works &amp; toilets etc. whereas, it has applied for consent to establish (NOC) for Industrial Plots @ 30.877 acres and Commercial Plots @ 3.432 acres.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">It is worth to mention here that the project proponent has also constructed many housing project in Kharar e.g. Sunny Enclave 177 acres, Sunny Enclave 134 acres and Sunny Heights etc. The project proponent is infamous for not providing proper treatment facilities for wastewater being generated from these projects and many cases are being filed against the project proponent in the court of law, bank guarantees encashed still the project proponent has not complied with Environmental Laws and <strong>the Board has put the project proponent in the category of chronic violator.</strong></span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">In this project also about 35% of development work has been completed and occupancy has also been provided in 02 plots, however, no construction work of the proposed STP has started till date. Even 40 showrooms have also been constructed and occupancy may start in those also but there is no treatment facility available for treatment of wastewater.</span></p> <p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi;">In view of the above, may if approved, it is recommended that consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 </span><span style="font-family: 'Tahoma','sans-serif';">for the establishment of Industrial Plots @ 30.877 acres and Commercial Plots @ 3.432 acres </span><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi;">may be refused and the directions issued by the Board vide letter no. </span><span style="font-family: 'Tahoma','sans-serif';">814-819 dated 31.01.2023 </span><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi;">may not be withdrawn until the project proponent provides proper STP and disposal arrangement of treat wastewater.</span></p> <p style="text-align: justify;"><strong>Competency: Worthy Chairman of the Board</strong></p>
