CTE/Fresh/SAS/2022/17410316 dated 01.02.2023, valid till 31.12.2022 for the establishment of commercial project having 69 Showrooms & 12 Shops in an area of 3996.271 sq.mt. under the name and style of “Chandigarh Square” developed by M/s Krishang Buildtech Pvt. Ltd. subject to special conditions as under:</p>

<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-list: Ignore;">13.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]-->The project proponent shall provide all medical help, investigation and treatment of workers involved in construction of building and carrying out construction material and debris related to dust emissions.</p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-list: Ignore;">14.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]-->The promoter shall develop its residential complex as well as construct flats strictly in accordance with the layout / building plans approved / to be approved by the Competent Authority.</p>

<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-list: Ignore;">20.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]-->The project proponent shall install a water meter on freshwater supply and all modes of disposals.</p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; mso-list: l0 level1 lfo2;"><!-- [if !supportLists]--><span style="mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-list: Ignore;">21.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]-->The industry shall ensure compliance with provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986, and or any other environment law applicable to him and rules, circulars issued by the Board from time to time.</p>

<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;">Now, the project proponent has applied fresh Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 <span style="mso-spacerun: yes;"> </span>and Air (Prevention & Control of Pollution) Act, 1981 for construction of commercial project having 69 Showrooms & 12 Shops in an area of 3996.271 sq.mt.</p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;">The project proponent has submitted CA Certificate with the value of fixed assets of Rs. 14.67 crore. The project proponent has not linked consent fees, with the application applied under Water Act, 1974 and Air Act, 1981.</p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;">The project proponent has submitted Articles of Association on Krishang buildtech Private Limited.</p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;">The project proponent has submitted a copy of letter issued by Municipal Council, Zirakpur vide no. 4071 dated 22.09.2011 regarding land use of the project in which mentioned that:-</p>

<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;">The project proponent has submitted completion certificate of STP of 50 KLD installed by Ewalt Technologies Pvt. Ltd. along with dimensional drawing. The project proponent has submitted approved site plan from the Competent Authority MC Zirakpur.</p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;">The project proponent has submitted water balance chart, as per which total water requirement of the project is 18.22 KLD, and 14.58 KLD effluent will be generated which will be treated in STP of 50 KLD and after treatment <span style="mso-spacerun: yes;"> </span>8 KLD will be used for flushing purpose and remaining into MC sewer.</p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;">The project proponent has submitted copy of letter issued by MC, Zirakpur vide no. 400 dated 18.102.2021 for ensuring compliance of duties of bulk waste generators as given in Solid Waste Management Rules, 2016 by ensuring source segregation, providing compost pits, dust bins etc.</p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;">The project proponent has submitted copy of letter issued by MC, Zirakpur vide no. 401 dated 18.10.2021 intimating that sewerage connection of MC Zirakpur is available near the project site and they have no objection of disposal of 6.4 KLD treated wastewater of the project subject to deposition of charges and capacity of sewer available at that time.</p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;">On scrutinizing the application of the project proponent following observations were observed on 18.03.2023 with request to submit reply within 2 days.</p>
<p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="mso-spacerun: yes;"> </span>The project proponent has not linked consent fees with the application under Water Act, 1974 and Air Act, 1981.</p>

Now the project proponent has applied for fresh Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for installation of STP of capacity of 50 KLD based on MBR technology.</p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; mso-list: l1 level1 lfo3;"><!-- [if !supportLists]--><span style="mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]-->The project proponent has submitted letter of MC Zirakpur dated 18.10.21 regarding disposal of 6.48 KLD treated waste-water into MC sewer subject to deposition of charges and capacity of sewer available at that time. Hence, it is requested to submit latest clearance letter of MC sewer regarding release of sewer connection to the project for 6.48 KLD treated sewer.</p>

It is requested to resubmit the population and water balance calculation.</p>

<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;">The project proponent has submitted compliance report of the Consent to Establish under the provisions of Water (Prevention & Control of Pollution) Act, 1974 <span style="mso-spacerun: yes;"> </span>and Air (Prevention & Control of Pollution) Act, 1981 granted to it.</p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;">The site was visited by undersigned on 16.03.2023 and contacted Sh. Rajan, Sale head (9855151618). During visit it was observed as under:</p>

No occupancy has come in the project till date.</p>

Finishing work of 4<sup>th</sup> & 5<sup>th</sup> Floor is partially pending. The representative informed that 4<sup>th</sup> floor has been rented of to IT company and the complete floor will be used by them. The representative informed that on 5<sup>th</sup> floor they are planning to provide gaming zone & restaurant. He further informed that on 1<sup>st</sup> floor shops will come and on 2<sup>nd</sup> and 3<sup>rd</sup> floor are allocated for office spaces.</p>
<p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; mso-list: l2 level1 lfo1;"><!-- [if !supportLists]--><span style="mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]-->The project proponent has installed STP of 50 KLD as per dimensional drawing submitted with the application in basement 2. The treated water lines are connected with flushing tanks but the color coding of the pipe needs to be done.</p>
<p class="MsoListParagraphCxSpLast" style="text-align: justify; text-justify: inter-ideograph; text-indent: -18.0pt; mso-list: l2 level1 lfo1;"><!-- [if !supportLists]--><span style="mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]-->The project proponent has presently installed DG set of 125 KVA with canopy & inadequate stack height. The representative informed that the other DG set of 625 KVA & 380 KVA are yet to arrive at the site.</p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph;">In view of above, it is recommended that show cause notice for refusal of Consent to Operate applied under Water (Prevention & Control of Pollution) Act, 1974 <span style="mso-spacerun: yes;"> </span>and Air (Prevention & Control of Pollution) Act, 1981 with an opportunity of 7 days to submit reply in writing. <span style="mso-spacerun: yes;"> </span></p>
