<p>Case Perused.</p>
<p>The industry was granted consents to operate of the Board under the Water Act, 1974 and Air Act, 1981 vide nos. CTOW/Renewal/MKS/2019/10145134 and CTOA/Renewal/MKS/2019/10145049 both dated 20.07.2019 the production of lead alloys @ 5 TPD valid upto 30.06.2024.</p>
<p>The industry has earlier proposed to install only oven type/ Mandir furnace.</p>
<p>Thereafter, the industry was visited on 25.11.2022 and it was observed that the industry was carrying out expansion by installing rotary furnace alongwith new APCD.</p>
<p>Accordingly the industry was issued SCN for revocation of CTO and notice to issue directions u/s 33-A of Water ACt, 1974 and 31- A of Air Act, 1981 was issued to industry vide Zonal office letter no. 5716, 5720 dated 06.12.2022 alongwith an opportunity of personal hearing before Worthy Chief Environmental Engineer of the Board on 15.12.2022 and same was got postponed due to administrative reasons. Therafter the industy was issued notice to issue directions u/s 33-A of Water ACt, 1974 and 31- A of Air Act, 1981, SCN for revocation of CTO & authorization vide Board's letter no. 5920 dated 13.123.2022 to submit in writing within 07 days.</p>
<p>Now, the industry has applied for obtaining varied consent to operate under the Water Act, 1974 and Air Act, 1981 after installing the rotary furnace & refining pot with new APCD. The industry has submitted a letter from joint Director, Director of Factories, Punjab vide no. LC/F-SA/3/2023-Factory dated 16.02.2023 which is reproduced as under : -</p>

<p>As per the above letter, the industry has not proposed to increase production capacity. Therefore, the Department of Director of Factories has clarified that there is no requirement for obtaining permission from Site-Appraisal-Committee.</p>
<p>As per the passbook of the industry the industry has procured raw material @ 144.162 MT from 25.02.2020 till 25.02.2021 & 419.211 MT from 25.02.2021 till 25.02.2022 & 170.44 MT from 25.02.2022 till 25.02.2023 which is less than the consented capacity.</p>
<p>The RO has visited the site of the industry on 24.02.2023 and observed that:</p>
<p>1. The industry was not in operation.</p>
<p>2. The industry has provided dust settling chamber followed by twin cyclone, bag filter house and then alkali scrubber as APCD along with adequate sampling facility. The APCD installed by the industry with lead smelting furnace was found in line / in working condition.</p>
<p>3. The industry has now installed rotary furnace provided with dust settling chamber followed by twin cyclone, bag filter house and then alkali scrubber as APCD along with adequate sampling facility. The APCD installed by the industry with lead smelting furnace was found in line condition. The furnace is ready to commission.</p>
<p>4. The industry has also provided the hood on the breaking section of scrap batteries and further connected with the APCD to contain the emissions to be generated during the breaking of batteries.</p>
<p>5. The industry has provided the impervious floor for breaking of scrap batteries with proper slop to collect any effluent generated during battery breaking.</p>
<p>6. The industry has provided neutralizing mechanism (@1KLD) consisting of storage tank -> reaction tank-cum-dosing tank-> outlet, to to treat effluent generated (if any) during the breaking lead bearing scrap. The neutralizing mechanism was found not in operation as there was no effluent generation however the neutralizing mechanism was found in operatable condition.</p>
<p>7. The industry has provided septic tank for treatment of its domestic effluent before discharging the same onto land for plantation.</p>
<p>8. The industry has provided flow meter at the source of water supply and outlet of ETP and start maintaining record in this regard.</p>
<p>9. The industry has provided display board at the main gate of the industry.</p>
<p>10. The industry has now provided adequate stack with 2 no. canopy equipped DG sets of capacity 35 KVA and 25 KVA, respectively however the same were found disconnected from the main line.</p>
<p>11. The industry has now planted trees along its boundary wall.</p>
<p>12.The industry has stored hazardous waste under category 9.1, 9.2 of schedule-I in pucca storage room with lockable arrangement.</p>
<p>13. The RO has provided compliance w.r.t. SOP conditions which is as under:</p>

Persons with higher lead levels (greater than 42 micrograms /dl) should be shifted immediately to non- lead activity areas and given special medical treatment till the lead levels come back to acceptable level (10- micrograms /dl).</p>

<p>Steps to minimize fugitive emissions of Lead.</p>
<p>i. The design of hood/fume collection system from the smelting/ refining operations (from metal tapping point, charging doors, furnace joints etc.) should be capable of collecting lead emissions and transfer to the air pollution control system.</p>
<p>ii. The storage and handling of all the raw materials, intermediates and products should be in covered area/ shed having concrete floors and mechanized equipment should be used to handle these materials as far as possible.</p>
<p>iii. The floors in the loading area should be kept wet through sprinklers to reduce the chances of lead particles/dust getting airborne.</p>
<p>iv. Any water used for washing, rain water etc., should be collected through separate pits (to delink this from the regular drain) for removing metallic lead etc. and the pit should have fine screens for passage of clear water.</p>
<p>v. The movement of vehicles to the administrative/ working/ production areas should ensure that only the trucks/vehicles involved in the material handling/transportation reach the work areas, and their tyres are washed before they leave these areas.</p>

<p>Since the industry is complying with the provisions of Water Act, 1974, Air Act, 1981 and SOP conditions. Also the industry has obtained permission from Director of Factories regarding no requirement of the SAC therefore the industry could be granted permission for installing additional machinery in the existing premises.</p>
<p>If approved, varied consent to operate under the Water Act, 1974 & Air Act, 1981 may be granted to the industry upto 26.02.2025 with suitable conditions along with following special conditions as under: -</p>
<p>1. The industry shall not operate Mandir Bhatti and Rotary Furnace simultaneously and in no case the production capacity of the industry shall exceed manufacturing of Lead Alloy @5 MTD.</p>
<p>2. The industry shall ensure that the total quantity of raw material i.e. used lead acid battery scrap lifted by it shall remain within the total permitted quantity on annual basis.</p>
<p>3. The industry shall provide the operational schedule and get analyzed its air emission sample from Board's lab within 2 months.</p>
<p>4. The industry will ensure compliance of SOPs prescribed by CPCB for such type of units, at all times.</p>
<p>5. The industry shall ensure the compliance of conditions of consents to operate under the Water Act, 1974 & Air Act, 1981; authorization under the Hazardous & Other Waste Management Rules, 2016 and conditions stipulated while issuing registration certificate-cum-passbook, at all times.</p>
<p> Competency: CEE (B) as notice u/s 33-A of Water Act, 1974 & u/s 31-A of Air Act, 1981 was issued against the industry.</p>
