It is submitted that the project proponent was granted fresh consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2022/17410316 dated 01.02.2023, valid till 31.12.2022 for the establishment of commercial project having 69 Showrooms & 12 Shops in an area of 3996.271 sq.mt. under the name and style of “Chandigarh Square” developed by M/s Krishang Buildtech Pvt. Ltd. subject to special conditions as under: 1.       The promoter company shall comply with the bye-laws of Master Plan, Zirakpur. 2.       The promoter company shall obtain permission from the PWRDA for the abstraction of groundwater. 3.       The promoter company shall properly handle and manage the solid waste as per the provisions of the Solid Waste Management Rules, 2016. 4.       The promoter company shall not generate any type of trade effluent from the project. 5.       The promoter company shall obtain other permissions from the competent authority, if need be. 6.       The promoter company shall make proper disposal arrangement and shall obtain the prior permission of the Board before giving any occupancy. 7.       The project proponent shall submit the complete drawing and design of the STP and its component at the time of obtaining consent to operate. 8.       The project proponent shall also ensure that the hazardous waste and e- waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste. 9.       The project proponent shall comply with the provisions of the Construction and Demolition Management Rules, 2016. 10.   The project proponent shall take all necessary steps to control the dust emissions to be generated from the construction activities of the project. 11.   The project proponent shall ensure that the vehicles carrying construction material and construction debris of any kind shall be cleaned before it is permitted to ply on the road after unloading of such material. 12.   The project proponent shall provide mask to every worker working on the construction site and involved in loading / unloading and carries of construction material and construction debris. 13.   The project proponent shall provide all medical help, investigation and treatment of workers involved in construction of building and carrying out construction material and debris related to dust emissions. 14.   The promoter shall develop its residential complex as well as construct flats strictly in accordance with the layout / building plans approved / to be approved by the Competent Authority. 15.   The promoter company shall make efforts to utilize the treated wastewater for other activities such as construction activities in the nearby area, irrigation of the public parks, green belt along the road side etc. 16.   The promoter shall not consume any fuel except HSD in DG set(s) without obtaining prior written permission from the Board. 17.   The project proponent shall install mechanical composter for the treatment of solid waste. 18.   The project proponent shall not give possessions to the owners without prior permission of the Board. 19.   The Project proponent will develop the project on its own risk & cost in regard to disposal arrangement. 20.   The project proponent shall install a water meter on freshwater supply and all modes of disposals. 21.   The industry shall ensure compliance with provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986, and or any other environment law applicable to him and rules, circulars issued by the Board from time to time. 22.   In case of any violation action u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 will be initiated for closure of the project proponent without further notice. Now, the project proponent has applied fresh Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974  and Air (Prevention & Control of Pollution) Act, 1981 for construction of commercial project having 69 Showrooms & 12 Shops in an area of 3996.271 sq.mt. The project proponent has submitted CA Certificate with the value of fixed assets of Rs. 14.67 crore. The project proponent has not linked consent fees, with the application applied under Water Act, 1974 and Air Act, 1981. The project proponent has submitted Articles of Association on Krishang buildtech Private Limited. The project proponent has submitted a copy of letter issued by Municipal Council, Zirakpur vide no. 4071 dated 22.09.2011 regarding land use of the project in which mentioned that:- “ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਸਬੰਧੀ ਆਪ ਦੀ ਮੰਗ ਅਨੁਸਾਰ ਲਿਖਿਆਂ ਜਾਂਦਾ ਹੈ ਕਿ ਨਗਰ ਕੋਸਲ, ਜੀਰਕਪੁਰ ਦੇ ਮਾਸਟਰ ਪਲੈਨ ਅਨੁਸਾਰ ਆਪ ਦੇ ਕਮਰਸੀਅਲ ਪ੍ਰੋਜੈਕਟ ਦੇ ਨਕਸੇ ਵਾਲੀ ਜਗ੍ਹਾਂ ਰਿਹਾਇਸੀ ਜੋਨ ਵਿੱਚ ਪੈਦੀ ਹੈ । ਇਹ ਜਗ੍ਹਾਂ ਨਗਰ ਕੋਸਲ ਹੱਦ ਵਿੱਚ ਆਉਂਦੀ ਹੈ । ਇਸ ਪ੍ਰੋਜੈਕਟ ਲਈ ਸਰਕਾਰ ਦੀਆਂ ਹਦਾਇਤਾਂ ਪੱਤਰ ਮੀਮੋ ਨੰ: 9/59 /08–5ਐਲ.ਜੀ. (3)/1166 ਮਿਤੀ 167–2008 ਇਸ ਨੂੰ ਸੀ.ਐਲ.ਯੂ.ਦੀ ਲੋੜ ਨਹੀ ਹੈ ।“ The project proponent has submitted completion certificate of STP of 50 KLD installed by Ewalt Technologies Pvt. Ltd. along with dimensional drawing. The project proponent has submitted approved site plan from the Competent Authority MC Zirakpur. The project proponent has submitted water balance chart, as per which total water requirement of the project is 18.22 KLD, and 14.58 KLD effluent will be generated which will be treated in STP of 50 KLD and after treatment  8 KLD will be used for flushing purpose and remaining into MC sewer. The project proponent has submitted copy of letter issued by MC, Zirakpur vide no. 400 dated 18.102.2021 for ensuring compliance of duties of bulk waste generators as given in Solid Waste Management Rules, 2016 by ensuring source segregation, providing compost pits, dust bins etc. The project proponent has submitted copy of letter issued by MC, Zirakpur vide no. 401 dated 18.10.2021 intimating that sewerage connection of MC Zirakpur is available near the project site and they have no objection of disposal of 6.4 KLD treated wastewater of the project subject to deposition of charges and capacity of sewer available at that time. On scrutinizing the application of the project proponent following observations were observed on 18.03.2023 with request to submit reply within 2 days. 1.        The project proponent has not linked consent fees with the application under Water Act, 1974 and Air Act, 1981. 2.       The project proponent is required to deposit NOC regularization amounting to Rs 2900/- for increase in assets amounting to Rs 42 Lakh. 3.       The project proponent was granted Consent to Establish under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for installation of STP of capacity 20 KLD based on SAF technology. Now the project proponent has applied for fresh Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for installation of STP of capacity of 50 KLD based on MBR technology. 4.       The project proponent has submitted letter of MC Zirakpur dated 18.10.21 regarding disposal of 6.48 KLD treated waste-water into MC sewer subject to deposition of charges and capacity of sewer available at that time. Hence, it is requested to submit latest clearance letter of MC sewer regarding release of sewer connection to the project for 6.48 KLD treated sewer. 5.       The project proponent is required to submit floor wise plan clearly showing the details of 69 Showrooms and 12 shops & mentioning built up area of project, for which it is applying for Consent to Operate. 6.       The project proponent in the feasibility report submitted along with NOC application has calculated population taking 5 person per SCO and show room but the calculation done is not right as the project proponent has also proposed restaurant and food court within its project as per information given during visit. It is requested to resubmit the population and water balance calculation. No reply received till date from the industry. The project proponent has submitted compliance report of the Consent to Establish under the provisions of Water (Prevention & Control of Pollution) Act, 1974  and Air (Prevention & Control of Pollution) Act, 1981 granted to it. The site was visited by undersigned on 16.03.2023 and contacted Sh. Rajan, Sale head (9855151618). During visit it was observed as under: 1.       The project proponent has completed the construction work at the site. No occupancy has come in the project till date. 2.       The project proponent has proposed to allocate 12 shops at ground floors to food court. Finishing work of 4th & 5th Floor is partially pending. The representative informed that 4th floor has been rented of to IT company and the complete floor will be used by them. The representative informed that on 5th floor they are planning to provide gaming zone & restaurant. He further informed that on 1st floor shops will come and on 2nd and 3rd floor are allocated for office spaces. 3.       The project proponent has installed STP of 50 KLD as per dimensional drawing submitted with the application in basement 2. The treated water lines are connected with flushing tanks but the color coding of the pipe needs to be done. 4.       The project proponent has presently installed DG set of 125 KVA with canopy & inadequate stack height. The representative informed that the other DG set of 625 KVA & 380 KVA are yet to arrive at the site. In view of above, it is recommended that show cause notice for refusal of Consent to Operate applied under Water (Prevention & Control of Pollution) Act, 1974  and Air (Prevention & Control of Pollution) Act, 1981 with an opportunity of 7 days to submit reply in writing.   *Competency - Chief Environmental Engineer.
